Book excerpt: This was an appeal from the St Louis Land Court on an action for partition. William Christy died in 1837 and his estate included numerous tracts of land, livestock and lots of slaves. His heirs included his 2 sons, 4 daughters and 4 grand-daughters - the daughters and grand-daughters had all since married. Mrs Martha J. Sweringen was one of the grand-daughters. The plaintiff (formerly Virginia N. Christy), now Mrs Smith was joined in this action by her husband Edwin B. Smith. The will of William Christy left land, buildings and other property to his wife and made provisions for the education of his children. General William Clark was named as an executor of the will. Martha T. Christy had pre-deceased William Christy. There were numerous problems and disputes concerning the will, the disposition of various plots of land and how the slaves remaining to the estate should be apportioned. The descendants of William Christy were therefore disputing and trying to sort out their various claims under his will. This particular case was brought on 9 February 1855 by Edwin and Virginia Smith for the partition of 14 plots of land. The two sons of William Christy had also died by this time. There had been an error in that Edmund, before his death, had received advancements beyond the fair value of his share. The petition by the Smiths set out that Martha J. Sweringen was entitled to a one fourteenth share. It also set out calculations for divided up the lots fairly to all the other heirs. The St Louis Land Court issued a decree of partition on the basis of the petition. This was then appealed by the Sweringens and all the other heirs. The Supreme Court reversed the decision due to errors at the previous hearing at the Land Court. The case was remanded for a further hearing at the court below so that amendments could be made. The opinion was written by Justice Napton, Justice Richardson concurring. Justice Scott wrote a dissenting opinion. He did not understand why Mrs Susan P. Christy, the widow of Howard Christy, was entitled to the relief she sought in regard to land assigned to her husband in the first partition, for which the title later failed.
