The Small Arms Survey 2007: Guns and the City offers new and updated information on small arms production, stockpiles, transfers, and measures, including a special focus on transfer controls. This year's thematic section explores the complex issue of urban violence with case studies on Burundi and Brazil as well as a photo essay by award-winning combat photographer Lucian Read. Book excerpt: This edited volume takes stock of the state of research and policy on the issue of Small Arms and Light Weapons (SALW), ten years after the UN first agreed to deal with the problem. The end of the Cold War originated a series of phenomena that would subsequently come to dominate the political agenda. Perhaps most symptomatic of the ensuing environment is the marked escalation in the scale and dynamics of armed violence, driven by the proliferation of SALW. Events in Rwanda, Somalia and Bosnia seared into global consciousness the devastating effects of this phenomenon, and of the necessity to engage actively in its limitation and prevention. This edited volume explores and outlines the research and policy on the SALW issue at this critical juncture. In addition to providing a detailed telling of the genesis and evolution of SALW research and advocacy, the volume features a series of essays from leading scholars in the field on both advances in research and action on SALW. It reflects on what has been achieved in terms of cumulative advances in data, methodology and analysis, and looks at the ways in which these developments have helped to inform policy making at national, regional and international levels. Alongside situating and integrating past and present advances in advocacy and international action, Controlling Small Arms also outlines future directions for research and action. This book will be of much interest to students of small arms, peace and conflict studies, peacebuilding, security studies and IR.

Available in PDF, EPUB and Kindle. Book excerpt: The United Nations Arms Trade Treaty became binding international law in late 2014, and although the text of the treaty is a relatively concise framework for assessing whether to authorize or deny proposed conventional weapons transfers by States Parties, there exists controversy as to the meaning of certain key provisions. Furthermore, the treaty requires a national regulatory body to authorize proposed transfers of conventional weapons covered by the treaty, but does not detail how such a body should be established and how it should effectively function. The Arms Trade Treaty: A Commentary explains in detail each of the treaty provisions, the parameters for prohibitions or the denial of transfers, international cooperation and assistance, and implementation obligations and mechanisms. As states ratify and implement the Treaty over the next few years, the commentary provides invaluable guidance to government officials, commentators, and scholars on the meaning of its contentious provisions. This volume describes in detail which weapons are covered by the treaty and explains the different forms of transfer that the Arms Trade Treaty regulates. It covers international human rights, trade, disarmament, humanitarian law, criminal law, and state-to-state use of force, as well as the application of the treaty to non-state actors.

Available in PDF, EPUB and Kindle. Book excerpt: While the high profile trial of Viktor Bout in New York will show some of the threats the world continues to face from unscrupulous private arms brokers, it only provides a glimpse into a much larger problem. Skilled at operating in the shadows and exploiting weak national arms transfer controls, arms brokers have funneled arms to almost every country under a UN arms embargoes in the last 15 years, often fueling armed conflict and serious human rights violations. The US has worked on at least 70 US prosecutions in the last five years that have charged defendants with crimes related to illegal arms brokering. Yet, it continues to face difficulties in bringing arms brokers to justice and shutting down criminal networks. The lack of effective legal systems addressing the arms trade in many countries enables illicit arms dealers to exploit regulatory gaps and carry out their activities with impunity. The US and the world need an effective global Arms Trade Treaty to help close these gaps and stop the irresponsible trade in deadly weapons.

Book excerpt: The diversion of conventional arms can occur at any stage in the transfer chain, adversely affecting security, stability, and sustainable development. Preventing the diversion of conventional arms is a key objective of the Arms Trade Treaty (ATT). In 2018 the ATT Working Group on Effective Treaty Implementation (WGETI) compiled a paper listing ‘possible measures to prevent and address diversion’. While diversion often occurs in the importing state, the ATT WGETI provides only a limited number of measures that can be taken to prevent and address such diversion. A comparison of the ATT WGETI paper and African small arms control instruments identifies significant overlaps, but also notable differences. African initial reports on measures to implement the ATT do not include information on national measures to prevent and address diversion in importing states.

Book excerpt: The absence of comprehensive, international legal obligations to prevent irresponsible transfers of arms has resulted in at least $2.2bn worth of arms and ammunition being imported by countries under arms embargoes between 2000 and 2010; To have real impact, a prospective Arms Trade Treaty (ATT) must include legally binding criteria that prevent arms transfers to abusers of human rights or into situations where there is a substantial risk that they will undermine development or exacerbate armed violence; The ATT can build on existing regional and sub-regional initiatives: as of 2012, 100 countries are already party to various regional agreements that include legally binding obligations to control the trade of arms and ammunition.

Available in PDF, EPUB and Kindle. Book excerpt: Shortlisted for the 2008 Young Authors Inner Temple Book Prize There are believed to be about 700 million small arms and light weapons (SALW) in the world, often contributing to highly destabilising security and other concerns in international law. SALW are the primary source of violations and abuses of humanitarian and human rights principles by states, rebels, terrorists and criminals. Many consider them the real weapons of mass destruction of our time, causing about half a million deaths annually. The unrestricted international transfer of SALW by states (99 states and 1000 companies involved in manufacturing and supply) is one of the major contributory and aggravating factors of this crisis; another is the illicit traffic in small arms. This book deals with the proliferation of SALW and their unregulated trade and transfer across borders. It addresses questions of definition, manufacturing, trade/transfer, and issues relating to state responsibility. The primary focus is on conventional small arms, in particular military-style weapons. The book tackles the core and most divisive legal problem of whether or not the laws relating to arms control and relevant norms of international law provide substantive restrictions upon the transfer of small arms by states. The application of the norms of international peace and security, non-intervention, humanitarian and human rights laws, and evolved relevant customary rules of arms control relating to these norms are considered particularly carefully. Questions of application and enforcement of relevant rules and institutional responses to the problem are also examined. The UN began considering an arms trade treaty in 2006; the publication of the book at this critical moment in time will make a positive contribution towards shaping the debate and aims to further enhance understanding in an area where close analysis is required.

Book excerpt: States and organisations recognise the centrality of international assistance to help states prevent, combat, and eradicate the illicit trade in small arms and light weapons (SALW). However, addressing SALW remains a serious challenge for many states. States and organizations have yet to tackle important questions about the practices of delivering, evaluating, and measuring SALW assistance. This report explores these questions and highlights areas where further work remains to be done. Looking partly through an aid-effectiveness lens, this report aims to help the international community work toward ensuring that assistance is being used optimally and that states are measurably benefiting.
