Book excerpt: Excerpt from The Doctrine of Non-Intervention With Slavery in the Territories From the time of the development of the Abolition movement until the beginning of the Civil War nearly three decades later, the American nation was agitated by the discussion of the slavery question. During the latter half of this period, beginning with the annexation of Texas in 1845, slavery was the dominant political issue. Over it the nation became sectionalized and the issue was resolved into a struggle between the two sections for political and industrial supremacy. The possession, first of the prospective Mexican acquisitions, later of the unorganized portion of the Louisiana Purchase, was the prize for which they strove, - the South to extend its system of slave labor to these regions, the North to restrain that system within existing limits and dedicate the future Territories and States to freedom. The long contest was characterized by great intensity and ever increasing bitterness, with the single exception of the period of "finality" which followed the Compromise of 1850; then, indeed, it was temporarily lulled into an unquiet sleep, - a sleep rudely terminated by the introduction of Douglas's Nebraska Bill in 1854. I can make allowance for difference in education, and doubt not the fre quent exercise of humanity in the master. I am not called Upon to speak of slavery in the States where it now exists; when those States came into the Union, no power over the subject was reserved to the General Government, and hence this power belongs to such States exclusively. But in discussing the expediency and the right Of extending this institution into free territory, it would he unpardon able in a legislator to shut his eyes against any thing legitimately bearing on the question. The charge, that the agitation of this subject tends to affect slave property in the Southern States is true to a certain extent. It is like the influence produced bygjhe emancipation of our own country from the thraldom of Great Britain upon shveral nations in Europe. So will the policy pursued by our Government in te gard to these newly acquired Territories, produce some moral effect upon the slave holding States themselves. Even the emancipation Of the slaves in the Northern States must have produced some influence in the South. I am not surprised that the emancipation of slaves by Mexico, the South American Republics, England, and Denmark, should press somewhat upon the Southern States, and produce a restiveness occasioned by the spread of principles hostile to this institution. This progress of freedom to the slave illy prepared the mind of the slaveholder for the intelligence that republican France, among her first legislative enactments, ex tended to her slaves the same liberty which she had won for her own citizens; and ratified the deed by inserting in her Constitution the short but comprehensive and memorable article, that slavery cannot exist in any territory belonging to France. Though this general progress of liberty may produce some effect in the South, it is demanding too much that all that the world is doing for liberal princi ples should stop on that account. Can the South ask more than the pledge, that slavery in the States where it now is, shall not be interfered with. Mr. Cass said: Mr. President, but four brief years are passing away, brief in the life of a nation, since this Hall resounded with angry and agitating discussions upon the very topics that now disturb and divide us, and since every breeze that spread out to the heavens the flag that waves over us our fathers flag, and blessed be God, yet our own brought us from crowded city and from lonely cabin, from hill, valley, and prairie, from ocean and lake, the echoes of anxiety and alarm, passing over the country, and which announced that a great people had reached a crisis in their destiny, which, for weal or for woe, might mark their history during long ages to come. Well, all this passed away by the mercy of Providence rather than by the wisdom of man, and a beautiful tribute was furnished to the inestimable value of free institutions; for there is not another Government under heaven which could have entered into such a trial, and come out of it unscathed. Peace and prosperity and good feeling were restored, and we looked forward to long years of tranquillity. The events now upon us are another illustration of the vanity of human expectations. But yesterday the whole hemisphere was without a cloud, even in the distant horizon. To-day the signs of an approaching tempest are audible and visible, and the only question which can ever put to hazard our union and safety, presents itself for solution. With the honorable Senator from Massachusetts Mr. Everett 1 frankly avow that I was filled with doubt and alarm during the troubles and contests, which were terminated by the compromise measures of 1850, and he who was unmoved, had more apathy or less apprehension than I had.J But though the ominous cry of Woe, woe to Jerusalem Uis once more heard, I do not believe that thecountry is in any danger, not the least; but still I do not deny that these frequent, almost periodical renewals, and revivals of this threatening subject, must necessarily produce irritation and excitement, tending to array one section of the country against another, and thus to weaken those ties of confidence and affection so essential to the permanence and tranquillity of this mighty Confederacy. Events, connected with our territorial aggrandizement, seemed as their necessary consequence, to lead to the former agitation; but the present one has burst upon us without warning, and, as I think, from causes which might have been avoided. Mr. President, I have not withheld the expression of my regret elsewhere, nor shall I withhold it here, that this question of the repeal of the Missouri compromise, which opens all the disputed points connected with the subject of congressional action upon slavery in the territory of the United States, ha.s been brought before us. I do not think the practical advantages to result from the measure will outweigh the injury which the ill-feeling, fated to accompany the discussion of this subject through the country, is sure to produce. And I was confirmed in this impression by what was said by the Senator from Tennessee, Mr. Jones, by the Senator from Kentucky, Mr Dixon, and by the Senator from North Carolina, Mr. Badger, and also by the remarks which fell from the Senator from Virginia, Mr. Hunter, and in which I fully concur, that the South will never derive any benefit from this measure, so far as respects the extension of slavery; for legislate as we may, no human power can ever establish it in the regions defined by these bills. And such were the sentiments of two eminent patriots, to vhose exertions we are greatly indebted for the satisfactory termination of the difiiculties of 1850, end who have since passed from their labors we may humbly hope, to their rewards. Book excerpt: Excerpt from Douglas Doctrine of Popular Sovereignty in the Territories: Its Counterpart I do not deny, but am pleased to acknowledge, that the gentleman has evinced varied tact and wariness in his arrangement. He states the position of the Republican Party on the Constitutional power of Congress over the Territories, and of the right and duty of Congress, in the exercise of that power, to prohibit, among other things, slavery therein, in the language of their Convention; he places the doctrine of the National Democracy in the line of irreconcilable opposition thereto, but admits it would be uncandid to deny that there are radical differences of opinion in that party, respecting the powers and duties of Congress, and the rights and immunities of the people of the Territories under the Federal Constitution, (on the subject of Slavery.) He then divides the National Democracy into three segments, upon the proper construction of the constitutional provision touching the powers of Congress over Slavery in the Territories; and after ignoring the interpretation of two of them, he declares himself, as usual, in favor of the following, as the Constitutional doctrine: First: Those who believe that the Constitution of the United States neither establishes nor prohibits Slavery in the States or Territories beyond the power of the people legally to control it, but 'leaves the people thereof perfectly free to form and regulate their domestic institutions in their own way, subject only to the Constitution of the United States.' Having given his reasoning in antagonism to the interpretation that the Constitution establishes Slavery in the Territories, to be vindicated as some of the National Democracy contend, either by the Territorial Legislature, or, in lack thereof, by Congress, or by the Judiciary, by virtue of Constitutional authority, and independent of any Legislative action whatever, as by some leaders of the Democracy is proclaimed, Mr. Douglas settles down to an array of facts and reasoning in support of his construction of the Constitution. Such is the plan of the treatise; he states and opposes the the conventional views of the Republican party - he wipes away the ultra interpretation of those of the Democracy who maintain that the Constitution creates Slavery in the Territories, either by subordinate Legislation, or, propria vigore; and concludes that the people of a Territory, and no other authority, have, under the Constitution, the right to regulate the question. Such is the system of his address, plain enough when analysed and stripped of various excrescences that profusely surround it. Book excerpt: Excerpt from The Crisis Slavery or Freedom: A Discourse, Preached in Williston and Hinesburgh, on Sundays, June 25th, and July 2d, 1854 During the present session of Congress, slavery has been crowned absolute monarch. Northern men with southern principles did the deed. Upon them rests the responsibility. But by being traitors to northern sentiment, they have been the means of bringing the issue before northern people and it is for them to decide which they will have, all slavery and no freedom, or all freedom and no slavery. The passage of the Nebraska bill sweeps away all compromises with slavery, so that not a vestige of them remains. This bill declares that the Missouri compromise of 1820, which solemnly forbade slave ry to go beyond 36 deg. 30 min., is inconsistent with the principles of non-intervention by congress with slavery in the states and territories as recognized by the legislation of 1850, commonly called the comepromise measures, is hereby declared inoperative and void. This measure is an open violation Of plighted faith. It drives us to the side of freedom at all peril to the union Of these states. If the union of these states depends upon maintaining the interests Of slavery and throttling freedom in New England, the union is a curse and ought to be broken - the sooner the better. Before we are driven to this al ternative, let us try what truth, justice and determined Opposition to the slave power will do in the present struggle. In the great con ict now commencing, says Horace Greeley, to resist the surrender of this union and government to the Slaveholders, we wish to know no party names or divisions. We desire to see enlisted under our ban ner all who are opposed to the invasion Of the free territories Of the north by the Slaveholders Of the south all who wish to see liber ty and not slavery the great interest of the state. We ask, who is ready to league together to dethrone the new monarch? Freedom has been betrayed and sacrificed. Its gates have been thrown Open by foul treachery, the invader has entered and revels in his spoils I A territory which one short year ago was unanimously considered by all, north and south, as sacredly secure by irrepealable law to freedom for ever, has been foully betrayed by traitor hearts and traitor voices, and surrendered to slavery. Book excerpt: Excerpt from Slavery; Attitudes About Slavery, Slave Trade: Excerpts From Newspapers and Other Sources By 1856 Lincoln was convinced that the sentiment in favor of white slavery prevailed in all the slave state papers, except those of Kentucky, Tennessee and Missouri and Maryland. The people of the South had an immediate palpable and immensely great pecuniary interest in the question; while, with the people of the North, it is merely an abstract question of moral right. Unfortunately, the latter formed a looser bond than economic self-interest in two billion dollars worth of slaves. And the Northern ability to resist was steadily undermined by the moral indifference to slavery epitomized by Douglas's willingness to see slavery voted up or down in the territories. The Dred Scott decision in 1857 convinced Lincoln that the kansas-nebraska Act had been the beginning of a conspiracy to make slavery perpetual, national, and universal. His house-divided Speech of 1858 and his famous debates with Douglas stressed the Specter of a conspiracy to nationalize slavery.
