Book Synopsis Judicial Review of Immigration Detention in the UK, US and EU by : Justine N Stefanelli
Download or read book Judicial Review of Immigration Detention in the UK, US and EU written by Justine N Stefanelli and published by Bloomsbury Publishing. This book was released on 2020-01-23 with total page 354 pages. Available in PDF, EPUB and Kindle. Book excerpt: Immigration detention is considered by many states to be a necessary tool in the execution of immigration policy. Despite the apparently key role it plays in immigration enforcement, the law on immigration detention is often vague, especially in relation to determining the circumstances under which prolonged detention remains lawful. As a result, the courts are frequently called upon to adjudicate these matters, with scant legal tools at their disposal. Though there have been some significant judgments on the legality of detention at the constitutional level, the extent to which these judgments have had an impact at the lower end of the judiciary is unclear. Indeed, it is the lower courts which are tasked with judging the legality of detention through habeas corpus or judicial review proceedings. This book examines the way this has occurred in the lower courts of two jurisdictions, the UK and the US, and contrasts this practice not only in those jurisdictions, but with judgments rendered by the Court of Justice of the European Union, a constitutional court at the other end of the judicial spectrum whose judgments are applied by courts and tribunals in the EU Member States. Although these three jurisdictions use similar tests to evaluate the legality of detention, case outcomes significantly differ. Many factors contribute to this divergence, but key among them is the role that fundamental rights protection plays in each jurisdiction. Through a forensic evaluation of 191 judgments, this book compares the laws on detention in the UK, US and EU, and makes recommendations to these jurisdictions for improvement.

Book Synopsis HC 833 - Financial Sustainability of Local Authorities 2014 by : Great Britain. Parliament. House of Commons. Committee of Public Accounts
Download or read book HC 833 - Financial Sustainability of Local Authorities 2014 written by Great Britain. Parliament. House of Commons. Committee of Public Accounts and published by The Stationery Office. This book was released on 2015 with total page 28 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Department for Communities and Local Government does not have a good enough understanding of the impact of funding cuts, either on local authorities' finances or on services. It is unclear whether the Department is exercising a cross government leadership role with respect to local government. It relies on data on spending and has little information on service levels, service quality, and financial sustainability. HM Treasury should better support the Department by ensuring compliance with its requests for information at future spending reviews. While the Department has identified that local authorities will need to change the way they deliver services to remain financially sustainable, it is unclear if it is providing sufficient leadership to ensure they can implement service transformation programmes successfully. Furthermore, if funding reductions were to continue following the next spending review, we question whether the Department would be in a position to provide assurance that all local authorities could maintain the full range of their statutory services. Overall, as pressure from cuts grows, so do the risks to local authorities' finances and their provision of services. The depth and quality of the Department's insight into these issues needs to keep pace with these changes, something it has struggled to achieve so far.
Book Synopsis Honour Based Crimes and the Law by : Mukaddes Gorar
Download or read book Honour Based Crimes and the Law written by Mukaddes Gorar and published by Routledge. This book was released on 2021-05-10 with total page 196 pages. Available in PDF, EPUB and Kindle. Book excerpt: Honour based violence and abuse manifests itself in different forms, and this book offers a comprehensive understanding of this phenomenon. This book argues that the limits of honour crimes must be defined more widely so that they include conducts and behaviours that originate from the patriarchal notion of honour, such as honour based oppression and breast ironing. The book provides a critical analysis and synthesis of the law in England and Wales and in the international human rights sphere. The relevant domestic legislation and cases are examined to reflect on whether adequate protection is provided for the victims and potential victims of honour based violence and abuse. Since honour based violence is a violation of human rights, the relevant international human rights law is examined to illustrate the perception of such crimes in the international arena. The effectiveness of any remedy for victims of honour based violence and abuse depends on its capability to change deep rooted behaviours in communities with honour based patriarchal values. This book argues that the law does not provide the effective impact required, in part due to patriarchal structures, and that more efforts should be dedicated to changes in education. It is held that there is a need for an educational programme that is especially designed to tackle violence and promote gender equality. The book will be essential reading for academics, researchers and policy-makers working in the areas of Human Rights Law, Criminal Law and Gender Studies.

Book excerpt: The Committee has summarised and evaluated it's work during the current Parliament in a short film entitled 'Closing the gap', available on the Committee's website. This report is intended to supplement the film and provide an overview of their work in different policy areas during the Parliament. Earlier summaries of their work in individual sessions of this Parliament are available on the website of the Liaison Committee. Based on discussions with key players in the fields of education and children's services the Committee decided that their future focus would be on the long tail of underachievement in education. This theme informed their work for the remainder of the Parliament as they sought to recommend changes to close the gap between disadvantaged children and young people, and their peers
Book Synopsis Parliaments and the European Court of Human Rights by : Alice Donald
Download or read book Parliaments and the European Court of Human Rights written by Alice Donald and published by Oxford University Press. This book was released on 2016-08-18 with total page 419 pages. Available in PDF, EPUB and Kindle. Book excerpt: The European system of human rights protection faces institutional and political pressures which threaten its very survival. These institional pressures stem from the backlog of applications before the European Court of Human Rights, the large number of its judgments that remain unimplemented, and the political pressures that arise from sustained attacks on the Court's legitimacy and authority, notably from politicians and jurists in the United Kingdom. This book addresses the theme which lies at the heart of these pressures: the role of national parliaments in the implementation of judgments of the Court. It combines theoretical and empirical insights into the role of parliaments in securing domestic compliance with the Court's decisions, and provides detailed investigation of five European states with differing records of human rights compliance and parliamentary mobilisation: Ukraine, Romania, the United Kingdom, Germany, and the Netherlands. How far are parliaments engaged in implementation, and how far should they be? Do parliaments advance or hinder human rights compliance? Is it ever justifiable for parliaments to defy judgments of the Court? And how significant is the role played by the Parliamentary Assembly of the Council of Europe? Drawing on the fields of international law, international relations, political science, and political philosophy, the book argues that adverse human rights judgments not only confer obligations on parliamentarians but also create opportunities for them to develop influential interpretations of human rights and enhance their own democratic legitimacy. It makes an authoritative contribution to debate about the future of the European and other supranational human rights mechanisms and the broader relationship between democracy, human rights, and legitimate authority.

Home Affairs Committee and published by The Stationery Office. This book was released on 2016 with total page 81 pages. Available in PDF, EPUB and Kindle. Book excerpt: UKVI altered its service standards timetable so that a higher proportion of new straightforward claims for asylum are given an initial decision within six months. This is at the same time as the number of applications is rising. The total number of main applications in the year ending September 2015 was 19% higher than in the year ending September 2014. In Q3 2015 the number of main applicants and dependants reached 12,028 compared to 7,567 in Q2 2015. The number of asylum applications surpassed the number of decisions made in Q3 2015. We are concerned that the department may not be able to maintain the service levels it has set itself on initial decisions for new asylum claims within 6 months. To do so may require further funding and resources. We recommend that the Home Office reconsider its country guidance on Eritrea, taking into account the findings of the Independent Advisory Group on Country of Origin Information. We will continue to monitor closely the proportion of successful and unsuccessful asylum applications from Eritreans

Book Synopsis HC 881 - Press Briefing of the FCA's Business Plan for 2014/15 by : Great Britain. Parliament. House of Commons. Treasury Committee
Download or read book HC 881 - Press Briefing of the FCA's Business Plan for 2014/15 written by Great Britain. Parliament. House of Commons. Treasury Committee and published by The Stationery Office. This book was released on 2015 with total page 87 pages. Available in PDF, EPUB and Kindle. Book excerpt: On the evening of 27 March 2014, the Daily Telegraph published an article on its website describing a forthcoming thematic review by the Financial Conduct Authority (FCA) into the life insurance market. The same story appeared in the print edition of the Telegraph the following day. The story, based on an advance briefing given by the FCA to the Telegraph earlier that week, gave a misleading impression of the scope of the life insurance review, and was published before the FCA had made any official announcement of its own. When the markets opened on 28 March, the share prices of several leading life insurers began to fall heavily. Only when the FCA published a clarifying statement about the scope of the review - several hours later that day - did share prices begin to recover. On the day following the publication of the Telegraph article, the Chairman of this Committee called for a "full and transparent explanation about how such an apparently serious mistake came to be made by our financial services watchdog--the body appointed by Parliament to enforce high standards of conduct". Simon Davis, Partner at Clifford Chance LLP, was subsequently appointed to conduct an investigation, and reported his findings in December 2014. The Committee records its thanks to Mr Davis for undertaking this work and for the evidence he gave to it.

Book Synopsis HC 736 - Financial Sustainability Of NHS Bodies by : Great Britain. Parliament. House of Commons. Committee of Public Accounts
Download or read book HC 736 - Financial Sustainability Of NHS Bodies written by Great Britain. Parliament. House of Commons. Committee of Public Accounts and published by The Stationery Office. This book was released on 2015 with total page 23 pages. Available in PDF, EPUB and Kindle. Book excerpt: The financial health of NHS bodies has worsened in the last two financial years. The overall net surplus achieved by NHS bodies in 2012-13 of £2.1 billion fell to £722 million in 2013-14. The percentage of NHS trusts and foundation trusts in deficit increased from 10% in 2012-13 to 26% in 2013-14. Monitor found that 80% of foundation trusts that provide acute hospital services were reporting a deficit by the second quarter of 2014-15. NHS England, Monitor and the NHS Trust Development Authority recognise that radical change is needed to the way services are provided and that extra resources are required if the NHS is to become financially sustainable. The necessary changes will require further upfront investment. Present incentives to reduce A&E attendance and increase community based care services have not had the impact expected. New incentives and strong relationships are needed to promote the more effective collaboration necessary for delivering new models of care.
