Available in PDF, EPUB and Kindle. Book excerpt: In the first half of the twentieth century, Americans' intense concern with sex crimes against children led to a wave of public discussion, legislative action, and criminal prosecution. Stephen Robertson provides the first large-scale, long-term study of how American criminal courts dealt with the prosecution of sexual violence against children. Robertson describes how the nineteenth-century approach to childhood as a single phase of innocence began to shift at the end of the century to include several stages of childhood development, prompting reformers to create legal categories such as statutory rape and carnal abuse to protect children. However, while ordinary New Yorkers' involvement in the prosecution of those offenses reshaped their understandings of who was a child and produced a new concern to establish the age of their sexual partners, their beliefs in childhood innocence and in a concept of sexuality centered on sexual intercourse remained unchanged. As a result, families' use of the law and jurors' decisions ultimately diminished the protection the new laws offered to children. Robertson's study, based on the previously unexamined files of the New York County district attorney's office, reveals the importance of child sexuality and sex crimes in twentieth-century American culture.

This book was released on 2020-10-21 with total page 722 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the justice gap and trial process for sexual assault against both adults and children in two jurisdictions: England and Wales and New South Wales, Australia. Drawing on decades of research, it investigates the reality of the policing and prosecution of sexual assault offences – often seen as one of the ‘hardest crimes to prosecute’ – across two similar jurisdictions. Despite the introduction of the many reform options detailed in the book, satisfactory outcomes for victims and the public are still difficult to obtain. Cossins takes a new approach by examining the nature and effects of adversarialism on vulnerable witnesses, jury decision-making and the structures of power within the trial process, to show how, and at what points, that process is weighted against complainants of sexual assault, in order to make evidence-based suggestions for reform. She argues that this justice gap is a result of a moralistic adversarial culture which fosters myths and misconceptions about rape and child sexual assault, thus requiring the prosecution to prove a complainant’s moral worthiness. She argues this culture can only be eliminated by a radical replacement of the adversarial system with a trauma-informed system. By reviewing the relevant psychological literature, this book documents the triggers for re-traumatisation within an adversarial trial, and discusses the reform measures that would be necessary to transform the sexual assault trial from one where the complainant’s moral worthiness is ‘on trial’ to a fully functioning trauma-informed system. It speaks to students and academics across subjects including law, criminology, gender studies and psychology, and practitioners in law and victim services, as well as policy-makers.

Sociologist Anne Nurse has synthesized studies spanning the fields of psychology, sociology, communications, criminology, and political science to produce this nuanced, accessible, and up-to-date account. Topics include the prevalence of abuse, the impact of abuse on victims and families, offender characteristics, abuse in institutions, and the efficacy of treatments. Written for people who care for kids, for students considering careers in criminal justice or human services, and for anyone seeking information about this devastating issue, Nurse’s book offers new public policy ideas as well as practical suggestions on how to engage in prevention work. Available in PDF, EPUB and Kindle. Book excerpt: Sexual Offences Against Children in India examines the evolution of the law pertaining to sexual violence against children, the judicial decisions since the inception of the POCSO Act till date with respect to aspects of the POCSO Act and the best practices from other developed jurisdictions for handling cases and victims of child abuse. Despite being prevalent, violence against children is often hidden or underreported, though its impact is widely acknowledged. In a country like India the vocabulary to communicate around sexuality and sexual abuse is almost non-existent. India has seen its journey from having no law on sexual abuse of children to having a “special” law in the form of the Protection of Children against Sexual Offences Act 2012 (POCSO Act). This book demystifies the problem of sexual violence against children in India pre- and post-POCSO Act. There is also a novel attempt to examine the implementation of the POCSO Act in the eastern Indian states of Odisha, Jharkhand and West Bengal, and if its objectives were being attained – in content, in implementation, and in impact. This book will be useful for police, judiciary and government officials, scholars, and researchers studying comparative aspects of dealing with sexual offence cases against children.

Identifying Child Molesters: Preventing Child Sexual Abuse by Recognizing the Patterns of the Offenders will teach you to better protect children from potential child sexual molesters long before any abuse can actually occur. Here you'll learn to recognize and understand the seemingly invisible steps that typically precede child sexual abuse. These stories of molesters, their families, and their victims, will enable you to more accurately see through a potential molester's charming demeanor and better protect the children in your life. Understanding the behavior that molesters often exhibit when trying to obtain access to children is essential to protecting children from their advances. By becoming familiar with this terrain you will find the courage and strength to decide what must be done, and the skills to follow through with the necessary actions. Such responses will appropriately curtail an offender's access to children and subsequent opportunities to molest. Identifying Child Molesters will teach you: how to recognize those who might molest how molesters typically 'charm’adults how societal attitudes help to foster child sexual abuse what to do when encountering a potential molester what physical and emotional damage molestation can cause to victims how to graciously avoid potentially dangerous situations Identifying Child Molesters: Preventing Child Sexual Abuse by Recognizing the Patterns of the Offenders clearly spells out the techniques that child sexual molesters so successfully use to charm adults into giving them access to children. When these strategies are seen and understood, adults can take much more direct responsibility for preventing child sexual abuse than was previously possible. Anyone who lives or works with children needs to own this book. The information you'll encounter in Identifying Child Molesters might startle you, but it might also help you save the life of a child!

Book excerpt: The Politics of Child Sexual Abuse is the first study of activism against child sexual abuse, tracing its emergence in feminist anti-rape efforts, its development into mainstream self-help, and its entry into mass media and public policy. Nancy Whittier deftly charts the development of the movement's "therapeutic politics," demonstrating that activists viewed tactics for changing emotions and one's sense of self as necessary for widespread social change and combined them with efforts to change institutions and the state. A lucid and moving account, this book draws powerful lessons about the transformative potential of therapeutic politics, their connection to institutions, and the processes of incomplete social change that characterize American politics today.

Book excerpt: Sexual Violence on Trial provides a contemporary critical examination of the investigation, prosecution and cultural contexts of sexual violence. It draws on Northern Ireland as a case study, while also drawing on experiences from other jurisdictions across the United Kingdom and island of Ireland. Public and academic debates concerning the high-profile ‘Belfast/Rugby Rape Trial’ and the subsequent Gillen review of the arrangements to deliver justice in serious sexual offence cases have been mirrored at a global level with movements such as #MeToo and #TimesUp. This book brings together the perspectives of practitioners and academics to discuss contemporary challenges surrounding the societal and legal framing of sexual violence. It examines key aspects of the criminal justice process including the challenges of supporting victims; of responding to a range of forms of sexual violence such as rape, peer abuse, intimate partner violence and forced-to-penetrate cases; as well as alternative perspectives and future reforms. It also considers broader debates including balancing the interests of victims and defendants; the impact of cultural myths and stereotypes; the challenges of the digital age; models of consent; legal representation for victims and anonymity and publicity surrounding trials. Written by leading authorities in the field, Sexual Violence on Trial will be of great interest to students and scholars of Criminology, Law and Sociology.
