Available in PDF, EPUB and Kindle. Book excerpt: This book focuses on the law of criminal procedure and sentencing in Western Australia. A considerable body of legislation and decisions has been in place for a period of time in Western Australia on both these subjects. This book consolidates this vast subject matter in a straightforward and practical manner. Drawing on the author's experience as a state prosecutor, in-house legal adviser, defence lawyer and criminal law tutor, the book provides an essential practical addition for the courts, practitioners, and students alike. The result is a summary of the law for students and younger lawyers, while providing a base for practitioners' research. Features * tables summarising more complicated areas such as joinder, jurisdiction, bail, trial by judge alone, standards of proof in challenging various admissions and spent convictions; * extracted principles for selected offences when it comes to sentencing. A key feature is an explanation of breach powers in sentencing; and * an emphasis and explanation of criminal procedure and sentencing in the Children's Court. Book Synopsis A Lesser Species of Homicide by : Kerry King
Download or read book A Lesser Species of Homicide written by Kerry King and published by UWA Publishing. This book was released on 2020-01-01 with total page 340 pages. Available in PDF, EPUB and Kindle. Book excerpt: There has been a dearth of longitudinal attention to the prosecution of ‘road traffic deaths’ in Australia and worldwide, surprising given more than 50 million people have died or been killed to date. Globally, the ‘road toll’ is estimated at 1.35 million per year. Almost all of those deaths are attributable to some form of human error. A Lesser Species of Homicide examines the shifting nexus where human error, fault, act or omission meet the question of criminal liability. In the first study of its kind in the world, Kerry King examines how parliaments, prosecutors, police and the courts have responded to deaths occasioned by the use of motor vehicles from the mid-twentieth century to the present, including the extent to which the community and judiciary have been prepared to label driving conduct culpable. She explores how our weddedness to the residual notion of ‘accident’, to speed, drink-driving, risk, masculinity and the broader driving culture, have intersected with the tenets of intention, negligence, dangerousness and carelessness to affect judgments about drivers’ conduct. Drawing on hundreds of cases, King carefully traces the construction of offences and case law while observing key emerging themes, including approaches to multiple fatalities, outcomes in cases involving vulnerable road users, the difficulties with prosecuting intoxicated drivers and, most importantly, trends in charging standards and sentencing. For rigour, one Australian jurisdiction, Western Australia, has been chosen as the site of inquiry, yet there is little evidence to suggest that the trends explored herein are peculiar or exceptional. The status quo elsewhere in Australia and overseas appears remarkably similar. A Lesser Species of Homicide seeks to explore how and why deaths on the road have been treated as a species apart.
Book Synopsis Principles of Sentencing by : Geraldine Mackenzie
Download or read book Principles of Sentencing written by Geraldine Mackenzie and published by . This book was released on 2010 with total page 324 pages. Available in PDF, EPUB and Kindle. Book excerpt: Sentencing in all Australian jurisdictions is now largely governed by legislation which prescribes some basic guidelines and principles. At the same time, the High Court and the State appeal courts have been more active in developing a sentencing jurisprudence, effectively standardising many of the core principles of sentencing law. However, judges and magistrates retain a wide discretion in almost every case, and lawyers argue many different, often disparate and sometimes inherently complex, factors. The authors of this book burrow through the maze of developing sentencing law to isolate, explain and critique the principles which operate across and between jurisdictions. They identify the key themes, analyse examples from the different jurisdictions and examine the exercise of judicial discretion both in the scope of factors that may be taken into account and in the choice of sanctions.

Book Synopsis Youth Crime and Youth Justice by : Hough, Mike
Download or read book Youth Crime and Youth Justice written by Hough, Mike and published by Policy Press. This book was released on 2004-11-04 with total page 80 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report presents the findings from the first national, representative survey of public attitudes to youth crime and youth justice in England and Wales. The findings illustrate the complex and multilayered nature of public opinion on this topic. They show that the public has a more pessimistic view of youth crime than is justified by official crime statistics. While most people say that they want the youth justice system to be tougher on young offenders, many are supportive of restorative or rehabilitative approaches when presented with detail on specific cases. Youth crime and youth justice is essential reading for academics, researchers, policy makers and practitioners in the fields of criminal justice, criminology, social policy, social work and probation.
