This book examines these controversies on three fronts: (1) the rise of intellectual property protections for plant varieties and the enclosure of the "genetic" commons; (2) the subsequent move of the agro-chemical industry from manufacturing fertilizers, pesticides, and herbicides to "manufacturing" seeds in the context of industrial agriculture; and (3) the emergence of overlapping regimes of domestic and multilateral treaties such as the Trade-Related Aspects of Intellectual Property (TRIPS, 1994), the Convention on Biodiversity (CBD, 1992) and the International Treaty on Plant Genetic Resources (ITPGR, 2004) from the 1990s on. Finally, this book speculates on possible directions that intellectual property protection for PGRs may take in the 21st century. While intellectual property protection for plants has been available in the United States since 1930, the decade of the 1960s saw the rise of Plant Variety Protections in Europe and by 1980, the U.S. Supreme Court embraced the idea that living organisms could be patented, paving the way for new plant varieties to receive utility patent protection in the U.S. "Seed Wars provides an excellent overview of the issues and suggests a range of options to overcome the ill effects of expanding intellectual property rights on access to plant genetic resources, seeds and plant varieties. Gazing at Bloody Lane where, in 1862, several Union assaults were brutally repulsed before they finally broke through, he marveled, "You couldn't get American soldiers today to make an attack like that." Why did those men risk certain death, over and over again, through countless bloody battles and four long, awful years ? Why did the conventional wisdom -- that soldiers become increasingly cynical and disillusioned as war progresses -- not hold true in the Civil War? It is to this question--why did they fight--that James McPherson, America's preeminent Civil War historian, now turns his attention. He shows that, contrary to what many scholars believe, the soldiers of the Civil War remained powerfully convinced of the ideals for which they fought throughout the conflict. And another soldier said simply, "I still love my country." McPherson draws on more than 25,000 letters and nearly 250 private diaries from men on both sides. Civil War soldiers were among the most literate soldiers in history, and most of them wrote home frequently, as it was the only way for them to keep in touch with homes that many of them had left for the first time in their lives. Significantly, their letters were also uncensored by military authorities, and are uniquely frank in their criticism and detailed in their reports of marches and battles, relations between officers and men, political debates, and morale. For Cause and Comrades lets these soldiers tell their own stories in their own words to create an account that is both deeply moving and far truer than most books on war. Battle Cry of Freedom, McPherson's Pulitzer Prize-winning account of the Civil War, was a national bestseller that Hugh Brogan, in The New York Times, called "history writing of the highest order." Book excerpt: How lawsuits around intellectual property in Brazil and India are impacting the patentability of plants and seeds, farmers’ rights, and the public interest. Over the past decade, legal challenges have arisen in the Global South over patents on genetically modified crops. In this ethnographic study, Karine E. Peschard explores the effects of these disputes on people’s lives, while uncovering the role of power—material, institutional, and discursive—in shaping laws and legal systems. The expansion of corporate intellectual property (IP), she shows, negatively impacts farmers’ rights and, by extension, the right to food, since small farms produce the bulk of food for domestic consumption. Peschard sees emerging a new legal common sense concerning the patentability of plant-related inventions, as well as a balance among IP, farmers’ rights, and the public interest. Peschard examines the strengthening of IP regimes for plant varieties, the consolidation of the global biotech industry, the erosion of agrobiodiversity, and farmers’ dispossession. She shows how litigants question the legality of patents and private IP systems implemented by Monsanto for royalties on three genetically modified crop varieties, Roundup Ready soybean in Brazil and Bt cotton and Bt eggplant in India. Peschard argues that these private IP systems have rendered moot domestic legislation on plant variety protection and farmers’ rights. This unprecedented level of corporate concentration in such a vital sector raises concerns over the erosion of agricultural biodiversity, farmers’ rights and livelihoods, food security, and, ultimately, the merits of extending IP rights to higher life forms such as plants.

Second, it proposes solutions - using recent developments of the "theory of the commons" - to improve the collective seed management system of the Treaty, a necessary condition for its member states to reach the overall food security and sustainable agriculture goals. Redesigning the Global Seed Commons provides a significant contribution to the current political and academic debates on agrobiodiversity law and governance, and on food security and food sovereignty, by analyzing key issues under the Treaty that affect the design and implementation of regulatory instruments managing seeds as a commons. It also examines the practical, legal, political and economic problems encountered in the attempt to implement these obligations in contemporary settings.
