Available in PDF, EPUB and Kindle. Book excerpt: The idea of compiling a bibliography of legal Festschriften originated with Lilly Roberts, and represented the most important creative side of her life during the last ten years of her association with the Universi ty of Michigan Law Library. The project received advice and counsel from the Foreign Law Com mittee of the American Association of Law Libraries. The final publi cation was made possible by an allocation from the grant made to the University of Michigan Law School by the Ford Foundation for re search in International and Comparative Law. Beverley J. Pooley Professor of Law Director of the Law Library University of Michigan PREFACE The present bibliography is international in scope; it covers Fest schriften published in many countries. It includes Festschriften from 1868 (date of the earliest legal Festschrift found) through December, 1968. A bibliography of all legal Festschriften, to be complete, could only be achieved through the cooperative effort of an international group of experts. The present bibliography is based on notes gathered by the compiler over a period of years from material available at the University of Michigan Law Library. It is therefore, inevitably, incom plete and occasionally inaccurate and must be considered as a tentative list, subject to implementation and correction at other legal centers. It was felt, however, that its publication might be of some use, since not enough bibliographical information about this important and steadily growing type of legal literature exists.

Available in PDF, EPUB and Kindle. Book excerpt: One of the great and lasting influences on the course of Western culture, Roman law occupies a unique place in the history of the civilized world. Originally the law of a small rural community, then of a powerful city-state, it became the law of an empire which embraced almost all of the known civilized world. The influence of Roman law extends into modern times and is reflected in the great codifications of private law that have come into existence in Europe, America, and Asia. Even now, Roman law in modified form is the law of the land in Scotland, and the civil code of Louisiana is directly based on Roman law. Forming an important part in the historical and intellectual background of understanding and a basis for further development of the principles of international jurisprudence. In this book an international authority on Roman legal history sets forth in clear, understandable English the institutions of Roman law and traces their development through the Byzantine Empire into medieval and modern Europe. It is an indispensable study for every American lawyer and for anyone interesting in legal and political history.

The objectives of the work, not the juristic character of available Latin writings, therefore, determined the inclusion or exclusion of any single word or phrase. This dict. is not intended to be a complete Latin-English dict. for all words which occur in the writings of the Roman jurists or in the various codifications of Roman law. The reader must consult a general Latin-English lexicon for ordinary words that have no specific meaning in law or juristic language. Reprinted 1980.

Available in PDF, EPUB and Kindle. Book excerpt: Slaves were property of their dominus, objects rather than persons, without rights: These are some components of our basic knowledge about Roman slavery. But Roman slavery was more diverse than we might assume from the standard wording about servile legal status. Numerous inscriptions as well as literary and legal sources reveal clear differences in the social structure of Roman slavery. There were numerous groups and professions who shared the status of being unfree while inhabiting very different worlds. The papers in this volume pose the question of whether and how legal texts reflected such social differences within the Roman servile community. Did the legal system reinscribe social differences, and if so, in what shape? Were exceptions created only in individual cases, or did the legal system generate privileges for particular groups of slaves? Did it reinforce and even promote social differentiation? All papers probe neuralgic points that are apt to challenge the homogeneous image of Roman slave law. They show that this law was a good deal more colourful than historical research has so far assumed. The authors' primary concern is to make this legal diversity accessible to historical scholarship.

Available in PDF, EPUB and Kindle. Book excerpt: Freed from the familial and social obligations incumbent on the living, the Roman testator could craft his will to be a literal "last judgment" on family, friends, and society. The Romans were fascinated by the contents of wills, believing the will to be a mirror of the testator's true character and opinions. The wills offer us a unique view of the individual Roman testator's world. Just as classicists, ancient historians, and legal historians will find a mine of information here, the general reader will be fascinated by the book's lively recounting of last testaments. Who were the testators and what were their motives? Why do family, kin, servants, friends, and community all figure in the will, and how are they treated? What sort of afterlife did the Romans anticipate? By examining wills, the book sets several issues in a new light, offering new interpretations of, or new insights into, subjects as diverse as captatio (inheritance-seeking), the structure of the Roman family, the manumission of slaves, public philanthropy, the afterlife and the relation of subject to emperor. Champlin's principal argument is that a strongly felt "duty of testacy" informed and guided most Romans, a duty to reward or punish all who were important to them, a duty which led them to write their wills early in life and to revise them frequently.

Book excerpt: Recent research has called into question the orthodox view that the last two centuries of the Roman Republic witnessed a decline of the free rural population. Yet the implications of the alternative reconstructions of Italy's demographic history that have been proposed have never been explored systematically. This volume offers a series of in-depth discussions not only of the republican manpower and census figures but also of the abundant archaeological data. It also explores the growth of cities, especially Rome, and the changing distribution of the population over the Italian landscape. On the rural side it addresses the interplay between demographic, economic, and legal developments and the background to the Gracchan land reforms. Finally it examines the political implications of demographic growth and large-scale migration to the provinces. The volume as a whole demonstrates that demography is the key to many aspects of Italy's economic, social, military, and political history.
