Ocorre que, diante da iminente necessidade de expansão do serviço público na direção da universalização, a falta da capacidade de investimento por parte do Poder Público vem limitando o alcance do serviço. Nesse contexto, foi publicada a Lei no 14.026/2020, que atualiza o marco regulatório do setor e incentiva a realização de investimentos privados, o que deve alterar a matriz preponderante de investimentos do setor, de pública para o capital privado. O presente ensaio tem como objetivo apresentar alguns dos desafios do setor do saneamento básico, especialmente no tocante aos aspectos econômicos, federativos e regulatórios do setor.
