Book excerpt: Where do party systems come from? The first part of this dissertation argues that party system formation depends on the rule of law, which is defined as the extent to which the state uniformly implements and enforces its laws and policies. When the rule of law is weak, voters form attachments primarily over politicians, and voters cast their ballots for whichever party their preferred politician chooses to establish or join. Consequently, politicians ultimately shape party system formation, since their decisions about party affiliation determine whether a political party succeeds or fails. By contrast, when the rule of law is strong, voters form attachments directly over political parties; voters therefore determine which parties constitute the party system. The second part of the dissertation applies the argument about party system formation under weak rule of law to the case of regional political parties in India. This project explains the success of regional parties in a weak rule of law democracy such as India by focusing on why so many politicians choose to establish and join regional parties. The two factors that explain the extraordinary success of Indian regional parties are 1) the geographic concentration of caste groups (and to a lesser extent, other types of politically salient groups) and 2) frequent coalition government at the national level. The geographic concentration of caste groups raises the costs associated with establishing a national party by forcing politicians from various caste groups to coordinate with one another. Meanwhile, frequent coalition government increases the benefits associated with membership in a regional party by allowing regional parties to participate in national-level government. Empirically, this dissertation is based on 17 months of field research and over 550 interviews with state- and local-level politicians across three Indian states: Rajasthan, Tamil Nadu, and West Bengal.

The traditional answer of jurists has been that laws have an autonomous causal efficacy: law rules when actions follow anterior norms; the relation between laws and actions is one of obedience, obligation, or compliance. Contrary to this conception, the authors defend a positive interpretation where the rule of law results from the strategic choices of relevant actors. Rule of law is just one possible outcome in which political actors process their conflicts using whatever resources they can muster: only when these actors seek to resolve their conflicts by recourse to la, does law rule. What distinguishes 'rule-of-law' as an institutional equilibrium from 'rule-by-law' is the distribution of power. The former emerges when no one group is strong enough to dominate the others and when the many use institutions to promote their interest.

His book, Political Parties, first translated into English in 1954, has been very influential in both the party politics literature (which continues to make use of his typology of party organization) and in the electoral systems literature. His chief contributions there deal with what have come to be called in his honor Duverger’s Law and Duverger’s Hypothesis. The first argues that countries with plurality-based electoral methods will tend to become two-party systems; the second argues that countries using proportional representation (PR) methods will tend to become multi-party systems. Duverger also identifies specific mechanisms that will produce these effects, conventionally referred to as “mechanical effects”, and “psychological effects”. However, while Duverger’s Hypothesis concerning the link between PR and multipartism is now widely accepted; the empirical evidence that plurality voting results in two-party systems is remarkably weak—with the U.S. the most notable exception. The chapters in this volume consider national-level evidence for the operation of Duverger’s law in the world’s largest, longest-lived and most successful democracies of Britain, Canada, India and the United States. One set of papers involves looking at the overall evidence for Duverger’s Law in these countries; the other set deals with evidence for the mechanical and incentive effects predicted by Duverger. The result is an incisive analysis of electoral and party dynamics.
