This book sets out the form and method for publishing a notice of rule making proceedings and a notice of text in the North Carolina Register and for filing a rule in the North Carolina Administrative Code. It also gives practical advice and a description of current rule-making processes and provides a historical perspective on the evolution of rule making. Scholars, critics, reformers, and those who directly participate in rule making can use this reference as a basis for their own theories on improving government action. Book excerpt: "Chapter 160D of the North Carolina General Statutes is the first major recodification and modernization of city and county development regulations since 1905. The endeavor was initiated by the Zoning and Land Use Section of the N.C. Bar Association in 2013 and emanated from the section's rewrite of the city and county board of adjustments statute earlier that year. This bill summary and its many footnotes are intended to help citizens and local governments understand and navigate these changes."--Page vii.

Book excerpt: North Carolina Legal Research is devoted to explaining the process of legal research for people searching for the law in North Carolina. The book uniquely incorporates North Carolina sources of law and related strategies into a logical legal research process. After initial discussions of legal research and analysis, and the research process, the book's chapters generally follow a basic research process including North Carolina administrative law, case law, statutory law and secondary sources. Additionally, methods of finding North Carolina legislative history, court rules, and rules of ethics are included in the text. While the book is substantially focused on the process of legal research incorporating North Carolina legal information sources, discussion of federal legal information sources is included when federal information would be relevant for research in North Carolina. North Carolina Legal Research is designed for teaching legal research to students in law school, either in the first year or in an upper level research course; however, practitioners, paralegals, librarians, college students, and even laypeople might find it helpful. The book includes descriptions of a wide range of legal information sources including free government websites and lower cost websites, as well as premium online services and books. The second edition is updated to focus on researching on the new generations of legal research databases such as Lexis Advance, WestlawNext, and Bloomberg Law. This book is part of the Legal Research Series, edited by Suzanne E. Rowe, Director of Legal Research and Writing, University of Oregon School of Law.

Available in PDF, EPUB and Kindle. Book excerpt: Challenging traditional accounts of the development of American private law, Peter Karsten offers an important new perspective on the making of the rules of common law and equity in nineteenth-century courts. The central story of that era, he finds, was a struggle between a jurisprudence of the head, which adhered strongly to English precedent, and a jurisprudence of the heart, a humane concern for the rights of parties rendered weak by inequitable rules and a willingness to create exceptions or altogether new rules on their behalf. Karsten first documents the tendency of jurists, particularly those in the Northeast, to resist arguments to alter rules of property, contract, and tort law. He then contrasts this tendency with a number of judicial innovations--among them the sanctioning of 'deep pocket' jury awards and the creation of the attractive-nuisance rule--designed to protect society's weaker members. In tracing the emergence of a pro-plaintiff, humanitarian jurisprudence of the heart, Karsten necessarily addresses the shortcomings of the reigning, economic-oriented paradigm regarding judicial rulemaking in nineteenth-century America. Book excerpt: Beginning in the late eighteenth century, British rule transformed the relationship between law, society, and the state in South Asia. But qazis and muftis, alongside ordinary people without formal training in law, fought back as the colonial system in India sidelined Islamic legal experts. They petitioned the East India Company for employment, lobbied imperial legislators for recognition, and built robust institutions to serve their communities. By bringing legal debates into the public sphere, they resisted the colonial state's authority over personal law and rejected legal codification by embracing flexibility and possibility. With postcards, letters, and telegrams, they made everyday Islamic law vibrant and resilient and challenged the hegemony of the Anglo-Indian legal system. Following these developments from the beginning of the Raj through independence, Elizabeth Lhost rejects narratives of stagnation and decline to show how an unexpected coterie of scholars, practitioners, and ordinary individuals negotiated the contests and challenges of colonial legal change. The rich archive of unpublished fatwa files, qazi notebooks, and legal documents they left behind chronicles their efforts to make Islamic law relevant for everyday life, even beyond colonial courtrooms and the confines of family law. Lhost shows how ordinary Muslims shaped colonial legal life and how their diversity and difference have contributed to contemporary debates about religion, law, pluralism, and democracy in South Asia and beyond.

Book excerpt: Many students learn about criminal justice from introductory texts that are crowded with descriptions of criminal justice systems across the country in an attempt to reach a national market. Examples of police departments, court structures, and corrections agencies are drawn from major urban areas that bear little resemblance to the majority of jurisdictions within North Carolina. These texts contain current events of major media interest but not those most relevant to North Carolina. North Carolina's Criminal Justice System provides a survey view of criminal justice in the state, including crime patterns and trends, the state constitution, state and local lawmaking, prosecution and defense, police agencies, court structure and criminal procedure, corrections, juvenile justice, and victim services. The book also covers the presence of federal law enforcement in North Carolina. The book explains how each aspect of North Carolina's system developed as it did, and how North Carolina's institutions and practices compare with the rest of the nation. It also charts African-American first, from the first black correctional administrator to the first black justice on the state supreme court.

Available in PDF, EPUB and Kindle. Book excerpt: As its name suggests, a quasi-judicial decision is like a court decision in several important ways. It requires the deciding board to use its judgment in applying general law to a particular land use situation while ensuring the constitutional due process rights of the parties. This handbook is designed as a guide for boards making development regulation decisions through the quasi-judicial process. The discussion covers the process prior to, during, and after the evidentiary hearing as well as the decision itself. Other topics include the board of adjustment, variances, special use permits, certificates of appropriateness, appeals of zoning determinations, and judicial review. A package of 5 books is available for a discounted price for those looking to purchase copies for their entire board.
