Book excerpt: Governing by Numbers is a jargon-free account of how delegated legislation - laws that do not pass through the full legislative scrutiny to which Acts of Parliament are subjected - is made. It is based on new research involving an analysis of nearly 30,000 pieces of delegated legislation; detailed investigation of 46 recent regulations based on in-depth interviews with those involved in developing, writing and scrutinising them and a major survey of nearly 400 interest groups. Delegated legislation is examined as a form of "everyday policy-making". It deals with important issues, from the level of welfare benefits to weapons exports, animal health and the prevention of air pollution, yet has been largely ignored in studies of the British political and administrative system. This book analyses the distinctive character of everyday policy making and the implications of how it works for our understanding of British democracy.

Book excerpt: This is a reprint of Anthony Ogus' classic study of regulation, first published in the 1990s. It examines how, since the last decades of the twentieth century there have been fundamental changes in the relationship between the state and industry. With the aid of economic theory Anthony Ogus critically examines the ways in which public law has been adapted to the task of regulating industrial activity and provides a systematic overview of the theory and forms of social and economic regulation. In particular, he explores the reasons why governments regulate, for which, broadly speaking, two theoretical frameworks exist. First 'public interest' theories determine that regulation should aim to improve social and economic welfare. Second, 'economic' theories suggest that regulation should aim to satisfy the demands of private interests. The book also looks at the evolution of the forms of regulation in Britain, extending to the policies of privatization and deregulation which were so characteristic of the period. The author skilfully evaluates the advantages and disadvantages of the different forms of regulation, particularly in the light of the two theoretical frameworks, but also by involving an analysis of how firms respond to the various kinds of incentives and controls offered by government. A significant feature of the book is its analysis of the choices made by governments between the different forms of regulation and the influence exerted by interest groups (including bureaucrats) and EC law.

Available in PDF, EPUB and Kindle. Book excerpt: Never before have people been so aware of the importance of sound environmental law, as every week stories of controversial planning developments and prosecutions for the release of toxic substances feature in the news. Environmental Law and Citizen Action sets out and explains the ways that ordinary citizens can use the law to ensure the environment is protected. There are a number of existing UK laws which require local authorities to control pollution and protect the environments and many more which can be used to tackle environmental offenders, yet often local government officers themselves are unaware of the full scope of their powers. Writing in a clear, accessible style, Alan Murdie explains how to get access to the relevant information, participate in public enquiries, use the courts to challenge public and government bodies and prosecute polluters. This book maps a path through the intricate legal maze to show what rights every citizen has, and how those rights can be enforced. Alan Murdie is a barrister with long-standing interest and involvement in local government issues, and a lecturer at Thames Valley University. He is co-author of To Pay or Not To Pay, a best-selling analysis of the poll tax debate, and has contributed to a wide range of legal and government periodicals. Originally published in 1993

Available in PDF, EPUB and Kindle. Book excerpt: Road traffic offences are those which are connected with the ownership, driving or control of mechanically-propelled vehicles in public places, including drunken, dangerous and careless driving. Over 90% of prosecutions in the District Courts are road related. 1961-2017 Road Traffic Legislation sets out annotated road traffic legislation from 1961 to 2017 and covers all relevant case law and Statutory Instruments, which makes it an ideal book for solicitors, barristers and GardaĆ. This new edition includes reference to litigation on intoxicants, dangerous driving, careless driving and drug driving along with many other areas of Road Traffic Law. This title covers both practice and procedure and each section is annotated fully and cross referenced. The layout is user-friendly and where relevant makes reference to earlier volumes. This is crucial as road traffic law is a vital part of many smaller solicitors' firms' daily work and this title provides them with annotated legislation in an area rife with difficulty as the legislation is piecemeal and often contradictory. Many Statutory Instruments and Acts are created in this area: some enacted in full, others not. This book updates the practitioner on this thorny area of law and points them to relevant case law where necessary.
