Book excerpt: Dopo una sintetica ricostruzione dell’originario statuto di immunità della P.A., dei motivi che hanno portato al tramonto del dogma dell’irrisarcibilità dell’interesse legittimo, delle argomentazioni, con cui nel 1999 la Cassazione ha per la prima volta affermato la responsabilità aquiliana dell’Amministrazione in subiecta materia, e dei problemi frutto della svolta e tutt’ora irrisolti, sono affrontate criticamente due modalità di tutela risarcitoria dell’interesse legittimo, che hanno ad oggetto rispettivamente la chance e l’affidamento. Se ne propone l’individuazione come meccanismi di risarcimento ad un interesse legittimo non più collegato solo al conseguimento di un bene della vita, ma comprendente anche le possibilità connesse ad un nuovo esercizio del potere secondo le più recenti suggestioni giurisprudenziali. Si esaminano poi le questioni collegate all’uso del binomio “regole di validità/regole di responsabilità” ed al superamento del principio di non interferenza tra le due tipologie di disposizioni in tema di trattamento risarcitorio dell’interesse legittimo. Infine, nelle conclusioni si afferma la necessità di mantenere fermo il criterio del collegamento con il potere nella definizione dell’interesse legittimo, al fine di evitare un improprio accostamento di questa situazione giuridica al diritto soggettivo. Tale evoluzione potrebbe infatti diminuire gli spazi tutela effettiva apprestati dall’ordinamento.
