Book excerpt: At the UN General Assembly in 1997, an overwhelming majority of States voted for the adoption of the United Nations Convention on the Law of the Non-Navigational Uses of International Watercourses – a global overarching framework governing the rights and duties of States sharing freshwater systems. Globally, there are 263 internationally shared watersheds, which drain the territories of 145 countries and represent more than forty percent of the Earth's land surface. Hence, inter-State cooperation towards the sustainable management of transboundary water supplies, in accordance with applicable international legal instruments, is a topic of crucial importance, especially in the context of the current global water crisis. This volume provides an assessment of the role and relevance of the UN Watercourses Convention and describes and evaluates its entry into force as a key component of transboundary water governance. To date, the Convention still requires further contracting States before it can enter into force. The authors describe the drafting and negotiation of the Convention and its relationship to other multilateral environmental agreements. A series of case studies assess the role of the Convention at various levels: regional (European Union, East Africa, West Africa, Central Asia, Central America and South America), river basin (e.g. the Mekong and Congo) and national (e.g. Ethiopia and Mexico). The book concludes by proposing how future implementation might further strengthen international cooperation in the management of water resources, to promote biodiversity conservation as well as sustainable and equitable use.

According to recent estimates, the value of China’s trade with African nations grew from a mere USD 10 million in the 1980s to USD 55 billion in 2006, and to more than USD 100 billion by the end of 2009, at which time nearly 1,600 Chinese companies were doing business in Africa with a direct stock investment of about USD 7.8 billion. The accelerating impetus of China-Africa trade has overtaken some crucially important features of an effective trade regime, most notably a fully trustworthy dispute resolution system. It is the current and potential future efficacy of such a system that is taken up in this book with great understanding and skill. The author evaluates existing mechanisms of dispute resolution in all aspects of China-Africa economic relations in light of the parties’ economic and cultural profiles and their evolving legal traditions, and goes on to propose a comprehensive institutional model of dispute resolution that takes full account of the economic needs and legal cultures of both China and the various African countries. Freshwater resources contained in aquifer systems globally are two orders of magnitude greater than those found in all rivers, lakes, and other surface freshwaters combined. Moreover, approximately one half of the world’s population today is dependent on groundwater for its basic needs. While these truisms are widely acknowledged, an additional reality is now recognized – many of these subsurface freshwater reservoirs are actually transboundary formations shared amongst two or more nations. In fact, around 600 transboundary aquifers have been identified worldwide. They underlie the territory of nearly every non-island nation and are found in both humid and arid environments. Surprisingly, though, only a handful of transboundary aquifers worldwide are subject to any type of formal or informal international agreement. Transboundary groundwater resources are now receiving growing attention among the international community. Questions are being raised about how they should be managed, allocated and protected, what rights aquifer riparians can enjoy, and what responsibilities these aquifer states might owe to neighbouring aquifer riparians. This book considers all these various aspects of the management and regulation of transboundary groundwater resources. It also presents case studies and explores recent efforts to engage the international community on best practices and global standards for governing transboundary aquifers. As communities and nations continue to expand their reliance on these critical sources of freshwater, they will have to address such issues and develop governance regimes for these shared subsurface resources.
