In recent years, several requests have been made by citizens and associations to political decision-makers regarding the need for a significant improvement in waste management methods. Particularly considering the significant increase in awareness of social and environmental impacts and the economic consequences of non-virtuous waste management. There is growing attention on legislation and regulation's role in the waste sector. Regulation can help companies and citizens achieve a faster, more effective, and more efficient transition from a linear economy, based on the take-make-dispose paradigm, to a circular economy, in which the potential of waste as resources and secondary raw materials is exploited. This book is set in the wake of economic literature that tackles the transition from the linear to the circular economy. It focuses on the downstream stages of the waste management process (i.e. the waste treatment phase). In this regard, it is proposed a journey through the history of European waste legislation to study the waste sector's transition dynamics from a selfish and no longer sustainable economic model based on rampant consumerism to a far-sighted sustainable model addressing the well-being of future generations. Studying the changes in European waste regulations leads us to ask ourselves the following questions: how has waste collection changed in recent years? What are the new regulatory challenges that must be addressed to achieve the objectives of a circular economy? How successful has the EU legislation been in fostering the transition from a linear to a circular economy? Finally, has the European environmental legislation sprung a convergence process among European countries towards the circular economy, or has the definition of targets fuelled the already marked differences between EU countries?

The question of which treatment technique to adopt is essentially a downstream problem. In our view the issue needed to be tackled further upstream. Waste management is not only a technical problem, it is also an area which involves various actors throughout society. In this book, as in the previous volume (Buclet, Godard, 2000), the organisation of waste management is seen in terms of regimes. A regime is an entire form ofinstitutional, technical, economic and social organisation relating to a specific field, no matter how complex that field is. Regime formation is generally a long-drawn-out process, rooted in the multiple interactions of the actors involved. Legislation plays a crucial role but would not, of itself, lead to the formation of a regime. There is always the old question of causality and which element occurs first: the behaviour of actors who constitute the reality, or the legislation that models their behaviour? Besides legislation, other formal or informal conventions influence the behaviour of actors approaching a common path, making co ordination easier between them. In this book we have insisted on conventional principles. They are the real guides for actors within each national regime.

Book excerpt: The adoption of new EU waste legislation in May 2018 lays down ambitious new rules which will require major structural changes for waste management, including organisation, delivery and investments. Targets on municipal waste recycling are now set at 55% for 2025, 60% for 2030 and 65% for 2035, while overall packaging waste targets have been set at 65% for 2025 and 70% for 2030. For many Member States, in order to meet these challenging targets there will need to be a change in focus, and some considerable investment, focussed towards the top of the waste hierarchy. In order to inform the Commission in the context of setting the budget for the 2021-2027 Multiannual Financial Framework (MFF), this report brings together research and analysis to quantify total investment needs required to achieve the reuse and recycling targets under the new legislation, together with detailed research into certain focus waste streams (plastics, textiles and furniture). This document seeks to quantify the total scale of funding needed. Some of this has potential to be supported by EU funds, though it should be clarified at the outset that the quantification of investment needs is neutral as regards to the EU, national and private sources of funding in individual Member States. The work within the report is split across four separate tasks: - Task 1 (reported within Section 2) provides an assessment of the investment opportunities and spending achieved under the current 2014-2020 EU budget. - Task 2 (reported within Section 3) assesses the EU waste management investments needed to meet targets within the forthcoming MFF period 2021-2027. In addition, a calculation is also provided for the investment needs through to 2035 to meet the long term circular economy package targets. - Task 3 (reported within Section 4) provides further focussed assessments of investment needs for additional reuse and recycling of three specific waste streams, beyond the investment needs calculated within Task 2 (plastics, textiles and furniture). - Task 4 (reported within Section 5) seeks to understand how charges for municipal waste management are formed in individual Member States, and the extent to which these cover the costs of waste management.
