Book excerpt: On April 11, 2003, the House and Senate reached agreement on a budget resolution for FY2004 (H.Con.Res. 95) which recommends that revenues be reduced by $1.225 trillion over the 11-year period covering FY2003-2013. In addition, the budget resolution recommends increases in outlays stemming from related tax policy changes (i.e., refundable tax credits). These recommendations in the aggregate roughly parallel those proposed by President George W. Bush in the FY2004 budget he submitted to Congress on February 3. The FY2004 budget resolution recommends that a large portion of the revenue reductions (and associated outlay increases), pertaining to an economic growth package, be achieved through the budget reconciliation process. The remaining revenue reductions, amounting to about $691 billion (plus associated outlay increases), may be considered under regular legislative procedures. The reconciliation process, authorized under Section 310 of the 1974 Congressional Budget Act, is an optional procedure that operates as an adjunct to the budget resolution process. The chief purpose of the reconciliation process is to enhance Congress's ability to change current law in order to bring revenue and mandatory spending levels into conformity with the policies of the budget resolution. While a budget resolution may rest on assumptions regarding changes in revenue and mandatory spending levels, reconciliation may make it more likely that such changes will occur by compelling committees to develop the necessary legislation and providing for its expedited consideration. The reconciliation directives, set forth in Section 201 of the budget resolution, require the House Ways and Means Committee and the Senate Finance Committee to report reconciliation legislation to their respective chambers by May 8, 2003. Although the level of tax policy changes is the same for each committee (not more than $550 billion over the 11-year period covering FY2003-2013), the two committees have a different mix of directives to reduce revenues and increase outlays related to tax policy changes. The Ways and Means Committee is directed to reduce revenues by not more than $535 billion and to increase outlays by not more than $15 billion; the corresponding amounts for the Finance Committee are not more than $522.524 billion in revenue reductions and not more than $27.476 billion in outlay increases. In an innovative procedure intended in part to avoid conflicts with the Senate's so-called Byrd rule (Section 313 of the 1974 Congressional Budget Act), the budget resolution also contains a point of order, set forth in Section 202, that prohibits the initial consideration in the Senate of reconciliation legislation proposing revenue reductions and associated outlay increases greater than $350 billion. The prohibition does not apply, however, to the consideration in the Senate of the conference report. This report will be updated as developments warrant.

Book excerpt: The Congressional Budget Act (CBA) of 1974 (Titles I-IX of P.L. 93-344, 88 Stat. 297-332), as amended, establishes the concurrent resolution on the budget as the centerpiece of the congressional budget process. The annual budget resolution is an agreement between the House and Senate on a budget plan for the upcoming fiscal year and at least the following four fiscal years. As a concurrent resolution, it is not presented to the President for his signature and thus does not become law. The budget resolution, however, provides the framework for subsequent legislative action on budgetary legislation during each congressional session. Congress has adopted 35 budget resolutions during the 30 years that the congressional budget process has been in effect. At least one budget resolution has been adopted every year except 1998 (for FY1999), 2002 (for FY2003), and 2004 (for FY2005). A second budget resolution was adopted in each of the first seven years and a third budget resolution was adopted for FY1977. Since 1982, Congress has adopted only one budget resolution for each fiscal year. Congress initially was required to cover only the upcoming fiscal year in the budget resolution, but over the years Congress has expanded this time frame. Currently, the budget resolution must include at least five fiscal years. The budget resolution may include reconciliation directives, instructing one or more committees to recommend legislative changes to meet the spending and revenue levels included in the budget resolution. In the past 30 years, Congress included reconciliation directives in 18 budget resolutions. Pursuant to these directives, 16 reconciliation measures have been enacted. Twice (in 1982 and 1997), Congress adopted two reconciliation measures in one year. Four reconciliation measures have been vetoed, in 1975, 1995, 1999, and 2000. Over the past 30 years, the House has considered and adopted fewer amendments to the budget resolution than the Senate. The House has considered, on average, over six amendments per budget resolution, adopting, on average, one of these. For more than a decade, the House has considered the budget resolutions under special rules that allow only amendments in the nature of a substitute to be offered. In all but one year, the House has rejected all such amendments. In contrast, the Senate has considered, on average, about 37 amendments per budget resolution, adopting, on average, over 19 of these. Congress originally was required to complete action on the budget resolution by May 15 of each year; this deadline was changed to April 15 beginning with the FY1987 budget resolution. The budget resolution deadline has been met only six times over the past 30 years, most recently in 2003 with the FY2004 budget resolution. Budget resolutions have been adopted, on average, about 38 days after the deadline. This report will be updated as warranted.

The chief purpose of the reconciliation process is to enhance Congress's ability to change current law in order to bring revenue, spending, and debt-limit levels into conformity with the policies of the annual budget resolution. Reconciliation is a two-stage process. First, reconciliation directives are included in the budget resolution, instructing the appropriate committees to develop legislation achieving the desired budgetary outcomes. If the budget resolution instructs more than one committee in a chamber, then the instructed committees submit their legislative recommendations to their respective Budget Committees by the deadline prescribed in the budget resolution; the Budget Committees incorporate them into an omnibus budget reconciliation bill without making any substantive revisions. In cases where only one committee has been instructed, the process allows that committee to report its reconciliation legislation directly to its parent chamber, thus bypassing the Budget Committee. The second step involves consideration of the resultant reconciliation legislation by the House and Senate under expedited procedures. Among other things, debate in the Senate on any reconciliation measure is limited to 20 hours (and 10 hours on a conference report) and amendments must be germane and not include extraneous matter. The House Rules Committee typically recommends a special rule for the consideration of a reconciliation measure in the House that places restrictions on debate time and the offering of amendments. As an optional procedure, reconciliation has not been used in every year that the congressional budget process has been in effect. Beginning with the first use of reconciliation by both the House and Senate in 1980, however, reconciliation has been used in most years. In three years, 1998 (for FY1999), 2002 (for FY2003), and 2004 (for FY2005), the House and Senate did not agree on a budget resolution. Congress has sent the President 19 reconciliation acts over the years; 16 were signed into law and three were vetoed (and the vetoes not overridden). Following an introduction that provides an overview of the reconciliation process and discusses its historical development, the book explains the process in sections dealing with the underlying authorities, reconciliation directives in budget resolutions, initial consideration of reconciliation measures in the House and Senate, resolving House-Senate differences on reconciliation measures, and presidential approval or disapproval of such measures. It entails dozens of subprocesses, countless rules and procedures, the efforts of tens of thousands of staff persons in the executive and legislative branches, and the active participation of the President, congressional leaders, Members of Congress, and members of the executive branch. This analysis shows the various elements of the federal budget process including the President's budget submission, framework, timetable, the budget resolution, reconciliation, the "Byrd Rule," appropriations, authorizations, and budget execution. Congress is distinguished from nearly every other legislature in the world by the control it exercises over fashioning the government's budgetary policies. This power, referred to as "the power of the purse," ensures Congress' primary role in setting revenue and borrowing policies for the federal government and in determining how these resources are spent. The congressional power of the purse derives from several key provisions in the Constitution. Article I, Section 8, Clause 1 (Power to tax and spend) declares in part that Congress shall have the power to raise (that is, "to lay and collect") revenues of various types, including taxes and duties, among other things. Article I, Section 8, Clause 2 (Borrowing power) declares that the power to borrow funds "on the credit of the United States" belongs to Congress. In addition to its powers regarding revenues and borrowing, Congress exerts control over the expenditure of funds. Article I, Section 9, Clause 7 declares in part that funds can be withdrawn from the Treasury only pursuant to laws that make appropriations. Under the Constitution, revenue measures must originate in the House of Representatives. Beyond this requirement, however, the Constitution does not prescribe how the House and Senate should organize themselves, or the procedures they should use, to conduct budgeting. Over the years, however, both chambers have developed an extensive set of rules (some set forth in statute) and precedents that lay out complicated, multiple processes for making budgetary decisions. The House and Senate have also created an intricate committee system to support these processes. As American society has grown and become ever more complex, and as the role of the federal government in the national economy has steadily expanded, Congress also has increasingly shared power over budgetary matters with the president and the executive branch. It has refashioned the president’s role in budgeting by requiring him to submit to Congress each year a budget for the entire federal government and giving him responsibilities for monitoring agencies’ implementation of spending and revenue laws.
