Los Estados han enfrentado jurídicamente esta pandemia, dictando estados de excepción o emergencia de diversos tipos, con medidas extraordinarias que incluyen el encerramiento domiciliario, el distanciamiento social y la cuarentena de las personas. Estas medias restrictivas han afectado, entre otros, el ejercicio de derechos de reunión pública y las manifestaciones y la celebración de elecciones. Además, se ha visto afectado el funcionamiento normal de los controles de los poderes legislativo y judicial. Las medidas adoptadas además han puesto en evidencia, la necesidad de garantizar el igual acceso a la salud pública y de darle un trato diferenciado a determinados grupos vulnerables. En conclusión: todas las medidas extraordinarias para enfrentar la pandemia deben estar dentro de la Constitución y el Derecho internacional.

Labor insertion is one of the most effective forms of integration because it allows migrants and refugees to enjoy more dignified living conditions, to contribute to the development of host communities, and to build relationships with the local population. But ensuring the right to work is a challenge for countries in the global South that have weak or developing economies and problems with job creation, which can force many people—not just migrants—to engage in precarious work and put themselves at risk of labor exploitation. Under these circumstances, advocating for migrants’ and refugees’ right to work is more urgent than ever. The recognition of decent work as a human right means that states may not pursue economic growth at the expense of the exploitation of migrants and refugees, but instead must seek to ensure opportunities and prosperity for all. In this regard, it is critical to foster discussions, such as the ones featured in this book, that facilitate the sharing of experiences and lessons learned on the labor conditions of migrants and refugees. The authors of the nine chapters in Migration and Decent Work are activists, academics, and members of civil society who have worked on the issue of migration from different angles and who address the challenge of migrants’ labor inclusion from an interdisciplinary and rights-based perspective. Their contributions offer an overview of migrants’ and refugees’ right to work in a range of countries in the global South based on an analysis of local contexts, public policies, and the everyday realities faced by these workers. Book excerpt: The document summarizes the report that, based on a review of more than 250 studies, demonstrates the importance and urgency of climate action to protect the forests of the indigenous and tribal territories of Latin America as well as the indigenous and tribal peoples who protect them. These territories contain about a third of the continent's forests. That's 14% of the carbon stored in tropical forests around the world; These territories are also home to an enormous diversity of wild fauna and flora and play a key role in stabilizing the local and regional climate. Based on an analysis of the approaches that have proven effective in recent decades, a set of investments and policies is proposed for adoption by climate funders and government decision-makers in collaboration with indigenous and tribal peoples. These measures are grouped into five main categories: i) strengthening of collective territorial rights; ii) compensate indigenous and tribal communities for the environmental services they provide; iii) facilitate community forest management; iv) revitalize traditional cultures and knowledge; and v) strengthen territorial governance and indigenous and tribal organizations. Preliminary analysis suggests that these investments could significantly reduce expected carbon emissions at a low cost, in addition to offering many other environmental and social benefits.
