Book excerpt: A common view among members of the ruling group in Belfast and London is that, after the reforms of the 1970s, the public services and the main social and economic institutions in Nothern Ireland are as fair as they can be in a divided society; and that any remaining inequality between Protestants and Catholics is a reflection of historic discrimination which has now been put right. In this benchmark study, David Smith and Gerald Chambers assemble a wide range of statistical material that emphatically contradicts this view of Northern Ireland's fair and equitable society. Examing the extent of inequality between Protestants and Catholics in all areas of daily life, the authors show how far inequalities can be explained by factors other than discrimination. They also show how people perceive inequality and discrimination and how important they think these issues are. This penetrating study will be of interest to teachers and students of politics, sociology, law, social policy, as well as journalists and political commentators.

Available in PDF, EPUB and Kindle. Book excerpt: This interdisciplinary book explores the Northern Ireland conflict through a human rights framework. The book examines the conflict from the creation of the Northern Ireland state in 1921 to 2014. This timeframe allows an analysis of how human rights impacted upon the conflict in its broadest understanding (i.e. the pre-violent conflict, the violent conflict and the post-violent conflict phases). Furthermore, it allows for a better understanding of how the various stages of the conflict impacted upon how human rights are understood in Northern Ireland today. The study’s main findings are that: (i) human rights had a significant impact on the development of the conflict; (ii) human rights violations were both underlying causes and direct causes of the descent into violence; (iii) the conflict coloured the view of human rights held by the main political actors; and (iv) human rights continue to be partially understood through the prism of the conflict. More generally, this interdisciplinary work explores the relationship between law, politics and conflict. This book will be of much interest to students of human rights, conflict resolution, British politics, law and security studies.

Available in PDF, EPUB and Kindle. Book excerpt: Relative to its size Northern Ireland is possibly the most heavily researched area on earth; hundreds of books and thousands of articles have been published since the current troubles began in the mid 1960s. John Whyte had been studying Northern Ireland since the mid-1960s. In Interpreting Northern Ireland he provides a badly-needed guide to the mass of literature and comment. In Part I, he surveys the research on the nature and extent of the community divide, examining in turn the religious, economic, political, and psychological aspects of the issue. In Part II he discusses ideological interpretations of the Northern Ireland problem, from unionist and nationalist to Marxist. In the final section of the book he surveys the various solutions that have been proposed and looks critically at what the mass of research has achieved. He suggests that if it has not achieved more it may be because it has sometimes asked the wrong questions.

Available in PDF, EPUB and Kindle. Book excerpt: This edition, first published in 1989, looks at the problems of racism and equal opportunity in employment and government policies towards them in Britain. It brings together a group of specialist contributors and covers the major areas of debate, including the law, policies towards unemployment, job training and the labour market, the role of the public and private sectors, the role of trade unions, the gap between policies and pronouncements on equal opportunity and their implementation, and the related issue of sectarian discrimination in Northern Ireland. It looks at the future prospects for equal opportunities and provides conclusions for policy. In particular, it aims to address important topics such as the assumptions underlying policies and whether they realistically reflect reality, the actual effect of legislation, and the relationship between power disparities in society as a whole and racial inequality.

Available in PDF, EPUB and Kindle. Book excerpt: In this landmark study, a thorough audit of British compliance with international human rights standards is carried out. The book identifies 42 violations and 22 near-violationsor causes for concern. It provides an up-to-date description of law and practice withrespect to freedom of information; freedom of expression; freedom of assembly and publicprotest; freedom of association and trade unionism; state surveillance; the right to lifeand liberty; and the right to vote and stand in elections. This study measures political freedom in the United Kingdom specifically against aunique Human Rights Index, specially constructed from international human rightslaws and jurisprudence by the authors. The Index is an important new tool formonitoring human rights around the world. It is already being used to monitor newlegislation in the UK. The Three Pillars of Liberty is the first-ever analysis of both the political and legalsystems for securing political freedom in the UK as a whole. It is the most rigorous andsystematic review of those systems yet published—and finds them wanting. It strikes atthe heart of the historic traditions of government and the rule of law in this country. This book will be essential reading for all those interested in their rights and the rightsof others.

Available in PDF, EPUB and Kindle. Book excerpt: "Published in November 1984, the MacBride Principles were nine proposals aimed at eliminating religious discrimination in the employment practices of United States corporations with subsidiaries in Northern Ireland. The federal constitution of the United States allowed states and cities to pass their own corporate legislation incorporating the MacBride Principles and to use their pension fund investments to pressurise corporations into adopting the Principles. Using devolved legislation, the MacBride Campaign broke the stranglehold on the discussion of Irish issues maintained by the US, UK and Irish governments in the Congress. Instead, these issues were debated in state legislatures and city councils, and Irish America was given an opportunity to participate in a non-violent campaign to further social justice in Northern Ireland." "Using interviews with key personalities involved and hitherto unpublished and inaccessible archives of the Department of Foreign Affairs, Dublin, as well as papers obtained using the Freedom of Information Acts of the United States and the United Kingdom, Kevin McNamara maps out the evolution and eventual success of the MacBride Campaign." --Book Jacket.

Available in PDF, EPUB and Kindle. Book excerpt: This textbook offers comprehensive coverage of the Equality Act 2010 and deals also with the equality aspects of the Human Rights Act 1998 and European Convention on Human Rights. It encourages critical analysis of equality law to equip the reader with an understanding of the enduring challenges that frame equality law and contemporary responses to those challenges. New content includes a chapter on age discrimination and analysis of the Public Sector Equality Duty. Structured so as to be accessible to the student approaching discrimination law for the first time, the book is also sufficiently detailed and analytical to appeal to the well-informed reader, and to provide those engaged in research with a solid base for further independent study. For the undergraduate student studying discrimination law as a free-standing subject or as part of a wider course, the book provides a one-stop shop. This book is also a key core text for any postgraduate discrimination law course.
