Dichas transferencias en la titularidad de la gestión de la actividad del concesionario a un tercero o a la propia administración en los casos de reversión plantean importantes problemas a la continuidad de la ejecución de la obra y, sobre todo, a la continuidad de su explotación, que no se resuelven con la apelación en exclusiva a la subrogación del tercero en el lugar del concesionario o a la imputación única de este previstas sin matizaciones en la legislación de Contratos de las Administraciones Públicas, pues las cuestiones más conflictivas que normalmente surgen exceden del ámbito administrativo y entran de lleno en el laboral, lo que puede afectar a la responsabilidad de la administración, por ser esta la que ha de garantizar en última instancia que la explotación de la obra se realice de forma que el servicio inherente a la misma se preste de manera regular y continua. Bajo tal premisa, la distorsión o disfuncionalidad del ordenamiento jurídico entre normas laborales y normas administrativas está servida desde el momento en que estas modificaciones subjetivas del adjudicatario de la concesión de obra pública no van a suponer solo un cambio jurídico empresarial en la titularidad de la prestación de servicios de necesaria autorización o, en su caso, conocimiento por parte de la administración, sino que, proyectándose más allá, van a alcanzar al estatus del ente público comitente, que puede verse inmerso en cuantiosos problemas de responsabilidad en materia laboral.
