Foi nesse estágio de desenvolvimento da sociedade que surgiu a Lei nº 8.078/90 (Código de Defesa do Consumidor), introduzindo uma considerável mudança, ao passar o direito privado das obrigações a ser disciplinado por três grandes e diferentes regimes jurídicos, quais sejam, o civil, o comercial e o da tutela do consumidor. 1 Durante vários séculos, nas economias de fundo agrário, mesmo depois da primeira Revolução Industrial, foram as prestações de coisas que preponderaram nas relações da vida econômica. À medida, porém, que a revolução tecnológica, subsequente ao termo da última guerra, foi modificando a fisionomia das sociedades contemporâneas, cada vez mais se acentuou a importância das prestações de serviços que as grandes empresas oferecem, muitas vezes em massa, ao núcleo crescente dos utentes. No limiar do século XIX, assistiu-se à valorização do indivíduo com forma ideológica de combate ao absolutismo real. Coube aos filósofos iluministas buscar inspiração na filosofia estoica, enaltecendo no indivíduo a razão, ‘e da existência da razão em todos deduzia o dogma da igualdade’. Em nome desses novos princípios passou-se a destruir tudo aquilo que o antigo regime havia construído: a realeza, as classes sociais, as corporações de ofício.

Os vícios e os defeitos, conforme regulados pelo CDC, em que pese a possibilidade de aproximação no plano teórico sob o manto da teoria da qualidade, apresentam-se, na prática, como institutos completamente distintos. As principais diferenças entre os vícios e os defeitos referem-se ao bem jurídico tutelado, à existência de vínculo contratual e aos efeitos produzidos. No defeito, o bem jurídico tutelado é a segurança física e patrimonial do consumidor, enquanto nos vícios, protege-se a adequação do produto ou serviço à finalidade a que se destinam. Nos defeitos, não há necessidade de vínculo contratual entre o consumidor prejudicado e o fornecedor responsável. Já nos vícios, apesar da ampliação do sistema de solidariedade (art. 25, §§ 1o e 2o, do CDC) entre os fornecedores, há necessidade de uma cadeia contratual e a unir o consumidor e o fornecedor responsável.

Book excerpt: The book starts from the premise that the current aviation framework, in Brazil, cannot sustain a full liberalisation in the long run. While the competition rules in place offer a strong framework, which only requires small modifications, these rules are not "enough" to foster a "healthy" liberalisation. In fact, until recently, Brazilian airlines were operating in a homogenous market, where competition was artificial. This artificial competition, obtained through the imposition of a legal obligation to provide water and a snack and grant a 23kg bag allowance, has resulted in a highly concentrated domestic market with very few players. Compared to other same size markets, such as China or India, Brazil is far behind in terms of airlines operating at national level. Consequently, the opening of the domestic market must be closely regulated to avoid national carriers suffocating under external pressure. For this reason, state intervention during the liberalisation process is crucial. State intervention is also with regard to the protection of passengers. The other major problem is the protection framework for passengers which is much too uncertain and burdensome. In a sense, it is detrimental to the domestic market and passengers. Indeed, there is no harmonisation of passenger compensation leading to contradictory judgments and possible high moral damages which hinders legal certainty for airlines. Compared to the situation in the EU, in Brazil, airlines have a limited range of defences, which are often dismissed by courts. This book, therefore, critically analyses the policies and regulations in place by mainly comparing the Brazilian framework to the European one. This choice has been motivated by the fact that European liberalisation is considered the best so far, and as Brazil is starting this process much later, it could benefit from the European experience. This book will be of particular interest to scholars and practitioners interested in the Brazilian system.

It systematically demonstrates that work - or lack of it - is central to our health and wellbeing and is the underlying determinant of health inequalities. Work is the cornerstone of modern society and dominates adult life with around a third of our time spent working. It is a vital part of self-identity and for most of us it is the foundation of economic and social status. As such, the material and psychosocial conditions in which we work have immense consequences for our physical and mental wellbeing, as well as the distribution of health across the population. Recessions, job-loss, insecurity and unemployment also have important ramifications for the health and wellbeing of individuals, families and communities. Chronic illness is itself a significant cause of worklessness and low pay. Drawing on examples from different countries, this book shows that the relationship between work, worklessness and health varies by country. Countries with a more regulated work environment and a more interventionist and supportive welfare system have better health and smaller work-related health inequalities. The book provides examples of specific policies and interventions that mitigate the ill-health effects of work and worklessness. It concludes by asserting the importance of politics and policy choices in the aetiology of health and health inequalities.
