La trascendencia práctica de este precepto se ha visto favorecida por la interpretación expansiva que de él vienen haciendo nuestros tribunales, lo que ha llevado a su aplicación a supuestos muy variados, como son los daños por filtraciones de agua. Asimismo, la actualidad del problema al que trata de dar respuesta se ha puesto de manifiesto tras el paso de la borrasca Filomena, que ha provocado en muchas localidades la existencia de daños por la caída de la nieve acumulada en los edificios, cuestión a la que se presta una especial atención. Tras examinar los antecedentes históricos y la naturaleza de la responsabilidad del cabeza de familia, se afronta el estudio de las causas de exoneración, con especial atención a la fuerza mayor. Igualmente, se contempla en toda su extensión quién es el sujeto responsable, para lo que se analizan, entre otras cuestiones, qué quiere decir habitar como cabeza de familia, si realmente es preciso habitar la casa para que se pueda acudir a este régimen de responsabilidad o si se aplica además a las casas deshabitadas, y quienes son las personas de cuyos hechos debe responder. También se realiza un detenido examen del ámbito objetivo de este régimen de responsabilidad para determinar cuál puede ser el objeto productor del daño, qué características debe tener la casa de la que procede el objeto dañoso y el lugar en el que cae y produce el daño. Finalmente, se aborda el análisis detallado de la responsabilidad de las comunidades de propietarios cuando el objeto cae desde un edificio sometido al régimen de propiedad horizontal. Todo ello hace que esta obra resulte de utilidad tanto a los investigadores como a los profesionales que ejercen su trabajo en el ámbito del Derecho.
