En éste el franquiciador, en contraprestación de una compensación económica, concede al master el derecho de explotar una franquicia con la finalidad de concluir acuerdos de franquicia con terceros, los franquiciados, conforme al sistema definido por el franquiciador, asumiendo el master el papel de franquiciador en un mercado determinado. El contrato de master franquicia es el instrumento más frecuente de internacionalización de redes de franquicia. La realidad del tráfico económico justifica la oportunidad del tema: en primer lugar, por la importancia que en los últimos años han adquirido las redes de franquicia frente a otros sistemas de distribución integrada; y en segundo lugar, porque en el mercado español empiezan a vislumbrarse los factores económicos que, en su momento, justificaron la aparición del contrato en los EEUU. Sin desconocer la incidencia que el Derecho antitrust tiene en la configuración del contrato, el análisis del mismo se aborda utilizando una estructura clásica desde la perspectiva jurídico-obligacional: origen, características, naturaleza jurídica, tratos preliminares, derechos y obligaciones y extinción. En este sentido, se ofrece un estudio completo del contrato de master franquicia y de las distintas normas y resoluciones judiciales que inciden no tanto sobre el contrato en sí, por inexistentes, como sobre sus principales elementos y sobre aquellos contratos con los que éste presenta una semejanza no sólo genética sino también funcional, integrándolas en el marco de una relación de master franquicia. Por esta razón, la obra puede ser un instrumento de trabajo útil tanto para estudiosos y prácticos del Derecho como para aquellos que desde otras ramas de las Ciencias Sociales se aproximen al ámbito de las redes de franquicia.
