Book excerpt: While previous scholarship on organizational compliance with legal regulations demonstrates the managerialization of law--how business logics merge with legal logics to reshape the meaning of legal rules to benefit private organizations and repeat players--this study uncovers new mechanisms by which actors within the penal field reshape the meaning of laws designed to regulate their use of incarceration. Organizational documents produced by California county officials in the aftermath of the U.S. Supreme Court's order in Brown v. Plata (2011) and the enactment of a state prison downsizing law, "Realignment" (A.B. 109, 2011), are analyzed as empirical windows into a legal translation and meaning-making process in one of the western world's largest correctional systems. This analysis reveals four mechanisms by which counties with divergent historical imprisonment legacies produced divergent interpretations of the same legal mandate: scapegoating law, plagiarizing law, selective magnification and selective siting. Together, these mechanisms are differentiated from managerialization and identified as a new overarching process known as the penalization of law.

In capital trials in the United States, it can be a question of life or death whether a jury believes that a wrongdoer showed remorse. And in wrongdoings that capture the popular imagination, public attention focuses not only on the act but on whether the perpetrator feels remorse for what they did. But who decides when remorse should be shown or not shown and whether it is genuine or not genuine? In contrast to previous academic studies on the subject, the primary focus of this work is not on whether the wrongdoer meets these expectations over how and when remorse should be shown but on how the community reacts when these expectations are met or not met. Using examples drawn from Canada, the United States, and South Africa, the author demonstrates that the showing of remorse is a site of negotiation and contention between groups who differ about when it is to be expressed and how it is to be expressed. The book illustrates these points by looking at cases about which there was conflict over whether the wrongdoer should show remorse or whether the feelings that were shown were sincere. They remark (pages 170; 192) that a uniform concept of the goal of punishment is still lacking, although, when all is said, there is a general agreement on the principle of resocialization.
