Book excerpt: Part 3 of the Scotland Act 2012 deals exclusively with the devolution of financial powers. These include: the creation of a new Scottish rate of income tax; the disapplication of UK stamp duty land tax in Scotland and provision for the introduction of a new Scottish tax on land transactions; the disapplication of UK landfill tax in Scotland and provision for the introduction of a new Scottish tax on disposals to landfill; provision for borrowing by Scottish Ministers; and the power to devolve further existing taxes and create new devolved taxes. The financial provisions represent a substantial body of work and it is recognised that their implementation must be carefully managed over a period of time. The financial provisions will be implemented over a number of years, to ensure that appropriate transitional arrangements are put in place. In order that both the UK and Scottish Parliaments are fully informed through this process, section 33 of the Scotland Act 2012 requires the Secretary of State for Scotland and Scottish Ministers to report annually on the implementation of this part of the Act. This is the first of these annual reports and concludes that the implementation of Part 3 of the Scotland Act 2012 is progressing effectively and efficiently

Book excerpt: This fourth Annual Report marks significant milestones in the implementation of the Scotland Act 2012. Since the publication of last year's report, we have seen the successful commencement of the Land and Buildings Transaction Tax and Scottish Landfill Tax - the first new Scottish taxes in over 300 years. The Scottish Rate of Income Tax will take effect in April 2016, with the Deputy First Minister having announced in December that he intends to retain the same level of income tax as the rest of the UK for 2016/17. The implementation of the Scotland Act 2012 is of course just one element of the transfer of new powers to Scotland which has taken place in the past year. The Scotland Bill, introduced to Parliament on 28 May 2015, fulfils the Government's manifesto commitment to implement in full the all-party Smith Commission Agreement. It also brings a better balance to Scotland's devolution settlement and strengthens the Union as a result.

Available in PDF, EPUB and Kindle. Book excerpt: The UK Government is undertaking a major cross-government programme of analysis prior to the referendum on Scottish independence in 2014. The aim is to provide a comprehensive and detailed analysis of Scotland's place in the UK. This paper, the first of a series to be published in 2013 and 2014, examines the UK's constitutional set-up and the legal implications of independence. The UK Government is convinced that the current devolution offers the best for Scotland: the Scottish Parliament and Government are empowered to take decisions on a range of domestic policy areas - such as health, education, policing - while Scotland continues to benefit from decisions made for the UK as a whole - defence and security, foreign representation, economic affairs. Independence is very different to devolution. Based on independent expert opinion (published as Annex A), the paper concludes that if there were to be a vote in favour of leaving the UK, Scotland would become an entirely new state whilst the remainder of the UK would continue as before, retaining the rights and obligations of the UK as it currently stands. Any separation would have to be negotiated between both governments. Legal and practical implications of independence, both at home and abroad, are addressed. An independent Scotland would have to apply to and/or negotiate to become a member of whichever international organisations it wished to join, including the EU and NATO. Scotland would also have to work through its positions on thousands of international treaties to which the UK is currently party.

Book excerpt: During the Committee's investigation into the devolution of public finances, Lord Palmerston's assessment of the Schleswig-Holstein question has often sprung to mind. Funding of devolved administrations, particularly with regards to Scotland, is a complex mix of social, economic and political questions; "You would not start from here", has been the lament of many of our witnesses. This inquiry was prompted by the Smith Commission agreement. The Scottish cross-party Smith Commission was established by the Prime Minister, following the September 2014 referendum on Scottish independence, to agree further powers which should be devolved to Scotland. The Committee was particularly interested in the proposals that seek to increase the financial accountability of the Scottish Parliament. The Smith Commission agreement will be delivered through the Scotland Bill 2015 and the renegotiation of the 'fiscal framework' by the UK and Scottish Governments. The fiscal framework sets out how Scotland, Wales and Northern Ireland receive funding from the UK Government and the institutional arrangements that govern the process. The renegotiation of the fiscal framework may also have implications for future funding arrangements for Wales and Northern Ireland. Negotiations on the fiscal framework have yet to be concluded. This report draws attention to certain problems we have identified that the UK Government and devolved administrations need to address: (1) The Absence of the Fiscal Framework; (2) Funding of Devolved Administrations in the UK; (3) Adjustment of the block grant for Scotland to reflect devolved income tax receipts; (4) the second 'no detriment' principle; (5) choice of devolved taxes; (6) borrowing powers; (7) transparency and scrutiny.

Book excerpt: The ability of the foundations and rules of the UK to evolve and in doing so adapt to changing circumstances has been a great strength. England, despite being home to 83% of the population of the UK, is yet to join the other nations of the Union in having effective devolution. Outside London, most decisions about England are still taken centrally by the UK Parliament though many decisions in the devolved parts of the Union are also taken centrally in the sense that they are made by the devolved Administrations and Legislatures for the whole of that part of the Union. 'Prospects for codifying the relationship between central and local government' (HC 656-I, ISBN 9780215052544) outlined a way in which devolution for England could be taken forward using local councils as the vehicle. Among the options is a national forum, or pre-convention, for England to discuss the most appropriate method to address the English Question. A strong, lasting democratic settlement for the UK must be built upon two principles: those of devolution and union. That is to say, a broad acceptance of the role and powers of the Union, allied to a respect for different but agreed forms of devolution for the nations that make up the Union. The development of bespoke devolution, rather than one size fits all, is welcomed but the more this is within a context of an agreed role for the UK, the more sustainable the settlement will be

The aim is to provide a comprehensive and detailed analysis of Scotland's place in the UK. This paper examines how Scotland might arrange its currency and wider macroeconomic framework. It reviews the current UK arrangements and examines the options for change. In the event of a vote for independence Scotland would have to establish its own institutional framework, and the current system of risk-sharing would end. An independent Scottish state would have four main currency options: continue to use sterling with a formal agreement with the continuing UK (a sterling currency union); use sterling unilaterally with no formal agreement ('sterlingisation'); join the euro; or introduce a new Scottish currency. This paper examines all these options and concludes that all of them would be less likely to be economically suitable for both Scotland and the rest of the UK.

Book excerpt: The 2015 Parliament will see the continuing development of the relationship between Scotland and the United Kingdom as a whole. The Scotland Bill currently going through the House of Commons will devolve to the Scottish Parliament substantial powers over taxation and welfare, increasing both its powers and its responsibilities. Underpinning this transfer of responsibilities will be a revised fiscal and funding framework for Scotland-a crucial part of the devolution process that will give the Scottish Government and Parliament greater financial autonomy and substantially increase their accountability to the people of Scotland. Like other departmental select committees, the Scottish Affairs Commitee is charged with scrutinising the performance of a government department, in its case, the Scotland Office, the "guardian of the devolution settlement" and its relations with the Scottish Parliament. Through this inquiry the Scottish Affair Committee wishes to find out directly from people and organisations in Scotland what key issues we should be looking at in the first part of this Parliament.

This book was released on 2016 with total page 49 pages. Available in PDF, EPUB and Kindle. Book excerpt: The relationship between Scotland and the rest of the United Kingdom is changing. The Smith Commission, set up in the wake of the 2014 referendum on Scottish independence, recommended that further powers be devolved to the Scottish Parliament. The UK Government accepted the Commission's recommendations in full and transposed those powers into legislation in the form of the Scotland Bill 2015. The Bill is currently being considered in the UK Parliament and soon the Scottish Parliament will do the same when it is invited to scrutinise and give its consent to the legislation. However, the Scotland Bill 2015 is only part of the process of further devolution. In order for the tax and spending provisions contained in the Bill to be successfully devolved, the way in which Scotland is funded must change. The fiscal framework for Scotland underpins the devolution settlement. The success of this latest round of devolution will depend to a large extent on the outcome of negotiations over the framework. Both governments have agreed not to comment on the negotiations while they are ongoing but this has led to concerns of a lack of debate over the appropriate degree of risk and incentives that Scotland should face as a result of the new settlement. As we aim to set out in this Report, these questions are fundamental to the whole process.

It studies constitutional and statutory limitations, as well as those imposed by international treaties and other instruments, including those of both the European Union and the International Monetary Fund. The book contains a general report examining the fiscal rules that govern the budgets and expenditures of nation states. The general report is followed by a special report which covers the limits imposed by the European Union and by the smaller group of countries constituting the Eurozone. Ten national reports, describing the limits in their respective countries, form the basis of the general report. These countries include eight members of the European Union (five of which use the Euro and three of which do not), one other European state and one non-European state. The reports include two countries in which constitutional “debt brakes” limit national deficit and debt.

This detailed analysis of the Scottish and Welsh Conservative Parties explains how they moved from campaigning against devolution to sitting in the Scottish Parliament and Welsh Assembly. Tracing the processes of party change in both parties this study explains why the Welsh Conservatives unexpectedly embraced devolution while the Scottish Conservatives took much longer to accept that Westminster was no longer the priority. This book will be of interest to students of British, Scottish and Welsh politics and anyone who is interested in the Conservative Party. It also speaks to wider debates about the nature of devolution, party change and multi-level governance.

Available in PDF, EPUB and Kindle. Book excerpt: This book presents a narrative of Scottish politics since devolution in 1999. It compares eight years of coalition government under Scottish Labour and the Scottish Liberal Democrats with four years of Scottish National Party minority government. It outlines the relative effect of each government on Scottish politics and public policy in various contexts, including: high expectations for ‘new politics' that were never fully realised; the influence of, and reactions from, the media and public; the role of political parties; the Scottish Government's relations with the UK Government, EU institutions, local government, quasi-governmental and non-governmental actors; and, the finance available to fund policy initiatives. It then considers how far Scotland has travelled on the road to constitutional change, comparing the original devolved framework with calls for independence or a new devolution settlement. The book draws heavily on information produced since 1999 by the Scottish Devolution Monitoring project (which forms one part of the devolution monitoring project led by the Constitution Unit, UCL) and is supplemented by new research on public policy, minority government, intergovernmental relations and constitutional change.

Book excerpt: In May 2015, general elections in the United Kingdom shocked the world as a new Conservative Government was voted into power, ending five years of Coalition governance. Both a response to the actions of the Coalition Government and a reflection on the implications of actions taken during the first hundred days of the new Conservative Government, this book could not be more timely in its assessment of the current and future states of UK social policies. The first book to consider Coalition social policy in its entirety, it not only reviews and evaluates the extent of change under the Coalition--looking at the impact of factors like austerity measures on social policies and politics more broadly--but also draws out what the Coalition years will mean for the incoming government, outlining both the challenges and opportunities of its legacy.

Book excerpt: As the volume of transactions in European financial markets continues to grow, the use of financial collateral, be it in the form of cash, shares, bonds or credit claims, has become a critical tool in supporting and managing risk in financial transactions. This book is the first of its kind to offer a systematic examination of the whole law relating to financial collateral. It does so in two parts. First, it explains the law created by the Financial Collateral Arrangements (No 2) Regulations 2003, the Directive it implemented and related legislation. Second, it examines how financial collateral is used in practice in a range of different markets. It will be an essential reference point for all legal practitioners operating in financial markets. Key features: • Analytical rigour combined with insight into how financial collateral works in practice, covering both English and Scots law • Valuable discussion of control and possession tests, right of use, remedy of appropriation, close-out netting and impact of ‘bail-in’ • Explains use of financial collateral in the derivatives market, clearing houses, direct and indirect securities holding systems and use of repos, securities lending and prime brokerage • Highlights key issues on regulatory treatment and conflicts of laws • Discusses direction of future law reform • Written by leading experts in the field.
