Book excerpt: Although human rights belong to all persons on the basis of their humanity, this book demonstrates that in the practice of international human rights law, the freedom to be non-religious or atheist does not receive the same protection as the freedom to be religious. Despite the claimed universality of freedom of religion and belief contained in article 18 of the International Covenant on Civil and Political Rights, the key assertion made is that there is a hierarchy of religion and belief, with followers of major established religions enjoying high protection and low regulation at the top, and atheists and non-believers enduring high persecution and weaker protection at the bottom. The existence of this hierarchy is proven and critiqued through three case study chapters that respectively explore the extent to which non-religious and atheist rights-holders enjoy freedom from proselytism, freedom from hate and freedom from the religions of their parents.

Special Rapporteurs (for example those on racism, freedom of expression, minority issues and cultural rights) and Treaty Bodies (for example the Human Rights Committee, the Committee on the Elimination of Racial Discrimination and the Committee on the Rights of the Child) have also elaborated on freedom of religion or belief in the context of their respective mandates. Freedom of Religion or Belief: An International Law Commentary is the first commentary to look comprehensively at the international provisions for the protection of freedom of religion or belief, considering how they are interpreted by various United Nations Special Procedures and Treaty Bodies. Book excerpt: The idea of the ‘Bangladesh paradox’ describes the unexpected social progress that Bangladesh has made in recent decades that has been both pro-poor and gender equitable. This began at a time when the country was characterised by extreme levels of poverty, poor quality governance, an oppressive patriarchy and rising Islamic orthodoxy. This ‘paradox’ has evoked a great deal of interest within the international development community because Bangladesh had been dubbed an ‘international basket case’ at the time of its independence in 1971, seemingly trapped in a development impasse. Previous attempts to explain this paradox have generally taken a top-down approach, focusing on the role of leading institutional actors – donors, government, NGOs and the private sector. In Renegotiating Patriarchy: Gender, Agency and the Bangladesh Paradox, Naila Kabeer starts with the rationale that policy actions taken at the top are unlikely to materialise into actual changes if they are not acted on by the mass of ordinary women and men. But what led these women and men to act? And why did they act in ways that modified some of the more oppressive aspects of patriarchy in the country? That is what this book sets out to investigate. It describes the history of the Bengal delta, and the forces that gave rise to the kind of society that Bangladesh was at the time of its independence. It considers the policy and politics that characterised post-independence Bangladesh and how these contributed to the progress captured in the idea of the Bangladesh paradox. But the key argument of the book is that much of this progress reflected the agency exercised by ordinary, often very poor, women in the course of their everyday lives. Their agency helped to translate institutional actions into concrete changes on the ground. To explore why and how this happened, the book draws on a rich body of ethnographic, qualitative and quantitative research on social change in Bangladesh – including studies by the author herself. The book is therefore about how norms and practices can change in progressive ways despite unpropitious circumstances as a result of the efforts of poor women in Bangladesh to renegotiate what had been described as one of the most non-negotiable patriarchies in the world.

Book excerpt: The Declaration on the Elimination of All Forms of Intolerance and of Discrimination Based on Religion or Belief, as proclaimed by the United Nations General Assembly in 1981, is the only universal human rights instrument specifically focusing on religious intolerance and discrimination. However, recent years have seen increasing controversy surrounding this right, in both political and legal contexts. The European Court of Human Rights has experienced a vast expansion in the number of cases it has had brought before it concerning religious freedom, and politically the boundaries of the right have been much disputed. This book provides a systematic analysis of the different approaches to religious rights which exist in public international law. The book explores how particular institutional perspectives emerge in the context of these differing approaches. It examines, and challenges, these institutional perspectives. It identifies new directions for approaching religious rights through international law by examining existing legal tools, and assesses their achievements and shortcomings. It studies religious organisations' support for international human rights protection, as well as religious critique of international human rights and the development of an alternative religious 'Bills of Rights'. It investigates whether expressions of members belonging to religious minorities can be considered under the minority right to culture, rather than the right to religion, and discusses the benefits and shortcomings of such a route. It analyses the reach and limits of the provisions in the 1981 Declaration, identifies ways in which the right is being eroded as a concept, and suggests new ways in which the right can be reinforced and protected.

This study seeks to evaluate the language and content of blasphemy laws to understand what aspects of these laws adhere to--or deviate from--international and human rights law principles. A better understanding of the laws' compliance with these principles may assist in the public policy community in developing clear, specifically-tailored recommendations for areas for reform.
