Book excerpt: Serious Offenders: A Historical Study of Habitual Criminals examines the persistent offending careers of men and women operating in northwest England between the 1840s and 1940s. The book focuses on a group of serious and persistent offenders who as well as offending in the region, had lengthy offending careers spanning several decades in various other locations. These were highly mobile persistent serious offenders who appear not to have been so closely bound in to the processes and structures which aided desistence from offending for the vast majority of the petty offenders. The authors discuss questions such as: Why did some people remain minor offenders, whilst others developed into serious offenders? What were the triggers which propelled previously minor offenders towards persistent serious criminality? What part did changes in criminal legislation play in these processes? They conclude by drawing on the lessons to be learnt for today's debates about the regulation and surveillance of serious habitual offenders.

Available in PDF, EPUB and Kindle. Book excerpt: Money is the most frequently means used in the legal system to punish and regulate. Monetary penalties outnumber all other sanctions delivered by criminal justice in many jurisdictions, imprisonment included. More people pay fines than go to prison and in some jurisdictions many of those in prison are there because of failure to pay their fines. Therefore, it is surprising how little has been written in the Anglophone academic world about the nature of money sanctions and their specific characteristics as legal sanctions. In many ways, legal innovations related to money sanctions have been poorly understood. This book argues that they are a direct consequence of the changing meaning of money. Considering the ‘meaninglessness’ of modern money, the book aims to examine the history of changing conceptions in how fines have been conceived and used. Using a set of interpretative techniques sensitive to how money and freedom are perceived, the genealogy of the penal fine is presented as a story of constant reformulation in response to shifting political pressures and changes in intellectual developments that influenced ideological commitments of legislators and practitioners. This book is multi-disciplinary and will appeal to those engaged with criminology, sociology and philosophy of punishment, socio-legal studies, and criminal law.

How these crimes are punished, policed and understood has changed considerably over the last century. From hormone injections to cognitive behavioural therapy, medical and psychological approaches to sexual offenders have proliferated. This book sets out the history of such theories and treatments in England. Beginning in the early 20th century, it traces the evolution of medical interest in the mental state of those convicted of sexual crime. As part of a broader interest in individualised responses to crime as a means to rehabilitation, doctors offered new explanations for some sexual crimes, proposed new solutions, and attempted to deliver new cures. From indecent exposure to homosexuality between men, from sadistic violence to thefts of underwear from washing lines, the interpretation and treatment of some sexual offences was thought to be complex. Of less medical interest, though, were offences against children, prostitution, and rape. Using a range of material, including medical and criminological texts, trial proceedings, government reports, newspapers, and autobiographies and memoirs, Janet Weston offers powerful insights into changing medico-legal practices and attitudes towards sex and health. She highlights the importance of prison doctors and rehabilitative programmes within prisons, psychoanalytically-minded private practitioners, and the interactions between medical and legal systems as medical theories were put into practice. She also reveals the extent and legacy of medical thought, as well as the limitations of a medical approach to sexual crime.

Available in PDF, EPUB and Kindle. Book excerpt: Why are certain methods of punishment adopted or rejected in a given social situation? To what extent is the development of penal methods determined by basic social relations? The answers to these questions are complex, and go well beyond the thesis that institutionalized punishment is simply for the protection of society. While today's punishment of offenders often incorporates aspects of psychology, psychiatry, and sociology, at one time there was a more pronounced difference in criminal punishment based on class and economics. Punishment and Social Structure originated from an article written by Georg Rusche in 1933 entitled "Labor Market and Penal Sanction: Thoughts on the Sociology of Criminal Justice." Originally published in Germany by the Frankfurt Institute of Social Research, this article became the germ of a theory of criminology that laid the groundwork for all subsequent research in this area. Rusche and Kirchheimer look at crime from an historical perspective, and correlate methods of punishment with both temporal cultural values and economic conditions. The authors classify the history of crime into three primary eras: the early Middle Ages, in which penance and fines were the predominant modes of punishment; the later Middle Ages, in which harsh corporal punishment and capital punishment moved to the forefront; and the seventeenth century, in which the prison system was more fully developed. They also discuss more recent forms of penal practice, most notably under the constraints of a fascist state. The majority of the book was translated from German into English, and then reshaped by Rusche's co-author, Otto Kirchheimer, with whom Rusche actually had little discussion. While the main body of Punishment and Social Structure are Rusche's ideas, Kirchheimer was responsible for bringing the book more up-to-date to include the Nazi and fascist era. Punishment and Social Structure is a pioneering work that sets a paradigm for the study of crime and punishment.

Available in PDF, EPUB and Kindle. Book excerpt: Historians of Winston Churchill's career customarily mention his innovations, whether realized or not, in prison treatment and sentencing during his Home Secretaryship between February 1910 and October 1911. Little mention is made, however, of what motivated him. This book traces the evolution of Churchill's thinking as it has survived in the documentary records of his Home Secretaryship held in the Home Office archive, together with other evidence, both primary and secondary. This evidence incorporates the exchange of views concerning specific prison treatment and sentencing issues in which Churchill engaged with his senior Home Office staff and His Majesty's Prison Commissioners in the course of their day-to-day transaction of the business of criminal justice. These issues continue to be relevant, given the ongoing debate about modification of the criminal justice system, the internal organization and management of the Home Office as its overseer and more particularly prison treatment and sentencing. The book also sheds light on Churchill as a person, a politician and a government minister by focusing on his working methods and his relationships with his staff, reminding us of a side to his character which is an important element in understanding his long parliamentary and ministerial career.
