Book Synopsis Law Books in Action by : Angela Fernandez
Download or read book Law Books in Action written by Angela Fernandez and published by Bloomsbury Publishing. This book was released on 2012-04-02 with total page 262 pages. Available in PDF, EPUB and Kindle. Book excerpt: 'Law Books in Action: Essays on the Anglo-American Legal Treatise' explores the history of the legal treatise in the common law world. Rather than looking at treatises as shortcuts from 'law in books' to 'law in action', the essays in this collection ask what treatises can tell us about what troubled legal professionals at a given time, what motivated them to write what they did, and what they hoped to achieve. This book, then, is the first study of the legal treatise as a 'law book in action', an active text produced by individuals with ideas about what they wanted the law to be, not a mere stepping-stone to codes and other forms of legal writing, but a multifaceted genre of legal literature in its own right, practical and fanciful, dogmatic and ornamental in turn. This book will be of interest to legal scholars, lawyers and judges, as well as to anyone else with a scholarly interest in law in general, and legal history in particular.
Book Synopsis Failures of American Methods of Lawmaking in Historical and Comparative Perspectives by : James R. Maxeiner
Download or read book Failures of American Methods of Lawmaking in Historical and Comparative Perspectives written by James R. Maxeiner and published by Cambridge University Press. This book was released on 2018-03-08 with total page 368 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this book, James R. Maxeiner takes on the challenge of demonstrating that historically American law makers did consider a statutory methodology as part of formulating laws. In the nineteenth century, when the people wanted laws they could understand, lawyers inflicted judge-made, statute-destroying, common law on them. Maxeiner offers the cure for common law, in the form of sensible statute law. Building on this historical evidence, Maxeiner shows how rule-making in civil law jurisdictions in other countries makes for a far more equitable legal system. Sensible statute laws fit together: one statute governs, as opposed to several laws that even lawyers have trouble disentangling. In a statute law system, lawmakers make laws for the common good in sensible procedures, and judges apply sensible laws and do not make them. This book shows how such a system works in Germany and would be a solution for the American legal system as well.

Book Synopsis Utilitarianism in the Early American Republic by : James E. Crimmins
Download or read book Utilitarianism in the Early American Republic written by James E. Crimmins and published by Routledge. This book was released on 2021-11-01 with total page 299 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Utilitarianism in the Early American Republic James E. Crimmins provides a fresh perspective on the history of antebellum American political thought. Based on a broad-ranging study of the dissemination and reception of utilitarian ideas in the areas of constitutional politics, law education, law reform, moral theory and political economy, Crimmins illustrates the complexities of the place of utilitarianism in the intellectual ferment of the times, in both its secular and religious forms, intersection with other doctrines, and practical outcomes. The pragmatic character of American political thought revealed—culminating in the postbellum rise of Pragmatism—stands in marked contrast to the conventional interpretations of intellectual history in this period. Utilitarianism in the Early American Republic will be of interest to academic specialists, and graduate and senior undergraduate students engaged in the history of political thought, moral philosophy and legal philosophy, particularly scholars with interests in utilitarianism, the trans-Atlantic transfer of ideas, the American political tradition and modern American intellectual history.

Book excerpt: This broad, comparative study examines the social, economic, and legal contexts of crime and authority in two vastly different states over a one hundred year period. Massachusetts--an urban, industrial, and heterogeneous northern state--chose the penitentiary in its attempt to minimize the role of informal and extralegal authority while South Carolina--a rural southern slave state--systematically reduced its formal legal institutions, frequently relying on vigilantism. Book Synopsis Parchment, Paper, Pixels by : Peter M. Tiersma
Download or read book Parchment, Paper, Pixels written by Peter M. Tiersma and published by University of Chicago Press. This book was released on 2010-06-15 with total page 270 pages. Available in PDF, EPUB and Kindle. Book excerpt: Technological revolutions have had an unquestionable, if still debatable, impact on culture and society—perhaps none more so than the written word. In the legal realm, the rise of literacy and print culture made possible the governing of large empires, the memorializing of private legal transactions, and the broad distribution of judicial precedents and legislation. Yet each of these technologies has its shadow side: written or printed texts easily become static and the textual practices of the legal profession can frustrate ordinary citizens, who may be bound by documents whose implications they scarcely understand. Parchment, Paper, Pixels offers an engaging exploration of the impact of three technological revolutions on the law. Beginning with the invention of writing, continuing with the mass production of identical copies of legal texts brought about by the printing press, and ending with a discussion of computers and the Internet, Peter M. Tiersma traces the journey of contracts, wills, statutes, judicial opinions, and other legal texts through the past and into the future. Though the ultimate effects of modern technologies on our legal system remain to be seen, Parchment, Paper, Pixels offers readers an insightful guide as to how our shifting forms of technological literacy have shaped and continue to shape the practice of law today.
