It will also be observed from the summary that it is not universally true that where the master is guilty of negligence the servant can recover compensation, for, if the master be guilty of negligence, and at the time of the injury to the servant he himself was not in the exercise of due care for his own safety (such care as an ordinarily prudent man would exercise for his own safety under the same or like circumstances), or was guilty himself of negligence, and such want of due care, or his own negligence con tributed in the slightest degree to the injury, the servant forfeits his right to compensation to the master, notwithstanding the mas ter's negligence.
