The state thus was treated by the Romans as a corporation or person, or as we treat every other corporation except the state. The logical result of their conception of a state as a corporatiou, made thein apply the law of prescription to the state as to an individual. Whatever view the legislators may have had in providing prescription for claims of the State, any lawyer who has had to contest a tax or a license, of no matter how many years standing, knows the difficulties presented by our jurisprudence. Yet the same principles apply. Time destroys evidence against the State as it does against an individual. And the same necessity of encouraging thrift by placing some limit to a debt and to quieting the citizen who has, to use a popular expression, reformed and is attempting to meet his obligations and to do better in the future, applies to the State as to his fellow-citizen. Ihe very object of Statecraft being to ennoble and encourage society, it is more appropriate that the State should set the example by observing its own rules. Another instance in which our courts displayed a tendency to change the jurisprudence of the State was on the subject of fldei commissa and substitutions.
