Available in PDF, EPUB and Kindle. Book excerpt: The local prisons of the latter half of the nineteenth century refined systems of punishment so harsh that one judge considered the maximum penalty of two years local imprisonment to be the most severe punishment known to English law: "next only to death". This work examines how private perceptions and concerns became public policy. It also traces the move in English government from the rural and aristocratic to the urban and more democratic. It follows the rise of the powerful elite of the higher civil service, describes some of the forces that attempted to oppose it, and provides a window through which to view the process of state formation.

Book excerpt: This title, first published in 1981, draws from an extensive range of national and local material, and examines how innovations in policy and administration, while solving problems or setting new objectives, frequently created or disclosed fresh difficulties, and brought different types of people into the administration and management of prisons, whose interests, values and expectations in turn often had significant effects upon penal ideas and their practical applications. Special attention has been paid to the study of recruitment, the work and influence of gaolers, keepers, governors, and highly administrative officials. This comprehensive book will be of interest to students of criminology and history.

Available in PDF, EPUB and Kindle. Book excerpt: The book covers the period from 1812, when the Tron Riot in Edinburgh dramatically drew attention to the ‘lamentable extent of juvenile depravity’, up to 1872, when the Education Act (Scotland) inaugurated a system of universal schooling. During the 1840s and 1850s in particular there was a move away from a punitive approach to young offenders to one based on reformation and prevention. Scotland played a key role in developing reformatory institutions – notably the Glasgow House of Refuge, the largest of its type in the UK – and industrial schools which provided meals and education for children in danger of falling into crime. These schools were pioneered in Aberdeen by Sheriff William Watson and in Edinburgh by the Reverend Thomas Guthrie and exerted considerable influence throughout the United Kingdom. The experience of the Scottish schools was crucial in the development of legislation for a national, UK-wide system between 1854 and 1866.

Book excerpt: How did Scotland's criminal justice system respond to marginalised street children who found themselves on the wrong side of the law, often for simple vagrancy or other minor offences? This book examines the historical criminalisation of Scotland's Victorian children, as well as revealing the history and early success of the Scottish day industrial school movement - a philanthropic response to juvenile offending hailed as 'magic' in Charles Dickens's Household Words. With case studies ranging from police courts to the High Court of Justiciary, the book offers a lively account of the way children experienced Scotland's early juvenile justice system.

Available in PDF, EPUB and Kindle. Book excerpt: In recent years, social and legal historians have called into question the degree to which the labour that fuelled and sustained industrialization in England was actually ’free’. The corpus of statutes known as master and servant law has been a focal point of interest: throughout the eighteenth and nineteenth centuries, at the behest of employers, mine owners, and manufacturers, Parliament regularly supplemented and updated the provisions of these statutes with new legislation which contained increasingly harsh sanctions for workers who left work, performed it poorly, or committed acts of misbehaviour. The statutes were characterized by a double standard of sanctions, which treated workers’ breach of contract as a criminal offence, but offered only civil remedies for the broken promises of employers. Surprisingly little scholarship has looked into resistance to the Master and Servant laws. This book examines the tactics, rhetoric and consequences of a sustained legal and political campaign by English and Welsh trade unions, Chartists, and a few radical solicitors against the penal sanctions of employment law during the mid-nineteenth century. By bringing together historical narratives that are all too frequently examined in isolation, Christopher Frank is able to draw new conclusions about the development of the English legal system, trade unionism and popular politics of the period. The author demonstrates how the use of imprisonment for breach of a labour contract under master and servant law, and its enforcement by local magistrates, played a significant role in shaping labour markets, disciplining workers and combating industrial action in many regions of England and Wales, and further into the British Empire. By combining social and legal history the book reveals the complex relationship between parliamentary legislation, its interpretation by the high courts, and its enforcement by local officials. This work marks an important contribution to legal

Available in PDF, EPUB and Kindle. Book excerpt: This book is the first history of the Irish juvenile justice system. It charts the emergence of the system from the mid-nineteenth century to the present. From the beginning, the system was dominated by a large network of reformatory and industrial schools which incarcerated tens of thousands of children and remained in existence into the late twentieth century. This dominance was eventually challenged by emerging discourses which emanated from the psychological sciences, social work, youth work and the children’s rights movement. The book draws from a wide range of official and unofficial sources in exploring the key rationalities underpinning the system. In adopting a governmentality approach, it also examines the technologies and forms of childhood identity that are employed to govern the child and young person within the context of the Irish juvenile justice system. This unique and original approach will appeal to legal scholars, criminologists and those with an interest in juvenile justice, history and social policy.
