Cette recherhce se fonde sur des études de cas, la littérature comptable d'abord puis de gestion, et sur des sources secondaires. Dans un premier temps, nous rappelons d'abord que la comptabilité est tenue dans les grandes entreprises du XVIIIe et du début du XIXe sans qui'il n'existe pour autant de fonction comptable autonome. Le contraste est alors éloquent entre une technique assez élaborée mais diffusée de façon très disparate et un personnel comptable peu nombreux. Dans un second temps, nous mettrons en évidence une rupture dans le savoir comptable à partir du début du XIXe siècle. S'appuyant sur la montée du nombre de faillites, il acquiert progressivement une légitimité suffisante pour devenir normatif, permettant l'apparition d'institutions qu'il légitimera : l'enseignement et les associations comptables, la presse professionnelle et les professions libérales que sont les experts-comptables et les ingénieurs-conseils. D'une façon ou d'une autre, elles contribuent à installer, développer et rendre incontournable la fonction comptable comme le mode d'organisation de la comptabilité dans la grande entreprise. Dans un dernier temps, nous définissons enfin la fonction comptable. Ce sont évidememment des techniques intellectuelle (la comptabilité) et matérielle (la mécanisation, les feuillets mobiles, etc.). Mais c'est aussi une multiplication de fonctions où s'invente une division du travail de plus en plus élaborée. La fonction comptable, c'est enfin le lieu où l'organisation prend toute son importance à travers les problématiques de l'espace, du temps et de la structure.

Afin d'appréhender cette problématique, une méthodologie qualitative, basée sur l'étude des archives et des entretiens, est adoptée. Elle répond aux spécificités du contexte et de la période étudiée (1906-2006). Cette étude retrace le parcours d'évolution de la profession comptable en période coloniale et post-coloniale. Ainsi, le développement de l'environnement de cette profession et de ses membres est analysé. Cette profession a vécu deux grands processus d'organisation (1948-1954 et 1980-1994) dont cette recherche examine et détaille les étapes, les acteurs et les procédés. Le Maroc représente un contexte d'autant plus singulier que son analyse à travers le cadre théorique et méthodologique mobilisé amène plusieurs apports à la littérature. La thèse apporte une contribution significative en identifiant le degré d'implication et les rôles des différents acteurs institutionnels dans le processus d'organisation de la profession comptable. Le développement et l'organisation de cette profession au Maroc a été dépendant de l'Etat, des groupes professionnels et de l'influence des institutions financières internationales facilitant et développant un marché pour les services comptables et une fonction sociale pour la profession.

Book excerpt: Despite broad international recognition of the criminalization of illicit enrichment, it has not been universally accepted as an anti-corruption measure. Instead, criminalization of illicit enrichment continues to generate extensive debate and controversy. Against this background, this volume aims to provide an analysis of how illicit enrichment works, and attempts to shed light on any contributions that it has made to the fight against corruption and the recovery of stolen assets. Rather than delving into the theoretical and academic debates around illicit enrichment, this study focuses primarily on the analysis of current practice, case law, and existing literature to offer a new perspective to the on-going discussions. More specifically, the volume addresses the legal framework upon which the concept of illicit enrichment rests, and the resulting policy implications of that legal framework. It also focuses on illicit enrichment as an anti-corruption mechanism, from its roots as a response to the problems inherent to prosecutions involving corruption, to an examination of elements and inchoate offenses relating to illicit enrichment under international conventions. It examines illicit enrichment jurisprudence in the global context. An extensive survey was carried out to determine the countries where the offense exists, what form it takes, how often it is used, and for countries where it doesn't, what other measures are used in its place. The authors neither recommend nor oppose the adoption of illicit enrichment provisions, but rather aim to assist jurisdictions considering such steps by highlighting key questions that might arise during implementation, including how the offense is defined and enforced domestically by States. Similarly, the authors do not endorse nor criticize any practice carried out by States in the implementation of the criminalization of illicit enrichment. Ultimately, it is also hoped that this study provides a basis for further discussion amongst policy makers and practitioners, and fuels upcoming discussions by the Conference of State parties of the UNCAC and its Working Groups
