Book excerpt: Al arrendar una vivienda se realizar? siempre por escrito un contrato de arrendamiento que habr?n de suscribir tanto el propietario como el inquilino. Al alquilar una vivienda las condiciones se establecer?n siempre por escrito mediante un contrato de arrendamiento entre ambas partes, el arrendador (propietario del inmueble o quien act?a en calidad de tal), y el arrendatario, la persona que paga para vivir en la vivienda. El contrato recoger? los siguientes apartados: 1.- Lugar y fecha en la que se lee y firma el contrato. 2.- Reunidos: Aqu? aparecen las partes que firman el contrato, "de una parte" el arrendador y de "otra" el arrendatario, con sus datos personales.(nombre, apellidos, direcci?n, DNI). 3.- Manifiestan: Aqu? se determina el "objeto" del contrato de arrendamiento, en este caso la vivienda que se alquila, as? como un detalle de la misma, metros ,ubicaci?n, distribuci?n de la misma. etc. 4.- Estipulan: A partir de aqu? aparecen los detalles a los que las partes se someten , es decir los acuerdos y condiciones del arrendamiento. .- Duraci?n: Se puede pactar libremente el n?mero de meses o a?os, siempre que no sea un acuerdo contrario a ley. Se a?adir? cuando entra en vigor el presente contrato. .- Renta: la que pacten las partes. En este tipo de alquiles no existe IVA. Se fija la cantidad que se ha de pagar de forma peri?dica y la forma de pago de la renta. .- Revisi?n de la renta: la Ley de Arrendamientos Urbanos (LAU) de 4 Noviembre de 1994 establece como incremento la variaci?n de IPC anual, pero se puede pactar otro importe. .- Destino: Se determina el uso de la vivienda. .- Conservaci?n: El arrendatario se comprometer? a devolver la vivienda en el mismo estado en la cual la recibi?. Si se han realizado mejoras, y si esto se pact?, tambi?n es conveniente que se fije si el inquilino tiene derecho a una indemnizaci?n por ellas, ya que el piso reformado normalmente aumenta de valor y por su naturaleza las obras no se pueden deshacer. Pero esto sirve s?lo previo pacto entre ambas partes en el contrato. .- Gastos e impuestos: Los gastos correspondientes al pago de las cuotas de comunidad correr?n a cargo del arrendador, as? como el pago de las tasas de alcantarillado y basuras, y el recibo del Impuesto de Bienes Inmuebles (IBI). Por el contrario todos los gastos derivados de mantenimientos de contadores, luz, agua, etc. corren a cargo del arrendatario. .- Reparaciones: Los gastos derivados de reparaciones por el uso habitual y mantenimiento de las instalaciones de la casa corren a cargo del arrendatario. Del resto ser?n a cargo del arrendador. .- Fianza: El arrendatario viene obligado a depositar en poder del arrendador una cantidad, que corresponde con una mensualidad de arrendamiento, esta cantidad ser? devuelta por el arrendador una vez se de por concluido el arrendamiento. .- Demora en el pago. Se podr? pactar c?mo proceder en caso de impago del alquiler. Estas son las estipulaciones habituales para el contrato de arrendamiento, pero siempre se podr?n todos los requisitos que quieran las partes. Por ejemplo, respecto a la fianza se pueden pactar otras garant?as del cumplimiento de las obligaciones del inquilino, adem?s del dep?sito por importe de un mes, que ser? obligatorio El libro incorpora de forma ?ntegra y actualizada la Ley de Arrendamientos Urbanos.
