Available in PDF, EPUB and Kindle. Book excerpt: From the Mormon Church's public announcement of its sanction of polygamy in 1852 until its formal decision to abandon the practice in 1890, people on both sides of the "Mormon question" debated central questions of constitutional law. Did principles of religious freedom and local self-government protect Mormons' claim to a distinct, religiously based legal order? Or was polygamy, as its opponents claimed, a new form of slavery--this time for white women in Utah? And did constitutional principles dictate that democracy and true liberty were founded on separation of church and state? As Sarah Barringer Gordon shows, the answers to these questions finally yielded an apparent victory for antipolygamists in the late nineteenth century, but only after decades of argument, litigation, and open conflict. Victory came at a price; as attention and national resources poured into Utah in the late 1870s and 1880s, antipolygamists turned more and more to coercion and punishment in the name of freedom. They also left a legacy in constitutional law and political theory that still governs our treatment of religious life: Americans are free to believe, but they may well not be free to act on their beliefs.

Available in PDF, EPUB and Kindle. Book excerpt: Campaigns against Corporal Punishment explores the theory and practice of punishment in Antebellum America from a broad, comparative perspective. It probes the concerns underlying the naval, prison, domestic, and educational reform campaigns which occurred in New England and New York from the late 1820s to the late 1850s. Focusing on the common forms of physical punishment inflicted on seamen, prisoners, women, and children, the book reveals the effect of these campaigns on actual disciplinary practices. Myra C. Glenn also places the crusade against corporal punishment in the context of various other contemporary reform movements such as the crusade against intemperance and that against slavery. She shows how regional and political differences affected discussions of punishment and discipline.

Available in PDF, EPUB and Kindle. Book excerpt: A piece of Plymouth Rock. A lock of George Washington’s hair. Wood from the cabin where Abraham Lincoln was born. Various bits and pieces of the past—often called “association items”—may appear to be eccentric odds and ends, but they are valued because of their connections to prominent people and events in American history. Kept in museum collections large and small across the United States, such objects are the touchstones of our popular engagement with history. In Sacred Relics, Teresa Barnett explores the history of private collections of items like these, illuminating how Americans view the past. She traces the relic-collecting tradition back to eighteenth-century England, then on to articles belonging to the founding fathers and through the mass collecting of artifacts that followed the Civil War. Ultimately, Barnett shows how we can trace our own historical collecting from the nineteenth century’s assemblages of the material possessions of great men and women.

Available in PDF, EPUB and Kindle. Book excerpt: This provocative reassessment of the 19th century American women’s movement calls into question its attack on common law traditions. While the United States was founded on principles of freedom and equality, its legal traditions are based in British common law. In the nineteenth-century, women’s rights advocates argued that this led to a contradiction: common law rules concerning property and the status of married women were at odds with the nation’s principles. Conventional wisdom suggests that this tactic was successful. But in Constitutional Context, historian Kathleen S. Sullivan offers a fresh perspective. In revisiting the era’s congressional debates, state legislation, judicial opinions, news accounts, and work of political activists, Sullivan finds that the argument for universal, abstract rights was not the only—or even the best—path available for social change. Rather than establishing a new paradigm of absolute rights, the women’s movement unwittingly undermined common law’s ability to redress grievances. This contributed to the social, cultural, and political stagnation that characterizes the movement today. A challenging and thoughtful study of what is commonly thought of as an era of progress, Constitutional Context provides the groundwork for a more comprehensive understanding and interpretation of constitutional law.

Available in PDF, EPUB and Kindle. Book excerpt: In this spellbinding new history, David Goldfield offers the first major new interpretation of the Civil War era since James M. McPherson's Battle Cry of Freedom. Where past scholars have limned the war as a triumph of freedom, Goldfield sees it as America's greatest failure: the result of a breakdown caused by the infusion of evangelical religion into the public sphere. As the Second GreatAwakening surged through America, political questions became matters of good and evil to be fought to the death. The price of that failure was horrific, but the carnage accomplished what statesmen could not: It made the United States one nation and eliminated slavery as a divisive force in the Union. The victorious North became synonymous with America as a land of innovation and industrialization, whose teeming cities offered squalor and opportunity in equal measure. Religion was supplanted by science and a gospel of progress, and the South was left behind. Goldfield's panoramic narrative, sweeping from the 1840s to the end of Reconstruction, is studded with memorable details and luminaries such as HarrietBeecher Stowe, Frederick Douglass, and Walt Whitman. There are lesser known yet equally compelling characters, too, including Carl Schurz-a German immigrant, warhero, and postwar reformer-and Alexander Stephens, the urbane and intellectual vice president of the Confederacy. America Aflame is a vivid portrait of the "fiery trial"that transformed the country we live in.

Available in PDF, EPUB and Kindle. Book excerpt: The Utah War of 1857–58, the unprecedented armed confrontation between Mormon Utah Territory and the U.S. government, was the most extensive American military action between the Mexican and Civil wars. At Sword’s Point presents in two volumes the first in-depth narrative and documentary history of that extraordinary conflict. William P. MacKinnon offers a lively narrative linking firsthand accounts—most previously unknown—from soldiers and civilians on both sides. This first volume traces the war’s causes and preliminary events, including President Buchanan’s decision to replace Brigham Young as governor of Utah and restore federal authority through a large army expedition. Also examined are Young’s defensive-aggressive reactions, the onset of armed hostilities, and Thomas L. Kane’s departure at the end of 1857 for his now-famous mediating mission to Utah. MacKinnon provides a balanced, comprehensive account, based on a half century of research and a wealth of carefully selected new material. Women’s voices from both sides enrich this colorful story. At Sword’s Point presents the Utah War as a sprawling confrontation with regional and international as well as territorial impact. As a nonpartisan definitive work, it eclipses previous studies of this remarkably bloody turning point in western, military, and Mormon history.

Book excerpt: This provocative book shows how the justices of the United States Supreme Court have used constitutional history, portraying the Framers' actions in a light favoring their own views about how church and state should be separated. Drakeman examines church-state constitutional controversies from the Founding Era to the present, arguing that the Framers originally intended the establishment clause only as a prohibition against a single national church.
