Moving beyond conventional explanations on the failure of secularism and the secular state, it argues that the impasse in the legal regulation of religion lies in the methodologies and frameworks used by British colonial administrators in identifying and governing religion. Drawing on insights from post-colonial theory and religious studies, it demonstrates the role of secular legal reasoning in the background of Western intellectual history and Christian theology through an illustration of the place of worship. It is a contribution to South Asian legal history and sociolegal studies analysing court archives, colonial narratives and legislative documents.

Book excerpt: Freedom of religion or belief implies that people have the right to embrace a full range of thoughts and beliefs, including those that others might deem blasphemous; freedom of expression implies that they have the right to speak or write about them publicly. These rights are guaranteed in international documents to which most countries have agreed. Chapter 1 examines and compares the content of laws prohibiting blasphemy ("blasphemy laws") worldwide through the lens of international and human rights law principles. The right to practice your religion freely is one of the cornerstone freedoms we have in the United States. Freedom of religion is in the very first amendment of the Bill of Rights in the Constitution. Other countries take a narrower view of freedom of religion. Some impose an official religion, while others actively persecute those practicing a disfavoured religion. Chapter 2 reports on the levels of religious freedom in different countries. The International Religious Freedom Act of 1998, requires the president to issue annually an International Religious Freedom Report and designate the worst violators as Countries of Particular Concern CPC a country so designated when its government has engaged in or tolerated particularly severe violations of religious freedom. Chapter 3 discusses the efforts of the United States to combat religious freedom violations in Eurasia. The gravity of the situation facing religious freedom in Central Asia is of particular concern. Despite the professed desire to enact more permissive regulations on religious life, the arguments opposing far-reaching reforms are cast in terms of national security and regime stability. The terms of this argument are familiar in Central Asia, not to mention in other parts of the Muslim world, where Islam simultaneously occupied a revered position in national, social, and private life, while also preoccupying national security agencies and regime loyalists who fear its potential to catalyse political opposition and terrorism as reported in chapter 4.

Such was the case in 1945 when Americans occupied Japan following World War II. Though the Japanese constitution had guaranteed freedom of religion since 1889, the United States declared that protection faulty, and when the occupation ended in 1952, they claimed to have successfully replaced it with “real” religious freedom. Through a fresh analysis of pre-war Japanese law, Jolyon Baraka Thomas demonstrates that the occupiers’ triumphant narrative obscured salient Japanese political debates about religious freedom. Indeed, Thomas reveals that American occupiers also vehemently disagreed about the topic. By reconstructing these vibrant debates, Faking Liberties unsettles any notion of American authorship and imposition of religious freedom. Instead, Thomas shows that, during the Occupation, a dialogue about freedom of religion ensued that constructed a new global set of political norms that continue to form policies today.

The book argues that the democratic law reform process has been influenced by radical Islamists because of the politicization of religion under democracy and the persistence of fears of Christianization. This book examines the management of religion in Indonesia. It discusses how Christianity has developed in Indonesia, how the state, though Muslim in outlook and culture, is nevertheless formally secular, and how the principal Christian church, the Java Christian Church, has adapted its practices to fit local circumstances. It examines religious violence and charts the evolution of the state’s religious policies, analysing in particular the impact of the 1974 Marriage Law showing how it enabled extensive state regulation, but how in practice, rather than reinforcing religious divisions, inter-religious marriage, involving the conversion of one party, is widespread. Overall, the book shows how Indonesia is developing its own brand of secularism, neither a full-blooded Islamic state like Saudi Arabia, nor an outright secular state like Turkey.

It considers the new religious groups as a part of religious reconfiguration in Vietnam caused by intensified interactions among these spheres. It explores changes of relationship between religions, and changes between the religious sphere and the political, economic and public spheres in contemporary Vietnam. Specifically, it traces trajectories of religious development in relation to politico-economic changes in this rapidly modernising nation. It tests a hypothesis that at least some new yet unrecognized new religious groups have a positive/ active role in modernisation rather than a negative/reactive role. To this end, the book draws on a number of research approaches and methodologies in an effort to provide readers with a multi-faceted understanding of Vietnam’s new religious groups. The research is interdisciplinary in orientation, drawing on sociology and anthropology. It is also comparative in that it bases its argument on a consideration of three distinct new religious groups in Vietnam. The research is also qualitative and ethnographic in that it drew on some of the techniques associated with participant observation during a sustained period of fieldwork amongst the three religious groups. The concept of religious reconfiguration developed in this book provides a framework for the study of religion in Vietnam which opens the way to further analysis from a comparative perspective. Meanwhile, an emphasis upon religious reinvention which addresses processes of remaking, transforming, legitimating and accommodating can be useful for research into New Religious Movements elsewhere in Asia. A research in the challenges of new religions could act as a catalyst for interdisciplinary studies based on detailed empirical study of religious diversity and of religious freedom by other scholars. It is hoped that this research might help to give a voice to religious minorities that are often the victim of stereotyping, misunderstanding, and punitive treatment. The book is suitable for post-graduate students and social researchers who are interested in religious revival, religious diversification, State-religion relationships, and State's regulation of new religions.
