SC science has been used in a treatment setting in the replacement of patients’ windpipes and in restoring sight to patients who were blind in one eye and in future it is hoped that when the body is injured it will be able to be stimulated to produce those types of SCs necessary to repair the particular damage caused. In the meantime, research into specific treatments for a wide range of serious conditions is being undertaken including Alzheimer’s disease, cancer, and diabetes. The book considers the regulatory governance of stem cell research, setting out a readily understandable account of the science and the challenges it poses for regulators as the research is increasingly being clinically applied. It provides a critical account of those elements of a regulatory system which will be required for any jurisdiction aiming to facilitate innovative and productive SC research while maintaining appropriate ethical and legal controls. The book addresses the specific failings in the current regulatory approach to SC research in the UK and goes on to look at the regulatory approaches in the US. The book systematically analyses the roles and responsibilities of the three key participants who collaborate in this process: regulators, scientists and tissue providers, arguing that a regulatory system which fails to recognise and facilitate the vital role which each of these three groups plays runs the risk of impairing the chances of the hopes for SC research being realised. The book places a particular emphasis on ensuring that those who contribute their bodily tissues to this endeavour are treated fairly, involving a recognition that their tissues are their property.

The government regulation analyzed in this case is limited to rate-of-return regulation. Using theoretical models such as the Averch-Johnson model and a two-stage Nash equilibrium model, this volume examines whether regulated monopolies engage in more or less technological innovation than unregulated monopolies. Furthermore, if the unregulated (or less regulated) monopolies do engage in more research and development than regulated ones, it questions whether social welfare would be greater with the former. Using a case study of ten privately-owned electric utilities in the State of Texas, USA, it then tests out the general propositions brought forward by the theoretical modelling and finally makes its conclusions taking into consideration both theoretical and empirical findings.

This contribution delineates the issues that arise at the intersection of innovation that takes place in the markets and regulatory intervention in such markets prompted by the dual objective of removing existing inefficiencies in the functioning of the markets, and of facilitating further innovation. The specific foci of the thesis are the concerns arising from the demand-side of the market, notably consumer choice and decision-making. This emphasis on the demand-side is prompted by the changing role of consumers within the process of innovation in the realm of digital and data-driven economy, the regulatory implications of which are currently underexplored in the legal scholarship. The premises for the problematics addressed in this thesis are twofold: the first concerns the presumption of markets' efficiency in delivering welfare-enhancing innovation as the outcome of the supply-side market mechanism, notably market competition; the second stems from the role of regulation as a value-free tool for facilitating innovation by removing supply-side obstacles. Although policy papers, impact assessments and legislative proposals dazzle with references to 'more and better choice' for consumers by means of more innovation, no substantive and systematic analysis of the impact of innovation on consumer welfare is undertaken. Welfare-enhancing effects are largely assumed, following 'the more, the better' approach as a paragon for market efficiency. However, such approach to regulating innovation is only seemingly value-free and instead diverts the innovation and market shaping function from regulation to market forces. This thesis argues that the current approach is suboptimal in the context of digital innovation and attempts to make the first steps towards a more demand-conscious approach to regulation.
