Como novedades, se analiza la incorporación de principios del procedimiento disciplinario: Principio de legalidad y tipicidad de las faltas y sanciones, Principio de irretroactividad de las disposiciones sancionadoras no favorables y de retroactividad de las favorables al presunto infractor, Principio de proporcionalidad, Principio de culpabilidad, Principio de presunción de inocencia. Además de los ya recogidos en la jurisprudencia También las nuevas faltas muy graves del art. 95.2o EBEP, más numerosas que las tipificadas en el art. 31 LMRFP de 1984 , operándose un incremento en la punibilidad de faltas que con anterioridad estaban calificadas como graves, solamente . Las sanciones se mantienen sin grandes modificaciones aunque se añaden otras distintas: el demérito y el traslado forzoso sin cambio de localidad de residencia. La prescripción de las faltas y sanciones son igualmente modificadas. Pero destaco la introducción de la denominada « Falta continuada», de controvertida operatividad en el ámbito penal, de donde es extraída, y que ahora es incorporada a la función pública. Junto a ello la eficacia de los « hechos probados» de sentencias firmes que vinculan a la Administración Pública, aunque con inconvenientes procesales que son analizados. Se incide especialmente en la ejecución de las sanciones, materia que aún su importancia, no es regulada adecuadamente con significativas lagunas. Se ha tratado de ofrecer un cuerpo de jurisprudencia (TS, TC y TEDH) y doctrina consolidado para su empleo, bien por la Administración, bien por abogados, juristas y organizaciones sindicales, ante órganos jurisdiccionales o ante las Administraciones en ejercicio de su potestad punitiva.
