Book excerpt: In early 2008, the National Energy Board (Board or NEB) identified a proposed approach for the Land Matters Consultative Initiative (LMCI), consisting of four distinct topic streams. One of the streams, Stream 3, was Pipeline Abandonment--Financial Issues. The Board indicated that the key issue to be considered in respect of that stream was: "What is the optimal way to ensure that funds are available when abandonment costs are incurred?" The Board noted two key principles fundamental to its future decisions with respect to the financial matters related to pipeline abandonment. These were: a) Abandonment costs are a legitimate cost of providing service and are recoverable upon Board approval from users of the system; and b) Landowners will not be liable for costs of pipeline abandonment. These Reasons for Decision provide an overview of the matters considered by the Board in reaching a decision in respect of the abandonment cost estimates applications.--Document.

Book Synopsis Aboriginal Consultation, Environmental Assessment, and Regulatory Review in Canada by : Kirk N. Lambrecht
Download or read book Aboriginal Consultation, Environmental Assessment, and Regulatory Review in Canada written by Kirk N. Lambrecht and published by University of Regina Press. This book was released on 2013 with total page 209 pages. Available in PDF, EPUB and Kindle. Book excerpt: Supreme Court of Canada decisions have defined a general framework for the "duty to consult" Aboriginal peoples and accommodate their concerns over natural resource development, but anticipate the details of that framework will be expanded upon in the future. Aboriginal Consultation, Environmental Assessment, and Regulatory Review in Canada offers a paradigm that advances that discussion. It proposes an integrated and robust planning model for natural resource extraction allowing Aboriginal peoples, industry, governments, tribunals, and the Courts to all make contributions to reconciliation in the context of sustainable development and environmental protection. Kirk Lambrecht surveys the law of actual and asserted Aboriginal rights and historical and modern Treaty rights in Canada and discusses the national and international purposes of environmental assessment and regulatory review. He appraises the fundamental principles of Supreme Court of Canada jurisprudence defining aboriginal consultation and accommodation as a constitutional imperative and uses case studies involving the National Energy Board to demonstrate how integrated process has evolved over time. Finally he offers general conclusions on the practical utility, and outstanding challenges, involving an integrated planning paradigm.
Book Synopsis Canada as a selective power. Canada’s Role and International Position after 1989 by : Marcin Gabryś
Download or read book Canada as a selective power. Canada’s Role and International Position after 1989 written by Marcin Gabryś and published by Księgarnia Akademicka. This book was released on 2017-12-31 with total page 338 pages. Available in PDF, EPUB and Kindle. Book excerpt: The academic study of Canada has traditionally been the realm of Canadian scholars. For this reason it is easy for outsiders to view Canada as a semi-Nordic continental utopia existing peacefully under a benign government that seeks only peace and harmony in the world. The reality is a more complicated story. That is the strength of this outstanding new book written by two young Polish scholars specializing in Canadian affairs. They have put together an impressively researched monograph that combines a detailed analysis outlining a rather basic premise: The world has changed dramatically since 1989 - and Canada has changed with it. In this well argued narrative they argue that in recent years Canada's foreign policy has becomeone primarily based on interests rather than the promotion of "untainted altruism" or stereotypical "Canadian values." They argue that since 1989 Canadian foreign policy has moved from the more modest aims of a "middle-power" to a more self-assertive role of a "selective power" pursuing more narrowly chosen priorities - and often based on "simple profit and loss calculations" that have clashed with Canada's traditional favorable image in the world - even if few outside of Canada seemed to notice.
Book Synopsis From Recognition to Reconciliation by : Patrick Macklem
Download or read book From Recognition to Reconciliation written by Patrick Macklem and published by University of Toronto Press. This book was released on 2016-04-06 with total page 535 pages. Available in PDF, EPUB and Kindle. Book excerpt: More than thirty years ago, section 35 of the Constitution Act recognized and affirmed “the existing aboriginal and treaty rights of the aboriginal peoples of Canada.” Hailed at the time as a watershed moment in the legal and political relationship between Indigenous peoples and settler societies in Canada, the constitutional entrenchment of Aboriginal and treaty rights has proven to be only the beginning of the long and complicated process of giving meaning to that constitutional recognition. In From Recognition to Reconciliation, twenty leading scholars reflect on the continuing transformation of the constitutional relationship between Indigenous peoples and the Canadian state. The book features essays on themes such as the role of sovereignty in constitutional jurisprudence, the diversity of methodologies at play in these legal and political questions, and connections between the Canadian constitutional experience and developments elsewhere in the world.

Book Synopsis Sharing the Costs and Benefits of Energy and Resource Activity by : Lila Barrera-Hernández
Download or read book Sharing the Costs and Benefits of Energy and Resource Activity written by Lila Barrera-Hernández and published by Oxford University Press. This book was released on 2016-03-31 with total page 479 pages. Available in PDF, EPUB and Kindle. Book excerpt: A new phase is emerging in the relationship between energy and resource activities and the communities that are affected by them. Any energy or resource project - a mine, a wind farm, a dam for hydroelectricity, or a shale gas development - will involve a mix of impacts and benefits for communities. For many years, the law has mediated impacts on communities and provided for the distribution of financial benefits. Now, there is growing awareness of the need to consider not only a wider range of costs and benefits for communities from energy and resource projects, but also the effects on communities at multiple scales and in complex ways. Sharing the costs and benefits of natural resource activity has now become a legal requirement for energy and resource projects operating in many jurisdictions, particularly in developing countries. This book uses cases studies from across the globe to examine the emergence of such legal measures, their advantages and disadvantages, and the improvements that may be feasible in the legal frameworks used to distribute the costs and benefits of energy and resources activity. The book has three parts: Part I considers general legal and conceptual frameworks; Part II addresses the mechanisms available to distribute costs and benefits; and Part III considers the role of public engagement and participation in the sharing of the costs and benefits from energy and resource projects.

Book Synopsis The Duty to Consult by : Dwight G. Newman
Download or read book The Duty to Consult written by Dwight G. Newman and published by UBC Press. This book was released on 2009-10-25 with total page 129 pages. Available in PDF, EPUB and Kindle. Book excerpt: Canada’s Supreme Court has established a new legal framework requiring governments to consult with Aboriginal peoples when contemplating actions that may affect their rights. Professor Newman examines Supreme Court and lower court decisions, legislation at various levels, policies developed by governments and Aboriginal communities, and consultative round tables that have been held to deal with important questions regarding this duty. He succinctly examines issues such as: when is consultation required; who is to be consulted; what is the nature of a “good” consultation; to what extent does the duty apply in treaty areas; and what duty is owed to Métis and non-status Indians? Newman also examines the philosophical underpinnings of the duty to consult, and the evolving framework in international law and similar developments in Australia.
