Book excerpt: This study is focused on the need to rationalize the existing Mining Act or Republic Act No. 7942 in order to address issues and problems encountered in the implementation process. Mining in the Philippines is a major source of revenues and investments and is encouraged not only as a source of employment but more importantly as resource that needs to be afforded with security for the present generation and, most importantly, for the coming generations. Particularly, while the Philippine business investments programs are at heightened level, the mining industry has to balance the exploration of mining resources with the necessities relating to the environment and the growing challenges of the global resource security. Some problems such as poor acceptability, unclear and unwarranted advocacy and promotion gaps, diverse legal commitments, and inadequate engagements of local governments, among others, contributed to a poor mining implementation management resulting in some local social and economic conflicts that overall result in poor utilization and mobilization of mining resources. The global phenomenon on resource nationalism has affected the Philippines and it made the government much aware of the consequences that might be brought about, thus, the need to strengthen governance of the mining industry and rationalize it in the light of resource security and environmental stability. It is considered view that this research will contribute to the improvement of the policy and legal enabling environment of the mining sector and support the demand and supply configuration in the market with a favorable framework for growth and development in general.

The contributors to this book set out to study the extent to which citizens can and do exert influence over their urban environments through the legal (and extra-legal) 'gateways' in eleven countries spanning several continents as well as different climates, levels and type of economic development, and national legal and constitutional systems, as well as exhibiting a different set of environmental problems. One interviewee questioned about access to environmental justice, dryly remarked that in his city there was no environment, no justice and no access to either. Yet this view, as will be seen, requires to be nuanced. While few people will be surprised by the finding that legal gateways to environmental justice are largely ineffective, the reasons for this are revealing; but also the richness of detail and the comparisons between the different countries, and also the positive aspects which surfaced in several instances, were indeed both encouraging and sometimes surprising. This book presents the first comparative survey of access to environmental justice, and will be of considerable use to lawyers, policy-makers, activists and scholars who are concerned with the environmental issues which so profoundly affect and afflict our habitat and conditions of social justice throughout the world.

The LGAF offers a comprehensive diagnostic tool that covers five main areas for policy intervention: Legal and institutional framework; Land use planning, management and taxation; Management of public land; Public provision of land information; and Dispute resolution and conflict management. The LGAF assesses these areas through a set of detailed indicators that are rated on a scale of pre-coded statements (from lack of good governance to good practice). While land governance can be highly technical in nature and tends to be addressed in a partial and sporadic manner, the LGAF posits a tool for a comprehensive assessment, taking into account the broad range of issues that land governance encompasses, while enabling those unfamiliar with land to grasp its full complexity. The LGAF will make it possible for policymakers to make sense of the technical levels of the land sector, benchmark governance, identify areas that require further attention and monitor progress. It is intended to assist countries in prioritizing reforms in the land sector by providing a holistic diagnostic review that can inform policy dialogue in a clear and targeted manner. In addition to presenting the LGAF tool, this book includes detailed case studies on its implementation in five selected countries: Peru, the Kyrgyz Republic, Ethiopia, Indonesia and Tanzania.
