Book excerpt: Many countries around the world are engaged in decentralization processes, and most African countries face serious problems with forest governance, from benefits sharing to illegality and sustainable forest management. This book summarizes experiences to date on the extent and nature of decentralization and its outcomes, most of which suggest an underperformance of governance reforms, and explores the viability of different governance instruments in the context of weak governance and expanding commercial pressures over forests. Findings are grouped into two thematic areas: decentralization, livelihoods and sustainable forest management; and international trade, finance and forest sector governance reforms. The authors examine diverse forces shaping the forest sector, including the theory and practice of decentralization, usurpation of authority, corruption and illegality, inequitable patterns of benefits capture and expansion of international trade in timber and carbon credits, and discuss related outcomes on livelihoods, forest condition and equity. Book excerpt: In this original study of intellectual property rights (IPR) in relation to state capacity, Dimitrov analyzes this puzzle by offering the first systematic analysis of all IPR enforcement avenues in China, across all IPR subtypes. He shows that the extremely high volume of enforcement provided for copyrights and trademarks is unfortunately of a low quality, and as such serves only to perpetuate IPR violations. In the area of patents, however, he finds a low volume of high-quality enforcement. In light of these findings, the book develops a theory of state capacity that conceptualizes the Chinese state as simultaneously weak and strong. The book draws on extensive fieldwork in China and five other countries, as well as on 10 unique IPR enforcement datasets that exploit previously unexplored sources, including case files of private investigation firms.

Book excerpt: Social housing appears to offer a solution for the housing of poor and disadvantaged people. The French "right to housing" offers poor and disadvantaged citizens priority in social housing allocation, and even a legal action against the State to obtain a social home. Despite this, France is suffering a long-lasting housing crisis with disadvantaged people having particular difficulties of access, often despite the efforts of local housing actors. This situation is affected by the European Court of Human Rights and EU decisions limiting diverse national housing and rental policies. Between historic French revolutions and the modern riots, negotiated solutions to social dilemmas emerged. Despite progress in constitutional principles, complex local negotiations still ultimately determine who is housed. Local social landlords, mayors and employee and tenant representatives use their privileges to house their insiders: existing tenants, locals and employees, with rent insufficiently subsidized. ‘Insider Outsider’ theory is used for an economic analysis of exclusion in social housing allocation: its processes, institutional context, and stigmatizing effects. This highlights the spatial effects of nimbyism, excluding disadvantaged outsiders, and concentrating them in deprived areas. Simultaneously, urban regeneration reduced affordable housing stock and ‘social mix’ became a reason to refuse a social home. History, comparative law, economic theory and local interviews with housing actors give a detailed picture of what happens in and around French social housing allocation for an interdisciplinary housing policy audience. Constitutional principles appear in an unfamiliar guise as negotiating positions, with the "right to property" supporting landlords and the "right to housing" supporting tenants. French debates about the function of social landlords are echoed across Europe and reflected in European policies concerning rights, and the exclusion of disadvantaged minorities.

The second section reveals the continued cooperation between the two entities in the management of the urbanization of Val d’Europe from the opening of the first Park and the start of a new major tourism development, in spite of criticisms and fluctuating attendance in the parks. The third part highlights more recent actions of the partners to create a formidable urban tourism pole that will attract ever more visitors, while still critically examining their effectiveness and sustainability.

Book excerpt: This book provides a detailed analysis of the political arguments about the place of Muslims in contemporary France, and also discusses the ideas put forward by a range of Muslim thinkers. France has become the setting for one of the most important conflicts in the modern world. On the one hand, it possesses a rigidly organized, centralized state, whose bureaucrats and civil servants are animated by a code of secular activism. On the other hand, France is also the home for Europe's largest Muslim minority, variously estimated at numbering between four and six million people. This means that in terms of simple numbers, France can be counted as the world's fifteenth Islamic power. Previous conflicts with religion have left a deep impression on French political culture: from the sixteenth and seventeenth-century conflicts between Catholics and Protestants played to the formation of the collaborationist Vichy government in 1940. In recent decades, Muslims have been stigmatized as an irreconcilable minority unable to adapt to the secular culture of the majority of French citizens. This work draws out the political implications of the current conflict. It is based on events and publications produced in a single five year period, beginning with the shock of the 2002 Presidential elections, in which Le Pen was the second most successful candidate, ranging through the legislation of March 2004 which banned the Islamic headscarf from French state schools, and which sparked off a series of bad-tempered exchanges between left and right-wing French nationalists, anti-racism campaigners, secularists, anti-clericals and a variety of Muslim authors.

At the outset, I only knew that I wanted to work on interest groups and litigation in the context of the European Union. At that time, I would not have believed that I would find myself some time later touring half Western Europe to interview environmental organisations, nor that I would read French, German and Dutch court rulings on the protection of endangered species whose names were completely unknown to me. Yet I never regretted my choice of topic, and hopefully the following chapters will convince the reader that it is indeed a topic that merits our attention. I would not have been able to cope with all the pitfalls of a long research project without the strong and enduring support of my friends and colleagues. Both personally and academically, I have profited enormously from my three years as a doctoral student at the department of political science at the Institute for Advanced Studies (Institut für Höhere Studien) in Vienna, Austria.
