Available in PDF, EPUB and Kindle. Book excerpt: 'Lawfare' describes the systematic use and abuse of legal procedure for political ends. This provocative book examines this insufficiently understood form of warfare in post-genocide Rwanda, where it contributed to the making of dictatorship. Jens Meierhenrich provides a redescription of Rwanda's daring experiment in transitional justice known as inkiko gacaca. By dissecting the temporally and structurally embedded mechanisms and processes by which change agents in post-genocide Rwanda manoeuvred to create modified legal arrangements of things past, Meierhenrich reveals an unexpected jurisprudence of violence. Combining nomothetic and ideographic reasoning, he shows that the deformation of the gacaca courts – and thus the rise of lawfare in post-genocide Rwanda – was not preordained but the outcome of a violently structured contingency. The Violence of Law tells a disturbing tale and will appeal to scholars, advanced students, and practitioners of international and comparative law, African studies and human rights.

Book excerpt: Mexico's "democratic transition" has created a competitive electoral system and a formally plural state. Besides, a peculiar wave of insurgency, started in 1994, has challenged the alleged moderating effect of democratic transition. This book argues that socioeconomic inequality is the main factor behind this combination of democratic and undemocratic trends.

Available in PDF, EPUB and Kindle. Book excerpt: All countries have distinctive urban regions, but Canadian cities especially differ from one another in culture, structure, and history. Anthony Perl, Matt Hern, and Jeffrey Kenworthy reveal that despite the peculiarities and singular traits that each city embodies, a common logic has guided the development of transportation infrastructure across the country. Big Moves analyzes how Canada's three largest urban regions - Montreal, Toronto, and Vancouver - have been shaped by the interplay of globalized imperatives, aspirations, activism, investment, and local development initiatives, both historically and in a contemporary context. Canadian urban development follows a distinct pattern that involves compromise between local viewpoints and values and the pursuit of global capital at particular historical junctures. As the authors show, the success or failure of each city to construct major mobility infrastructure has always depended on the timing of investments and the specific ways that cities have gained access to necessary capital. Drawing on urban mobility history and global city theory, this book delves into the details of the big moves that have affected transport infrastructure in major Canadian cities. Knowing where urban development will head in the twenty-first century requires understanding how cities' major mobility infrastructures were built. Big Moves explains the shape of Canada's three biggest cities and how their mix of expressways and rapid transit emerged.

This book was released on 2004-10-21 with total page 401 pages. Available in PDF, EPUB and Kindle. Book excerpt: Judicial Deliberations compares how and why the European Court of Justice, the French Cour de cassation and the US Supreme Court offer different approaches for generating judicial accountability and control, judicial debate and deliberation, and ultimately judicial legitimacy. Examining the judicial argumentation of the United States Supreme Court and of the French Cour de cassation, the book first reorders the traditional comparative understanding of the difference between French civil law and American common law judicial decision-making. It then uses this analysis to offer the first detailed comparative examination of the interpretive practice of the European Court of Justice. Lasser demonstrates that the French judicial system rests on a particularly unified institutional and ideological framework founded on explicitly republican notions of meritocracy and managerial expertise. Law-making per se may be limited to the legislature; but significant judicial normative administration is entrusted to State selected, trained, and sanctioned elites who are policed internally through hierarchical institutional structures. The American judicial system, by contrast, deploys a more participatory and democratic approach that reflects a more populist vision. Shunning the unifying, controlling, and hierarchical French structures, the American judicial system instead generates its legitimacy primarily by argumentative means. American judges engage in extensive debates that subject them to public scrutiny and control. The ECJ hovers delicately between the institutional/argumentative and republican/democratic extremes. On the one hand, the ECJ reproduces the hierarchical French discursive structure on which it was originally patterned. On the other, it transposes this structure into a transnational context of fractured political and legal assumptions. This drives the ECJ towards generating legitimacy by adopting a somewhat more transparent argumentative approach.

Book excerpt: The end of the Cold War forced Western donors to rethink their aid relations with Africa. This book looks at two of these donors, France and Britain, and asks whether the development programmes of these former colonial powers have undergone radical changes since the end of the Old World Order. It focuses on the introduction of a controversial new ’regime’ trend - political conditionality - and uses policy models to illustrate the driving forces behind this new development strategy and explain substantial differences in France and Britain’s practice of political conditionality in Togo and Kenya. Overall, this volume - the first comparative study of French and British aid in the post-Cold War period - offers fresh insights into the evolution of the political assistance agenda and into deeper forces at work within the French and UK policy processes.

This book was released on 2013-03-19 with total page 405 pages. Available in PDF, EPUB and Kindle. Book excerpt: In many countries, particularly in continental Europe, societies have been plagued by high unemployment for several decades. Simultaneously, due to recent shifts from industrial to service-oriented post-industrial societies, labor as a significant culture code is increasingly loosing importance. Because of this, the third or voluntary sector as a place of employment and as a service agency to society has become important for Europe as indicated by the 1997 Communication of the European Commission and various declarations by the European Parliament and the EU's Economic and Social Council. Strategy Mix for Nonprofit Organizations: Vehicles for Social and Labor Market Integration explores the role of the third sector in Europe, where unemployment is high and in North America, where unemployment is rising and exploring the "gaps" that the third sector is fulfilling: both as a social service and as an employer. The volume is organized into two distinctive parts. Part 1: The Nonprofit-Sector and Social Integration highlights the embeddedness of the sector in selected countries; it discusses how the sector is currently affected by changes of public policy particularly in the traditional social-democratic welfare state regimes, and it draws our attention to the sector's potentials to provide avenues for social integration, self-actualization and civic empowerment. Part 2: Labor Concepts and Market Integration refers to the multifunctionality of third sector organizations discussing potentials of workplace as well as community involvement via nonprofit organizations. This seminal volume will be of interest to those in the nonprofit sector, organizational management and economics, political scientists and other researchers working with nonprofit organizations and civil society studies on an international level.
