It draws connections between contemporary legal knowledge practices and colonial systems of thought, arguing that many people of colour experience the law as a part of a racial problem, rather than a solution, to racial injustice. Based on a critical legal ethnography of anti-racism work in Europe, and with an emphasis on the German context, the book positions Black and anti-racist perspectives at the centre, rather than the margins, of critically thinking through the intersection of race and law. Combining this ethnography with comparative legal analysis, discourse analysis and critical race theory, the book develops a critical discussion of the European legal frameworks aimed at regulating racism, and particularly institutional racism, in policy and policing. In linking this critique to the transformative potential of social movements, however, it goes on to examine the strategic and creative possibility of disrupting conventional modes of engaging, and resisting, law.

Western European societies are generally reluctant to think of far-right and racist violence as terrorism, but the reasons for this remain little understood. This book focuses on the extraordinarily complex case of the National Socialist Underground (NSU) in Germany, and high-profile instances of racist violence in Sweden and Norway. The author analyses the narratives surrounding far-right and racist violence, drawing on a broad range of empirical sources. Her account attributes the limits of imagining violence as far-right terrorism to elite practices of narrative control that maintain positive images of the liberal-democratic order in counterpoint to its two constitutive "others" – the far-right and racialised minorities. Situated broadly within the scholarly tradition of critical terrorism studies, the book breaks new ground in research on far-right terrorism by following its narrative traces across time, public spaces of contestation, and national borders. It also draws on material and findings originally written in German, Swedish, and Norwegian, which were previously not available in English. The book argues that racism is alive and dangerously well in Europe, and examines this racism through the lens of postcolonial criticism. Postcolonial racism can be a racism of reaction, based on the perceived threat to traditional social and cultural identities; or a racism of (false) respect, based on mainstream liberals’ desire to hold at arm’s length ‘different’ cultures they are anxious not to offend. Most of all, postcolonial racism, at least within the contemporary European context, is a racism of surveillance, whereby ‘foreigners’ become ‘aliens’, ‘protection’ disguises ‘preference’, and ‘cultural difference’ slides into ‘racial stigmatization’ ––all in the interests of representing the European people, which is a very different entity to the European population as a whole.
