Available in PDF, EPUB and Kindle. Book excerpt: Rather than considering the relationship between the three branches of government in the abstract, Beatty focuses on legal practice as it functions in labour law, and shows how the Charter could be used both to reform labour law and to protect against attempts to reverse gains made in labour legislation in the past. Beatty's critical analysis rests on two principles: that the Charter provides equal liberty for all workers to participate in determining the conditions that govern their working life, and that fundamental rights should be limited only by laws employing the least repressibe alternative. These principles are applied to the constitutional validity of rules that prohibit discrimination: those requiring payment of minimum wages, excluding groups from collective bargaining laws, mandating retirment at a specific age, and requiring membership in trade unions. Beatty argues that the current model of collective bargaining cannot be constitutionally sustained and that voluntary and/or plural representation of employee interests is more compatible with the Charter. The final part of the book makes clear just how dramatic achievements in social justice can be. Beatty shows that the process of judicial review can be instrumental in extending meaningful institutions of industrial democracy through all sectors of our economy and argues that interest group advocacy can be an effective means by which the least advantaged in our community can have more influence in determining the law which governs their working lives.

Available in PDF, EPUB and Kindle. Book excerpt: The entrenchment of a Charter of Rights and Freedoms in the Canadian constitution raises a host of fundamental issues, both theoretical and practical. As the American experience makes abundantly clear, expanding the focus of judicial review means that the symbiosis between law and politics will become more intimate and interwined than ever before. Putting the Charter to Work David Beatty investigates the extent to which judicial review offers a means to the enhancement of social justice in our community.

Available in PDF, EPUB and Kindle. Book excerpt: The Canadian Charter of Rights and Freedoms may only be thirty-five years old but it is an important document for all Canadians. Few today, however, are aware of the extensive work and tumultuous debates that occurred behind the scenes. In The Charter Debates, Adam Dodek tells the story of the Special Joint Committee of the Senate and the House of Commons on the Constitution, whose members were instrumental in drafting the Charter. Dodek places the work of the Joint Committee against the backdrop of the decades-long process of patriation and takes the reader inside the committee room, giving them access to Cabinet discussions about constitutional reform. The volume offers a textual exploration of the edited proceedings concerning major Charter subjects such as fundamental freedoms, democratic rights, equality rights, language rights, and the limitations clause. Presenting key moments from the transcripts, carefully selected and contextualized, The Charter Debates is a one-of-a-kind resource for scholars, students, and general readers interested in the Charter and its impact on constitutional politics in Canada.

Book excerpt: Forty years after the Bangkok Declaration, which established the Association of Southeast Asian Nations (ASEAN), a new document was drafted as a result of “bold and visionary recommendations” of an ASEAN Committee of Eminent Persons. The ASEAN Charter, which came into force in 2008, provides ASEAN’s legal status and institutional framework. In effect, it is a legally binding agreement among the 10 ASEAN Member States. In many respects, however, the Charter is more important as an aspirational document. Written by one of the persons involved in the negotiations leading to the adoption of the Charter, this meticulously researched publication helps readers navigate the ambiguities of the Charter by detailing an insider’s background, provision by provision, of the debates that went into the making of the ASEAN Charter. It not only explains how the provisions of the Charter came to be drafted, but also how they relate to the realities of diplomatic practice. This volume will be an indispensable reference for scholars, working diplomats, and businesses and institutions that have a stake in ASEAN. "The ASEAN Charter is a commitment for us to become a rules-based community. It is time for us, especially the weaker countries among us, to be ruled by law rather than by political whim, national interest or military power. Walter Woon's work will be a major contribution to that end." - Rodolfo C. Severino, former Secretary-General of ASEAN (1998-2002) "Prof Walter Woon and I represented Singapore in the High-Level Task Force which drafted the ASEAN Charter; he is the ideal author for such a commentary on the Charter. This should be read by everyone interested in ASEAN." - Tommy Koh, Ambassador-at-Large, Ministry of Foreign Affairs, Singapore

Available in PDF, EPUB and Kindle. Book excerpt: For more than forty years Nicholas Brooks has been at the forefront of research into early medieval Britain. In order to honour the achievements of one of the leading figures in Anglo-Saxon studies, this volume brings together essays by an internationally renowned group of scholars on four themes that the honorand has made his own: myths, rulership, church and charters. Myth and rulership are addressed in articles on the early history of Wessex, Æthelflæd of Mercia and the battle of Brunanburh; contributions concerned with charters explore the means for locating those hitherto lost, the use of charters in the study of place-names, their role as instruments of agricultural improvement, and the reasons for the decline in their output immediately after the Norman Conquest. Nicholas Brooks's long-standing interest in the church of Canterbury is reflected in articles on the Kentish minster of Reculver, which became a dependency of the church of Canterbury, on the role of early tenth-century archbishops in developing coronation ritual, and on the presentation of Archbishop Dunstan as a prophet. Other contributions provide case studies of saints' cults with regional and international dimensions, examining a mass for St Birinus and dedications to St Clement, while several contributions take a wider perspective, looking at later interpretations of the Anglo-Saxon past, both in the Anglo-Norman and more modern periods. This stimulating and wide-ranging collection will be welcomed by the many readers who have benefited from Nicholas Brooks's own work, or who have an interest in the Anglo-Saxon past more generally. It is an outstanding contribution to early medieval studies.

Book excerpt: What is a charter school? Where do they come from? Who promotes them, and why? What are they supposed to do? Are they the silver bullet to the ills plaguing the American public education system? This book provides a comprehensive and accessible overview and analysis of charter schools and their many dimensions. It shows that charter schools as a whole lower the quality of education through the privatization and marketization of education. The final chapter provides readers with a way toward rethinking and remaking education in a way that is consistent with modern requirements. Society and its members need a fully funded high quality public education system open to all and controlled by a public authority.
