Book Synopsis Comparative Legal Aid Systems and India by : Jeet Singh Mann
Download or read book Comparative Legal Aid Systems and India written by Jeet Singh Mann and published by Taylor & Francis. This book was released on 2022-10-20 with total page 335 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides an in-depth analysis of the functioning and challenges of the legal aid system in India. The legal aid system was set up to promote the interests of the economically weaker sections of society that did not have equitable access to judicial systems. However, the system has been largely unsuccessful in delivering justice. Drawing on empirical data from 18 states and 36 districts in India, the book highlights the institutional setbacks that plague the legal aid system and urges us to take cognizance of the hindrances faced by the beneficiaries in availing of these services. It acknowledges the gaps that exist in the governance of the legal aid system in India at the grassroots level and suggests approaches and ways to address these roadblocks to deliver free, swift, and economical access to justice to the poor legal aid beneficiaries. An important critical study of the commitment and competence of legal aid counsels in India, this volume will be an essential read for scholars and researchers of law, Indian law, constitutional law, political science, comparative law, law and gender, and social work.

Download or read book People, Law And Justice: Casebook On Public Interest Litigation (Vol. Ii) written by Ahuja and published by Orient Blackswan. This book was released on 1997 with total page 544 pages. Available in PDF, EPUB and Kindle. Book excerpt: This two-volume book documents all the reported and unreported cases of Public Interest Litigation (PIL) from its inception in 1979 to April 1994. The author stresses that the law is not autonomous, but embodies the priorities of those involved in establishing and maintaining a legal system. She shows how PIL provides a means whereby the terms of the legal discourse may be challenged; equally she shows how PIL suffers, paradoxically, by being a part of the very system it seeks to question.

This book was released on 2004-01-01 with total page 554 pages. Available in PDF, EPUB and Kindle. Book excerpt: This research examines the growth and expansion of public interest environmental litigation (PIEL) in India and analyses the changes that are influencing the development of PIEL in Bangladesh and Pakistan. The necessity for this research lies in the rapid degradation of environment and the need of efficient environmental management in the three countries of the South Asian region. Here, we compare the legal systems of the three countries from the environmental point of view, discuss new ideas and directions and critically analyse the legal provisions that would help to apply environmental norms. These offer the legislators a chance to find out what can be applied in their own region, thus developing their existing legal mechanisms. About the author Jona Razzaque is barrister and holds a PhD in law from the University of London. She works in the field of access to environmental justice and has published numerous articles on this issue. She taught law in Queen Mary College and School of Oriental and African Studies under the University of London. She is currently working as a lawyer in the Foundation for International Environmental Law and Development (FIELD) on cross-themed projects related to bio-diversity, trade and climate change.

Book Synopsis Beyond Common Knowledge by : Erik Gilbert Jensen
Download or read book Beyond Common Knowledge written by Erik Gilbert Jensen and published by Stanford University Press. This book was released on 2003 with total page 456 pages. Available in PDF, EPUB and Kindle. Book excerpt: An intensive global search is on for the "rule of law," the holy grail of good governance, which has led to a dramatic increase in judicial reform activities in developing countries. Very little attention, however, has been paid to the widening gap between theory and practice, or to the ongoing disconnect between stated project goals and actual funded activities. Beyond Common Knowledge examines the standard methods of legal and judicial reform. Taking stock of international experience in legal and judicial reform in Latin America, Europe, India, and China, this volume answers key questions in the judicial reform debate: What are the common assumptions about the role of the courts in improving economic growth and democratic politics? Do we expect too much from the formal legal system? Is investing in judicial reform projects a good strategy for getting at the problems of governance that beset many developing countries? If not, what are we missing?

Book Synopsis The Right to Education in India by : Florian Matthey-Prakash
Download or read book The Right to Education in India written by Florian Matthey-Prakash and published by Oxford University Press. This book was released on 2019-08-22 with total page 318 pages. Available in PDF, EPUB and Kindle. Book excerpt: What does it mean for education to be a fundamental right, and how may children benefit from it? Surprisingly, even when the right to education was added to the Indian Constitution as Article 21A, this question barely received any attention. The book identifies justiciability—or, more broadly, enforceability—as the most important feature of Article 21A, meaning that children and their parents must be provided with means to effectively claim their right from the State; otherwise, it would remain a ‘right’ only on paper. The book highlights how lack of access to the Indian judiciary means that the constitutional promise of justiciability remains unfulfilled. It deals with the possible alternative means the State may provide for the poor to claim the benefits under Article 21A, and identifies the grievance-redress mechanism created by the ‘Right of Children to Free and Compulsory Education Act, 2009’ as a potential system of enforcement. Even though this system is found to be deficient, the book concludes with an optimistic outlook, hoping that rights advocates may, in the future, focus on improving such mechanisms for legal empowerment.
