Available in PDF, EPUB and Kindle. Book excerpt: In Transforming California, Stephanie Pincetl argues that the transformation of nature in order to enhance economic development lies at the heart of much of the state's recent history. She sees late-twentieth-century California on a path of continued environmental degradation, gripped by cynicism about government. Transforming California describes the evolution of the state's institutions of government as they apply to land use and development, and it shows how land-use decisions affect people's quality of life and their daily interactions with each other and with their environment. Pincetl offers an alternative vision for the renewal of the democratic spirit and process in California and for a reconciliation with nature.

Available in PDF, EPUB and Kindle. Book excerpt: California Land Use & Planning is published biennially. In the interim years, a comprehensive summary of published judicial decisions concerning land use and planning in California will be available as a free download from www.solano.com. For over three decades, California Land Use & Planning Law has provided a succinct and definitive summary of the major provisions of California's land use and planning laws. It has been cited by the California Supreme Court and numerous appellate courts as an authoritative source. Cecily Talbert Barclay and Matthew S. Gray are both partners in the San Francisco office of Perkins Coie LLP, representing a range of local agencies, real estate developers and landowners in all stages of the land use entitlement and development process. For 27 years, Dan Curtin authored this book as a desk reference for those interested in California land use and planning law. Cecily joined Dan as a co-author in 2000 and worked with him to continually update the book based on their own and their partners' decades of experience representing both public agencies and private developers. Following Dan's passing in November 2006, Matt joined Cecily - first as Managing Editor and later as co-author in preserving and expanding upon the legacy Dan started with this book.

Book excerpt: Much of the preparation of this book has been generously supported by the Lincoln Institute of Land Policy, Cambridge, Massachusetts. It evolved from a colloquium held in October 1977, under the sponsorship of the Lincoln Institute. The three-day symposium entitled "Land Policy: Making the Value Choices" involved the preparation of major papers and formal discussions, most of which appear here in considerably revised form, along with additional pieces commis sioned later. The colloquium was an idea jointly conceived by myself and Edward Wood, a colleague at the time in the Tufts University Program in Urban Social and Environmental Policy. We were concerned about two major limitations in the literature and debates over land use. On the one hand, there was little explicit recognition of the latent values that motivated land use policy. On the other, there was no common forum where people from the different land use fields could discuss the issues and learn from one another. A small group of about two dozen people was invited to the colloquium. Each member was a leading spokesman for a different perspective and area of expertise. All participated formally in some fashion. All the papers were written expressly for the col loquium, with the exception of Ann Strong's, which was a keynote address to the American Society of Planning Officials earlier in the year. None of the papers has been published elsewhere.

Book excerpt: Bargaining for Development is a one-of-a-kind handbook that explores the policy and planning principles behind land development conditions, vested rights, and development/annexation agreements, and provides guidance for the practicing professional, government, and land development communities in evaluating the need for, and the drafting of, land development statutes, ordinances, and agreements. The handbook's basic premises are two-fold. First, land development and annexation agreements offer an excellent vehicle for government and landowners to provide in detail for land developments. Second, because of the law pertaining to vested rights and land development conditions, the development community needs more assurances concerning the continued viability of their projects and the government community requires more in the way of public facilities than the common law grants to either. Vested rights to proceed with a development, including the multi-stage variety, are not easy to come by under the applicable legal principles. Public facilities not closely tied to a land development project through nexus and proportionality are similarly difficult to legally enforce. A development agreement provides for both.
