Book excerpt: Les technologies de l'information et de la communication (TIC) qui recouvrent l'ensemble des outils et techniques résultant de la convergence des télécommunications ont révolutionné les comportements et les habitudes des consommateurs. Si ces technologies ne se limitent pas au réseau internet c'est la montée d'internet qui a renouvelé la problématique de la protection du consommateur. En réponse, le législateur ivoirien a, à travers la loi de 2016 relative à la consommation, essayé de s'arrimer aux standards internationaux relatifs à la protection du consommateur. Le nouveau dispositif adopté s'ajoute au droit positif ivoirien et au cadre législatif communautaire (UEMOA et CEDEAO). Cependant, le système se révèle insuffisant et, à certains égards, inadapté à la protection du consommateur, notamment dans l'hypothèse d'une vente conclue par le canal des TIC. Ces insuffisances s'observent au moment de la formation et de l'exécution du contrat de vente. Dans ce contexte, le cadre législatif français qui étend ses sources dans le droit communautaire européen peut, à bien d'égards, inspirer le législateur ivoirien. Il ne s'agit pas de transposer intégralement ce système en droit ivoirien. En effet, à l'épreuve des TIC, la protection du consommateur passe par la recherche de nouveaux points d'équilibre entre le consommateur et le professionnel.

The book starts with an analysis of the basic assumptions underlying the current consumer protection models and examines whether and how consumer models adapt to the new market conditions. The second part addresses the information obligations themselves, first highlighting the differences in the reported countries before narrowing the analysis down to countries with a general pre-contractual information duty, particularly the transparency requirements that often come with such a duty. The next part examines recent developments in the law on food labelling, commercial practices and unfair contract terms in order to identify whether similar traits can be found in European and non-European jurisdictions. The fourth part of the book focuses on specific information obligations in the financial services and e-commerce sectors, discussing the fact that legislators are experimenting with different forms of summary disclosures in these sectors. Book excerpt: Chile emerged from military rule in the 1990s as a leader of free market economic reform and democratic stability, and other countries now look to it for lessons in policy design, sequencing, and timing. Explanations for economic change in Chile generally focus on strong authoritarianism under General Augusto Pinochet and the insulation of policymakers from the influence of social groups, especially business and landowners. In this book Eduardo Silva argues that such a view underplays the role of entrepreneurs and landowners in Chile's neoliberal transformation and, hence, their potential effect on economic reform elsewhere. He shows how shifting coalitions of businesspeople and landowners with varying power resources influenced policy formulation and affected policy outcomes. He then examines the consequences of coalitional shifts for Chile's transition to democracy, arguing that the absence of a multiclass opposition that included captialists facilitated a political transition based on the authoritarian constitution of 1980 and inhibited its alternative. This situation helped to define the current style of consensual politics that, with respect to the question of social equity, has deepened a neoliberal model of welfare statism, rather than advanced a social democratic one.

Others don't feel the need for any sort of climate regulation. In The Cost-Benefit Revolution, Cass Sunstein argues our major disagreements really involve facts, not values. It follows that government policy should not be based on public opinion, intuitions, or pressure from interest groups, but on numbers—meaning careful consideration of costs and benefits. Will a policy save one life, or one thousand lives? Will it impose costs on consumers, and if so, will the costs be high or negligible? Will it hurt workers and small businesses, and, if so, precisely how much? As the Obama administration's “regulatory czar,” Sunstein knows his subject in both theory and practice. Policies should make people's lives better. Book excerpt: The Production and Distribution of Knowledge in the United States marked the beginning of the study of our postindustrial information society. Austrian-born economist Fritz Machlup had focused his research on the patent system, but he came to realize that patents were simply one part of a much bigger "knowledge economy." He then expanded the scope of his work to evaluate everything from stationery and typewriters to advertising to presidential addresses--anything that involved the activity of telling anyone anything. The Production and Distribution of Knowledge in the United States then revealed the new and startling shape of the U.S. economy. Machlup's cool appraisal of the data showed that the knowledge industry accounted for nearly 29 percent of the U.S. gross national product, and that 43 percent of the civilian labor force consisted of knowledge transmitters or full-time knowledge receivers. Indeed, the proportion of the labor force involved in the knowledge economy increased from 11 to 32 percent between 1900 and 1959--a monumental shift. Beyond documenting this revolution, Machlup founded the wholly new field of information economics. The transformation to a knowledge economy has resonated throughout the rest of the century, especially with the rise of the Internet. As two recent observers noted, "Information goods--from movies and music to software code and stock quotes--have supplanted industrial goods as the key drivers of world markets." Continued study of this change and its effects is testament to Fritz Machlup's pioneering work.
