American firms compete and grow by supplying products and services that consumers demand, and by internationalising their businesses through licensing, franchising, or exporting. For many small companies, patent protection prevents competitors from simply copying their innovations, and aids in attracting investor capital needed to grow, build market share, and create jobs. The aim of this book is to show how the U.S. Patent and Trademark Office, in coordination with other Federal departments and agencies, can best support businesses with international patent protection. Moreover, upon its signing in 2011, the Leahy-Smith America Invents Act (AIA) substantially overhauled U.S. patent law. Included in AIA was the expansion of the prior user rights defense to infringement and broadening the classes of patents that are eligible for the new limited prior user rights defense. (Here, prior user rights, is a defense to patent infringement afforded to a party that was commercially using, or engaged in substantial preparations for commercial use of, an invention later patented by another party). In the debate about the impact of an expanded prior user rights defense on the patent system and innovation more generally, the U.S. Patent and Trademark Office produced a report detailing its findings and recommendations on the operation of prior user rights in the industrialised world, which is discussed further in this book.

Book excerpt: Recently there has been an explosion of patent litigation in the high-tech sector as companies buy up patent portfolios and use them to force settlement agreements from competitors. This has led to an environment in which “patent trolling” is prevalent, and smaller players are pushed out of the market because they lack the patent portfolios to compete. Patent trolls are companies that do not create products, but instead acquire portfolios of basic patents that they use to sue possible infringers for fast profits. Larger tech companies such as Google, Apple, and Microsoft have recently begun to use their vast patent portfolios in this way, especially in the mobile sector where competition is most fierce. This note will analyze the current state of the patent system with regard to the big tech lawsuits including how broad “process” patents on software have helped create new problems, and will compare relevant aspects of the U.S. system to standards in other countries to assess ways to improve our system. The note will also evaluate current legislative efforts to reform the system and make recommendations regarding what the most effective changes would be. The purpose of the patent system is to encourage innovation and to reward inventors by protecting the fruits of their labor. Abuse of this sanctioned monopoly is helping to consolidate the tech marketplace to the few large companies that are winning the patent “arms race.” This note will propose reforms that will encourage true competition while retaining incentives to encourage innovation in the tech sector.

Though this pattern of job creation has largely held true for over thirty years, the capacity of American small businesses to create jobs is at risk. American firms compete and grow by supplying products and services that consumers demand, and by internationalizing their businesses through licensing, franchising, or exporting. For many small companies, patent protection prevents competitors from simply copying their innovations, and aids in attracting investor capital needed to grow, build market share, and create jobs. Yet small companies face significant financial challenges in acquiring, maintaining, and enforcing patents outside the United States. Therefore, supporting small firms and fostering job creation requires a thorough understanding of these challenges and an exploration of possible remedies. The Leahy-Smith America Invents Act requires the Director of the United States Patent and Trademark Office, in consultation with the Secretary of Commerce and the Administrator of the Small Business Administration, to study how best to support businesses with international patent protection. The USPTO and SBA are required to determine whether a revolving fund loan program or a grant program would be proper for helping small businesses defray the costs of filing, maintaining, and enforcing international patents. The USPTO and SBA are required to provide other pertinent recommendations. To prepare this report, the USPTO principally relied upon input from the public, seeking comments through a Federal Register notice and holding two public hearings to collect evidence for this study. At each hearing, government panelists from the USPTO and SBA invited and accepted formal testimony, and allowed informal comment and questioning from members of the public. In all, the USPTO received eighteen sets of comments, including responses from a U.S. intellectual property organization, an international industry organization, a foreign government intellectual property office, a U.S. law firm, a U.S. private company, eight U.S. patent practitioners, and five American citizens speaking as individuals. In addition, the USPTO conducted research, relying upon archival sources such as reports, economic studies, and existing data sources where available.
