Download or read book Multijuralism written by Albert Breton and published by Routledge. This book was released on 2017-11-28 with total page 205 pages. Available in PDF, EPUB and Kindle. Book excerpt: At one level of generality, multijuralism is the coexistence of two or more legal systems or sub-systems within a broader normative legal order to which they adhere, such as the existence of civil and common law systems within the EU. However, at a finer level of analysis multijuralism is a more widespread or common phenomenon and a more fluid reality than the civil law/common law distinction suggests. The papers in this study are therefore rooted in the latter frame of reference. They explore various types of multijural manifestations from the harmonizing potential of international treaties to indigenous law and the use of hard and soft pluralism. In addition, the authors consider the external events which are not part of the processes of multijural adjustment but which serve to influence these processes. Included among these important external events are European integration, the growing importance accorded to human rights, the international practice of law, the growth of the Internet, the globalization of markets and the flow of immigrants. This volume represents some of the most current thinking in the area of multijuralism and is essential reading for anyone interested in the coexistence of legal systems or sub-systems.

Available in PDF, EPUB and Kindle. Book excerpt: Each individual experiences obligations arising from personal relationships. These are often hard to fulfil and give rise to tension between the demands of various relationships, between meeting current or future needs, but also between private norms and the demands of a public set of rules. The international contributors to this volume consider the relationship between family law and family values in the way law is framed, the way we are developing the legal context for new kinds of relationships such as cross-household parenting, same-sex partner relationships, and the obligations of adults to elders, and closes with a plea to rethink family law in terms of the functions we want it to perform. Contributors include Masha Antokolskaia, Benoit Bastard, John Eekelaar, Lisa Glennon, Jacek Kurczewski, Jane Lewis, Carol Smart, Velina Todorova and Jean van Houtte.

Book Synopsis Do We Need a Cohabitation Agreement? by : Michael G. Cochrane
Download or read book Do We Need a Cohabitation Agreement? written by Michael G. Cochrane and published by John Wiley and Sons. This book was released on 2010-05-14 with total page 209 pages. Available in PDF, EPUB and Kindle. Book excerpt: You're committed, you're moving in together and you're blending your households. But are you forgetting something? Many Canadians find themselves in common-law relationships and think that they aren't any different from a legal marriage. It can be a shock to find out that, when the going gets tough, certain rights under the law-not to mention financial obligations-do or do not apply. For instance, if one common-law partner becomes seriously ill or passes away, will the other be able to access joint bank accounts? Their shared home? What happens if there is no will? And what about the kids? These are some of the many serious questions that couples need to consider before sharing their lives, all of which can be addressed in a cohabitation agreement. A cohabitation agreement allows a couple to make sure their partner and any children are taken care of in times of need or crisis; that ownership in properties or financial resources are clear, combined, separated or protected. Most of all, these contracts allow for the peace of mind that comes with having a game plan in place should the relationship end due to death or separation. Take the advice of Michael Cochrane, a lawyer with more than 30 years of experience, and consider the numerous issues that can affect a common-law relationship. Do We Need a Cohabitation Agreement? is written in clear, nontechnical language and includes real-life examples based on Canadian cases. Cochrane addresses critical issues such as wills and estates, powers of attorney, the special concerns of step-families and same-sex couples, and how to have this discussion with your partner. It will also help you work in a cost-effective way with a lawyer should you decide that an agreement will benefit your relationship. This is your future together. Get it right from the very beginning.

Book Synopsis Muslim Marriage in Western Courts by : Pascale Fournier
Download or read book Muslim Marriage in Western Courts written by Pascale Fournier and published by Routledge. This book was released on 2016-04-29 with total page 255 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book describes and analyses the notion of Mahr, the Muslim custom whereby the groom has to give a gift to the bride in consideration of the marriage. It explores how Western courts, specifically in Canada, the United States, France, and Germany, have approached and interpreted Mahr. Although the outcomes of the cases provide an illustrative framework for the book, the focus is broader than simply the adjudicative endeavours. The work explores the concept of liberalism, which purportedly champions individuals and individual choice concurrently with freedom and equality. Tensions between and among these concepts, however, inevitably arise. The acknowledgment and exploration of these intertwined tensions forms an important underpinning for the book. Through the analysis of case law from these four countries, this study suggests that transplanting Mahr from Islamic law into a Western courtroom cannot be undone: it immediately becomes rooted in the countries' legal, historical, political, and social backgrounds and flourishes (or fails) in diverse and unexpected ways. Rather than being the concept described by classical Islamic jurists, Mahr is interpreted according to wildly varied legal constructs and concepts such as multiculturalism, fairness, public policy, and gender equality. Moreover, Islamic law travels with a multiplicity of voices, and it is this complex hybridity (a fragmented and disjointed Mahr) which will be mediated through Western law. Returning to the overarching concept of liberalism, the book proposes that distributive consequences rather than recognition occupy central place in the evaluation of the legal options available to Muslim women upon divorce.
