Book excerpt: "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. Grateful acknowledgment is made of the contributions by all who helped in this work, particularly the staffs of the Office of the Law Revision Counsel and the Government Printing Office"--Preface.

Available in PDF, EPUB and Kindle. Book excerpt: Conceptualising Property Law offers a transsystemic and integrated approach to common law and civil law property. Property law has traditionally been excluded from comparative law analysis, common law and civil law property being deemed irreconcilable. With this book, Ya'll Emerich aims to dispel the myth that comparison between these two systems of property is impossible. By establishing a dialogue between common law and civil law property, it becomes clear that the two legal traditions share common ground in the way that they address legal, cultural, and social issues related to property and wealth.

Book excerpt: Knowing all the ins and outs of property law from state to state can be a difficult and time-consuming task. When issues arise related to ownership and tenancy of property, it is important for lawyers, real estate brokers and agents, and landmen to have an efficient and comprehensive way to both understand and clarify the precedents, regulations, and rights associated with state property laws. Lytton's Handbook on Texas Property Law covers a broad expanse of various aspects of Texas property law, and it offers a range of comprehensive perspectives on many topics related to property, ownership, sovereignty, and landlord/tenant rights. Containing thirty chapters with extensive citations to legal authority, it provides law and real estate professionals with a user-friendly and practical guidebook for quickly and efficiently navigating and understanding Texas property law, codes, and legal precedent. When legal disputes arise related to owning and leasing property; maintaining estates; managing residential or commercial tenancies and condominiums; handling deeds, mortgages, and covenants; and controlling rights to waters, soils, and products of the land, this comprehensive handbook can help both professionals and laypersons better understand both the laws and how to approach resolution.

This book was released on 2012-06-21 with total page 133 pages. Available in PDF, EPUB and Kindle. Book excerpt: When property rights and environmental legislation clash, what side should the Rule of Law weigh in on? It is from this point that Jeremy Waldron explores the Rule of Law both from an historical perspective - considering the property theory of John Locke - and from the perspective of modern legal controversies. This critical and direct account of the relation between the Rule of Law and the protection of private property criticizes the view - associated with the 'World Bank model' of investor expectations - that a society which fails to protect property rights against legislative restriction is failing to support the Rule of Law. In this book, developed from the 2011 Hamlyn Lectures, Waldron rejects the idea that the Rule of Law privileges property rights over other forms of law and argues instead that the Rule of Law should endorse and applaud the use of legislation to achieve valid social objectives.
