A autonomia privada desponta como corolário lógico desse instituto. As partes deixam de ser meras coadjuvantes e passam a exercer protagonismo no processo civil. Ao permitir alterações e adaptações no procedimento, mediante acordo entre as partes, o negócio jurídico processual atípico pode contribuir para a prestação de uma tutela jurisdicional efetiva e sob medida. O processo inalterável, com fórmulas pré-definidas, deve ter um tratamento diferenciado sobre os procedimentos e os interesses das partes, máxime tratando-se de direitos que admitem autocomposição. Na condição de destinatárias do provimento jurisdicional, às partes deve ser facultado o direito de participar, tanto na construção da decisão de mérito quanto na construção dos procedimentos que atendam seus interesses processuais legítimos. Isso, no final, acaba desaguando na prestação de uma tutela jurisdicional efetiva.
