Book excerpt: This book presents the first cross-regional analysis of post-transitional justice periods and the conditions that influence states’ behaviors. Specifically, the book examines why states that adopt and ostensibly implement transitional justice norms as policies—criminal prosecutions, reparations policies, and truth commissions—fail to follow through with their recommendations. Applying these perspectives to a comparative study of states from Latin America and East Asia—namely, Peru, Uruguay, and South Korea—which accepted and implemented transitional justice norms but took different trajectories of behavior after the implementation of policies, this book contributes to understanding the relationship of norm influence on states and why states change in compliance after norm adoption. The book explores the conditions that contribute or limit the continued respect for transitional justice norms, emphasizing the political interests and transnational advocacy networks’ roles in affecting states’ policies of addressing past abuses.

Available in PDF, EPUB and Kindle. Book excerpt: In recent decades, corporations have increasingly accepted that they have obligations to respect the socio-economic rights of individuals whose rights to livelihoods, education, food, health, housing and water are affected by the actions of corporations on a daily basis. Despite this, it is often difficult for victims to bring corporations to court for violations of their socio-economic rights. Domestic constitutional systems provide, at best, fragile and limited protections against adverse corporate activities, while international responses have been lacking in creating obligations and accountability for corporations under socio-economic rights. The urgency of bolstering corporate accountability for socio-economic rights is therefore apparent. In light of this, this book asks whether corporations are required to observe socio-economic rights and if they are accountable for any violations. In doing so, it identifies and analyzes the theoretical foundations and the existing scope of corporate accountability arising from socio-economic rights at both national and international levels. Through careful analysis, Jernej Letnar Černič exposes the stark need for greater clarity in the obligations and accountability of corporations, advocating a normative framework for corporate accountability for socio-economic rights in national legal orders which builds on existing mechanisms.

Available in PDF, EPUB and Kindle. Book excerpt: A multi-scale ethnography of government pedagogy in Colombia and its impact on peace. Colombia’s 2016 peace agreement with the FARC guerrillas sought to end fifty years of war and won President Juan Manuel Santos the Nobel Peace Prize. Yet Colombian society rejected it in a polarizing referendum, amid an emotive disinformation campaign. Gwen Burnyeat joined the Office of the High Commissioner for Peace, the government institution responsible for peace negotiations, to observe and participate in an innovative “peace pedagogy” strategy to explain the agreement to Colombian society. Burnyeat’s multi-scale ethnography reveals the challenges government officials experienced communicating with skeptical audiences and translating the peace process for public opinion. She argues that the fatal flaw in the peace process lay in government-society relations, enmeshed in culturally liberal logics and shaped by the politics of international donors. The Face of Peace offers the Colombian case as a mirror to the global crisis of liberalism, shattering the fantasy of rationality that haunts liberal responses to “post-truth” politics.

Available in PDF, EPUB and Kindle. Book excerpt: This edited book offers a collection of highly nuanced accounts of children and childhoods in peace and conflict across political time and space. Organized according to three broad themes (ontologies, pedagogies, and contingencies), each chapter explores the complexities of a particular case study, providing new insights into the ways children’s lives figure as terrains of engagement, contestation, ambivalence, resistance, and reproduction of militarisms. The first three chapters challenge dominant ontologies that prefigure childhood in particular ways. These include who counts as a child worthy of protection, questions of voice and participation, and the diminution of agency. The chapters in the second section bring to view everyday pedagogies whereby myriad knowledges, performances, practices, and competencies may function to militarize children’s lives, including in but not limited to advanced (post)industrial societies of the global North. The third and final section includes investigations that foreground questions of responsibility to children. Here, contributors assess, among other things, resilience-building, the exigencies of protection, and the ethics of military recruitment practices targeting children.

Book excerpt: This War Report provides detailed information on every armed conflict which took place during 2013, offering an unprecedented overview of the nature, range, and impact of these conflicts and the legal issues they created. In Part I, the Report describes its criteria for the identification and classification of armed conflicts under international law, and the legal consequences that flow from this classification. It sets out a list of armed conflicts in 2013, categorising each as international, non-international, or a military occupation, with estimates of civilian and military casualties. In Part II, each of the 28 conflicts identified in Part I are examined in more detail, with an overview of the belligerents, means and methods of warfare, the applicable treaties and rules, and any prosecutions for, investigations into, or robust allegations of war crimes. Part III of the Report provides detailed thematic analysis of key legal developments which arose in the context of these conflicts, allowing for a more in-depth reflection on cross-cutting questions and controversies. The topics under investigation in this Report include US policy on drone strikes, the use of chemical weapons in Syria, the protection of persons with a disability, and national and international war crimes trials. The Report gives a full and accessible overview of armed conflicts in 2013, making it the perfect first port of call for everyone working in the field.

Book excerpt: Striking a balance between peace and justice has long been debated by scholars and practitioners. There has been definite progress in a world in which blanket amnesties were at times granted with little hesitation. There is a growing understanding that accountability has both pragmatic and principled arguments in its favor. Practical arguments as much as shifts in norms have created a situation in which the choice is increasingly seen as "which forms of accountability" rather than a stark one between peace and justice. The Colombian Justice and Peace Law 975 and its implementation offer an interesting and unique approach to dealing with the international crimes committed in Colombia’s decades-long armed conflict. Yet, will this approach suffice with regard to Colombia’s obligations under international law to investigate and prosecute international crimes? Does it meet the standards of the ICC, which has been monitoring the Colombian situation for some time now? In particular, does it pass the complementarity test laid out in the ICC statute or will the ICC have to intervene in Colombia to enforce international criminal law?

Available in PDF, EPUB and Kindle. Book excerpt: This book seeks to refine our understanding of transitional justice and peacebuilding, and long-term security and reintegration challenges after violent conflicts. As recent events following political change during the so-called 'Arab Spring' demonstrate, demands for accountability often follow or attend conflict and political transition. While traditionally much literature and many practitioners highlighted tensions between peacebuilding and justice, recent research and practice demonstrates a turn away from the supposed 'peace vs justice' dilemma. This volume examines the complex relationship between peacebuilding and transitional justice through the lenses of the increased emphasis on victim-centred approaches to justice and the widespread practices of disarmament, demobilization, and reintegration (DDR) of excombatants. While recent volumes have sought to address either DDR or victim-centred approaches to justice, none has sought to make connections between the two, much less to place them in the larger context of the increasing linkages between transitional justice and peacebuilding. This book will be of great interest to students of transitional justice, peacebuilding, human rights, war and conflict studies, security studies and IR.

This book was released on 2023-06-28 with total page 227 pages. Available in PDF, EPUB and Kindle. Book excerpt: Social work has long been working directly with the criminal and civil courts of the justice system. The work of Latin American practitioners in the legal system, however, is little known at global and local levels. This book is the first to go beyond Western-centric appraisals and presents a truly Latin American portrait of social work in the justice system. The long-term interaction of social work practitioners with the judicial system enabled them to develop an expertise to dialogue with other disciplines such as law and psychology. This knowledge is very important to identify and share with other professionals to develop specialized programs for education and training. In this sense, positive and negative experiences of social work in the justice system allow one to improve its practice. It is crucial to identify local experiences and the great dilemmas that the profession faces on this subject. The volume's chapters deal with these dynamics in Latin American countries including: Forensic Social Work: The construction of possible ways of the criminal intervention Socio-Legal Social Work in the Field of Criminal Defense Family and Community Life: Contributions of Social Work to the Debate in Family Courts Support to Victims in High-conflict Scenarios: An approach from the socio-legal, the pedagogical, and the care perspectives The Assessment of Child and Adolescent Sexual Abuse Allegations from a Social Work Perspective Latin American Social Work in the Justice System is essential reading for students, researchers, academicians, policymakers, and practitioners who are interested in international social work with a special focus on Latin American countries and legal culture. Students and scholars in law, development studies, and public policy as well as psychologists working with and interested in the judicial system would also find this book a useful resource.
